Dear Better Business Bureau,I received a bill today for an overdue parking ticket paid by ***** on my behalf for a ticket that was supposedly issued from Diamond Parking during my recent rental from Banff July 3-8, 2024. This an erroneous and false charge from Diamond Parking company. I never received a parking ticket and would have certainly paid any ticket before returning my rental. I have never been to this area of *******, was never at this parking facility at ************************* At the time of the supposed ticket on 7/6/24 at 23:41, I was parked in the hotel parking lot for the 2nd night in a row, many miles away in ****** enjoying my campfire with family. When I looked up the "photo and notice details" supposedly available on the Diamond website, there is no evidence or photo available.Could you please assist me in rectifying this situation? I am very concerned about these false charges being perpetuated. Please let me know if there is any further information I can provide. Thank you in advance for your assistance.

On August 9 2024, I briefly parked in what I assumed to be a free spot to quickly load and unload some personal items which took around less than 5 minutes. However, upon returning just five minutes later, I discovered a parking ticket on my vehicle. The signage indicating that it was a paid parking area was not clearly visible. This gives the impression of a deliberate attempt to mislead individuals into parking there, only to issue them tickets afterward. It is right in the front ofmy apartment. I would appreciate a response from the vendor regarding this practice. If payment is required, the signage should be prominently displayed so that drivers are clearly informed of the need to pay in advance, rather than being obscured. I have attached the ticket image below with reference number. **********

On Aug 12 2024 I had to use paid parking on ******************. After I parked my van I went to pay station to make a payment. I've never used those stations before and it was very complicated to process the payment. After struggling with that machine for 10 min I finally got payment processed and receipt printed. Before I left parking lot I put proof of payment on dash. When I came back I found ticket placed under windshield wiper. When I got home I sent proof of payment to dispute department and thought it will be cancelled. Next day I was informed that payment was made to City of ******* and S/B to Diamond Parking. I called City of ******* to get help and was told that I made a mistake and it's my problem since Diamond Parking is private owner. First time users are very confused how to make payment and there is no sign or instructions how to pay and no one to help. If 2 organisations using same pay stations there should be clear instructions how to do it right. If city of Seattle ticketing customers there is legal way to fight it, but Diamond just want to collect money as much as they can. City of ******* should take over all parking spaces and Diamond should be out of this business if they cannot make it convenient for customers. I followed the rules and made all efforts to do it right and should not be punished by paying extra $65 on the top of the parking fee that been paid on time. Diamond should have a way to get that fee back from city of ******* since they agreed to use same pay stations

I pulled in on a parking lot located in *************** ******* to drop off a document to ********************. *********** is located as well within the parking lot managed by Diamond Parking. I went inside the medical clinic and came back after around a minute and saw their parking staff taking pictures of my vehicle. The parking staff was just parked beside my vehicle as I saw him there before I went in. He said that I walked off the parking lot and the medical clinic is not part of their coverage. I said that I was just gone for 1 minute and there is no way for me to know that the medical clinic is considered outside of their coverage already as it is located within the parking lot. I tried to appeal to the parking staff to be considerate as he could have just called my attention to move my vehicle before I went in. He left an $83 parking ticket on my windshield and just told me to contact Diamond Parking to file a dispute.I felt that I was scammed by this parking company as they are not really prioritizing managing their parking lots but just waiting for unsuspecting victims to make thje tiniest justifiable mistake and make money from them. I have read online that there are more than a hundred complaints filed against this parking company already so that speaks volume of thier reputation.

On June 30th, 2024, I parked my vehicle in an alley off to the side and not impeding traffic. This alley fed into a parking lot managed by Diamond Parking LLC. I was parked there for about an hour, and returned to find a ticket/notice on my windshield. I looked around the alley and confirmed that there were no signs posted at all. Not a single "no parking" sign, colored curb, or Diamond Parking sign. I felt comfortable parking there because there was no indication that it wasn't allowed, nor was there any indication that I was required to pay to park there. Otherwise, I wouldn't have parked there, or I would have paid Diamond Parking to park there.Since then, I have been working through the appeal process with Diamond Parking. We have exchanged a number of emails back and forth. Ultimately, after they made some claims that they could not support, they just told me that I had "broken terms and conditions for parking in this location". Again, the problem is that I never entered into business agreement with them because no sign told me that I was. So how could I have "broken terms and conditions"? I didn't even realize I was parking in a Diamond lot! I told them that a police officer cannot ticket you for speeding when there is no posted speed limit. This alley situation feels like entrapment on the part of Diamond Parking. I'm an innocent person parking in a place with no indication that I'm doing anything wrong or that I'm required to do anything to be there.

      Customer Answer

      Date: 08/16/2024

      Hello,

I missed the 7 day window to respond.  Sorry about that.

Again, the response from Diamond Parking is ridiculous.  The business response states that the fine is correct because:

      1. I was parked on private ********************
      2. There is a Diamond Parking sign in the ********************

The first point nullifies their authority at the location of my car.  It would be up to the private property owner to handle unauthorized parking on their property, not Diamond Parking LLC.

The second point infers that a Diamond Parking sign hundreds of feet away applies to my vehicle location.  So if I park on the street hundreds of feet from a Diamond Parking sign at the entrance of a lot, Diamond Parking has authority over the location of my car?

As usual with these sorts of things, it is not about justice.  It is not about truth or fairness.  It is not even about being reasonable.  It is about money.  It is about who can argue the longest.

We sold a van in good faith on 8/11/2021 to an individual. We did what was suppose to be done and reported the sale to DMV and called it good. Unfortunately we get mail from Diamond Parking saying we owed them $91 in February of 2024. My wife promptly emailed them saying we sold the vehicle and showed them the written BoS and the screen shot that we are no longer owners of this vehicle. No word comes so my wife calls, the lady was rude and brisk, said there is nothing that can be done we obviously have the proof and they won't send us to collections. The letters stop for a short period of time. Then now in July 2024 we are getting letters again but this time more urgent. I need to make this bill go away that isn't ours and I do not want to deal with a credit company trying to collect from them. BBB Complaint # ********

Thank you for contacting Diamond Parking Services. We are responding to a complaint filed with the Better Business Bureau.
You have advised us that you have sold or transferred the vehicle that received a parking notice from Diamond Parking. Please refer to the sections below marked with an X. These are explanation related to the complaint.
__X___ We have received your Bill of Sale or Transfer of Ownership form with the buyers details. Thank you.  This document, however, is insufficient as proof sale because it does not provide any information related to the buyer or the buyer's signature authorizing the transfer. We have not updated the records to the buyers information or the prior owners you have provided on an official form. I have attached the correct form to provide regarding the sale of the vehicle.
__X____ The *** shows that you are still listed as the registered owner of this vehicle and the transfer is pending, and we have removed you from the notice(s) and will stop the recovery mail from coming to you. IMPORTANT NOTE: The buyer has not registered this purchase and has not paid the fees and taxes within thirty days of purchase, a violation of State laws with penalties of up to $250. The buyer has NOT paid the parking notices fines. A seller can ensure proper transfer to the buyer and avoid this problem by removing the license plates from any vehicle you sell privately or by meeting the buyer at the *** office to ensure that the transfer occurs successfully.
__X___ You are the registered owner on the official *** records. We are required to use the official records to identify the responsible party for our parking notices. The buyer has not registered it. In such cases, the *** does not update the buyers information until and if the buyer registers the vehicle, the second step in the transfer process. If you have not yet done so, please provide us with a copy of the bill of sale or *** document OR BILL OF SALE FROM THE DEALERSHIP. No handwritten paperwork please. With these documents, we will remove you as the listed owner on the parking notice(s).
___X__ You dont have the buyers name and complete address? If you do not have the contact information for the buyer, we will still stop parking notices from coming to you in the mail when you send us the release of liability document or a bill of sale.  We will remove you entirely for our notices with a completed transfer form with buyers name and full address provided.
If you should have any questions, please contact our office at **************. Please call or e-mail us rather than sending letters in the mail to expedite the resolution of this issue. This is an attempt to collect a debt, and any information obtained will be used for that purpose.
Under the provisions of the federal Fair Debt Collection Practices Act (FDCPA), and the **************************** Act (WCAA), we are required to provide you with the following notification (which is required by law to be included in all correspondence concerning the collection of outstanding parking fees and penalties, even if such fees and/or penalties have been waived or resolved as in this case):

I received a notice of a parking violation at *************** in *******, ** via mail, that included a link to photos of my vehicle with a ticket on the passenger side under the wiper blade. The photo did show my vehicle with my license plate. The violation notice stated that I had exceeded the allotted (3 hour) parking limit, and was showing that the photos were taken at approximately 3:01pm on April 16, 2024. I had just arrived at the location and parked in that spot at about 2:40 pm for an appointment, coming from work, where I was working from 9:00am to 2:00pm. Upon arrival to my vehicle from the appointment at 4:00pm, there was NO ticket on my vehicle. I sent the appeal, and ultimately they told me "too bad" and that I had been parked there. I attempted to contact them by email and by phone, and did receive an email stating that they would reduce the cost, however I never received a phone call. The file was eventually sent to collections, where the letter said that Diamond towing had sent me notices (correct), and had tried calling me multiple times (false).

Today, July 12th 2024, I parked at my work at 9 am, where I am permitted to park by my employer. I didnt return to my car until 5 which is when I saw a parking ticket from Diamond Parking LTD. The ticket said it was for unauthorized parking (which is untrue) and they said that it was because I parked in the parking lot and then walked off to the mosque across the street. They claim this occurred at 2:09 which cannot be possible as I was inside my work the entire time. Ive known about this problem but this is the first time its happened to me. This company puts tickets on random cars and claim that theyve walked off to the mosque. They are fraudulent and try to scare people into paying their tickets. Its a frequent occurrence that customers and staff are getting ticketed for no reason as they are patrons of the business I work at, not people going to the mosque. I called the number on the ticket and they cancelled the ticket but they said that its still a warning. When I asked them to make it so it wasnt a warning they said there was nothing they could do.
