On Tuesday 10/31/23 at 8:17pm, I parked in zone # ***** in **************. I paid $12.90 for 2 hours of parking (session ID ******************. When I returned to my car at the end of 2 hours, I had a ticket on my windshield. Ref # **********. The ticket was given at 9:02pm, less than an hour after I paid for parking. I was confused, since I had already paid to park in the lot for 2 hours. Upon looking at the ticket, I noticed the that license plate on the ticket was actually 1 digit off of my actual license plate number. So clearly, whoever was checking license plates just accidentally typed mine in incorrectly. Technically, since the ticket was given to a different license plate number, I don't really need to do anything since the ticket is not associated to my actual license plate. But I don't want to create a headache for the owner of the car who you gave a ticket to, so I decided to try to dispute it.Well I disputed the ticket online. I provided proof of receipt and proof that my credit card was charged for the parking lot fee, per your website instructions. Also, when I pull up ref # **********, there is a picture of my car which includes my license plate, and it's very easy to check that my actual license plate is 1 digit different (the last letter) than the license plate on the ticket. I just heard back on the dispute outcome. I was expecting Diamond Parking to void the fine since I clearly have paid and it was just a mistake by the employee. But no, Diamond Parking only REDUCED my fine. This feels illegal to charge me a fine for your mistake. I paid for parking correctly, your employee made a mistake, I've provided proof that I paid, there are pictures showing that the license plates don't match, yet you're still making me pay a fine?! I would like for Diamond Parking to void the fine on ref # ********** so that it shows $0 is owed. I owe Diamond Parking $0 additional fines since I paid for parking correctly.Business Response

Nov. 9th 2023 I parked in lot **** next to my business as shown in attached photos of documentation, where my receipt clearly confirms payment and location for 3:04-7:04 PM. When I went out to my vehicle I had a ticket and notice (ref. # **********) for lot B224 issued at 5:24 pm on Nov 9th. I paid for my parking in the lot I was in for the time parked so the ticket is completely inaccurate and inappropriate. My second problem occurred just prior on 11/8/2023 - I parked in a lot across from ********************** in ******* **, I went to pay by scanning the ** code on the sign, when I did so the location did not appear in my ParkWhiz app and it did not give me an option to pay at this lot leaving me to believe it was public free parking at the time I parked due to the signage and the missing lot location in the app at the time. I was given a ticket for *****. I pay for parking near my business to Diamond multiple times a week and have paid them hundreds of dollars yet they continue to hand out tickets unjustly like they are candy. I would like the most obvious solution to be solved ASAP where I was given a ticket for lot B224 while I was parked and paid for in lot B015 by removing this ticket completely and further action taken to make sure employees are educated on their job properly and not handing out tickets in the wrong lot. This has happened to coworkers in this location as well.Business Response

I am rejecting this response because: I have called many times and told the agents that the car is not mine and I didn't file for the dispute. I also told them that it could be someone else who might have given my information which is fraud. However, agents refused to listen to me and told me that I am lying and were extremely rude and disrespectful. I asked to speak to the manager, and she hung up on me. That car is not mine and I will not pay for something I haven't done. If it was my car and I got the ticket, I have no problem paying for it, but I will not get into this scam and pay for something I am not responsible for. Please contact the property manager and get the correct information, tow the car etc. Also, remove my name from collections. I am getting calls every day and getting harassed. I would not like to get this on my credit report. If you have further questions, please let me know.
Sincerely,
Dure LatifBusiness Response

Hello,
A notice was issued to this plate for unauthorized parking. A dispute was submitted through the online portal using your name and contact information and then confirmed you are the registered owner of this plate/vehicle. Once this was submitted, the next parking notice issued will also be linked to you because of this confirmation. On this appeal it was stated We live at this complexwe were not given a warningwe will not park there again. The appeal resulted in a reduction as a one-time courtesy. A payment was not made. We have now received the information from DMV, and received back that this vehicle resides at this address from the appeal but a different name. You called into the general information line and stated to multiple agents that you are not the owner. We have now removed the owner information from 2 other notices under this plate, but the owner information provided for the original dispute for ******** will remain as is based on you providing this.
The DMV information will be attached to the others, and the ****************** will be notified and updated.
Please advise if you originally created the online dispute for notice reference ******** or if this was done so fraudulently, we will then take the next steps such as notifying the property manager, towing the vehicle etc.
Regards,

I am rejecting this response because: it is just now in this email that they are telling me to park on 2nd floor, I was not aware of this because of their unclear instructions. And even while rejecting my dispute on their website they didnt say that. They do not have this written on the permit and neither in the parking lot. I only saw tenants only separate parking which has a gate and I dont have code. So I followed the only instructions that were provided on the permit that is to hang that thing in a visible area, which I did, and I have submitted pictures for this already. And after their denial I have not been parking at that spot, so what more do you need? I am not giving them any money as they are unclear in providing their instructions.
Sincerely,

Hello,
Our goal with any customer is to advise you of the rules for this parking lot to prevent from being ticketed in the future.
Please be advised Diamond Parking is contracted to enforce the rules of the parking facility for the property owner due to unauthorized use of the lot. You were ticketed in a stall that is limited to 15 minute parking only and is not negotiable. Please note that being a permit holder does not negate these rules, you must park in your designated area for staff/tenants which is the 2nd level of the parkade.
Since the vehicle exceeded the allowable 15 minutes in this stall, the notice is valid. As a courtesy, we will make a one-time reduction to $45.00.
Please visit www.diamondparking.ca to remit payment at your earliest convenience.
Regards,

I parked in the lot at 8:56 and paid for 4 hours and was ticketed at 11:11 for not paying. I tried to send proof of payment with the same document I attached to this compliant, and the appeal was denied.Business Response

I am rejecting this response simply because of the truth:1/ First of all, the documentation I submitted MUST BE accepted 100%. Just listen to me, It was a REPRINT of the Original Receipt: Transaction Number ****************. You can still go there and ask for a reprint again if you tell them the date, time and what was bought with my CASH. Every detail is on that REPRINT receipt.
2/ There is 30 minutes parking limit and I stayed within the posted limit.
3/ I was a CUSTOMER. See the submitted receipt/reprint. I did NOT leave the property. PERIOD!
Diamond Parking Predatory Parking enforcement is absolutely unethical and unacceptable.
I can provide the explanation again to BBB and/or Diamond Parking.
Sincerely,

Hello,
First, I want to state that this location is private property, and all parking rules have been created by the property owners. Diamond Parking has been hired to enforce these parking rules as posted on the property due to the unauthorized use on the facility. One of the rules posted is that you are not permitted to leave the property without your vehicle, or you can be ticketed and/or towed. Reserved exclusively while shopping at BCL only is posted clearly on the signs throughout the property as well as the ones in front of the vehicle and behind the vehicle, as per the photos on file. Once you leave the lot you are in violation. Specifically in your case, you were witnessed by our patroller leaving the lot which put you in violation, as stated on signage, and the patroller is contracted to immediately issue a notice. Also, the documentation you submitted was not accepted. The paper you sent is not a BCL receipt. It is typed on copy paper. Also, the patroller issued the ticket almost 20 min after the purchased time on the paper you submitted. You may have gone into BCL, but you were ticketed for leaving premises without your car after. Unfortunately, the was valid as Diamond Parking must uphold our contractual obligations. Thank you.

I did not park the vehicle in this location and do not assume responsibility for this citation, which I am only finding out about over a year later. There was a parking service valet for this event for which I was the hired wedding photographer, and I was directed to hand my vehicle over to them upon arrival at the venue. Upon dispute with diamond parking and at their request, I've provided documentation to indicate this. In the photo on the citation you can even see a valet ticket. Diamond is still holding me accountable to this violation even though Ive provided all the evidence needed to absolve my responsibility and provided contact information for the valet service.Business Response

He agreed to address this mistake by Diamond Services with them directly and I indicated I would also follow-up with Diamond Services.
