I financed a car through Exeter finance. Just over $9,000. I thought I was being taken care of. I am finding out that the interest rate that I am paying is illegal under usury law 28% interest. I called and asked if I could lower it because it was technically an outrageous and illegal rate. Exeter told me that they could charge up to 28% and that they didnt know anything about the legal limit of interest rates for car financing. I just want my interest rate down to the legal maximum at the very least. How can this be allowed to happen? Please help me. If Exeter does not lower I will need to file a suit and I would then be getting back all of the extra money I've paid because of the illegal rate. The amount being charged is twice the value of the car.

I am rejecting this response because:   Exeter Finance conspires with auto dealerships to inflate vehicle prices to cover a hidden finance charge, effectively passing on the discount fee charged to the dealer to the consumer. Here's a more detailed breakdown:
      Hidden Finance Charges:
Exeter Finance doesn't disclose the true cost of financing, including hidden fees. The cost of financing was disguised as an inflated vehicle price, effectively adding to the overall cost of the loan without the consumer's knowledge.  overall cost of the loan without the consumer's knowledge.
      Unlawful Repossession Practices:
The lawsuit alleges that Exeter Finance uses GPS tracking devices on vehicles to facilitate repossession, but this practice is not disclosed to consumers. The lawsuit claims this is an "unconscionable" invasion of privacy and a violation of state and federal laws.

      Complaint Statement:

Exeter Finance has committed ongoing fraud and unfair lending practices by falsely charging off my account for nine consecutive months, which is a clear violation of both federal credit reporting standards and securities laws. This action constitutes securities fraud, as each illegitimate charge-off creates a duplicate accounting entry for unjust enrichment and possible unlawful securitization. Despite multiple disputes Ive submitted under my rights granted by the Fair Credit Reporting Act (FCRA), including 15 U.S. Code 1681e(b) (requiring maximum accuracy) and 1681i(a)(5) (requiring proper reinvestigation and correction), Exeter Finance continues to falsely verify these entries as accurate.

This behavior has grossly and unfairly damaged my credit score, thereby violating my right to fair access to credit. Repeated charge-offs on the same account are not only factually false but also deceptive, as no new financial event has occurred each month to justify a new charge-off. These actions also raise serious concerns under Truth in Lending Act (TILA) violations and possible Title 15 consumer credit protection breaches.

I am demanding a full investigation and immediate removal of these fraudulent entries, along with appropriate correction of the record. Failure to do so should be considered willful noncompliance and deception under federal law.

I recently paid off my car loan with Exeter Finance. I made 44 payments out of 78 before paying it off. My original loan term was 72 months at 23.9% apr, and I extended my loan 6 times for a total of 78 months. The payoff amount was $12,024. The original amount financed was $15,513. The amount I paid in was $17,941, with the total amount paid $29,965. The total amount that would have been paid if the loan was paid off normally would have been $29,630. I paid $14,282 in interest, that being more than the total amount that would have been paid, if the loan would have been paid off as scheduled, $14,117. This is a simple interest, no prepayment penalty loan, and they are saying they don't owe me any money back. That was the whole point of paying it off early to avoid paying full interest. Paid off my loan almost 3 years early, so why am I paying interest on the almost 3 years that I paid it off early, when there is no prepayment penalty. This does not add up.
