I recently parked at the Diamond Parking Lot (#A801) located in downtown ******* and was issued a parking ticket, despite having paid the fee. The ticket's reference number is **********. I can confirm the payment, as it's reflected in my bank statement. However, I dont possess a physical receipt since I made the payment through a third-party website, which was recommended at the parking location.It's concerning that I've been charged $65, especially with the warning that this amount would be forwarded to collections if not settled. I am writing to formally dispute the parking ticket I received on Sep,6th 2023. I parked my vehicle in the designated parking lot outside Dollarama at Brentwood Rd NW. My purpose for being in that location was twofold: I had visited Dollarama, and subsequently, I went to attend an exam. I came back before 3:15 p.m. I entered my vehicle to set up my GPS and prepare to leave, but then I found a guy walking around my car and staring at me. So, I waited in my car for a few extra minutes to make sure that I drove out safely and not to hit him. Then I found he was starting to take photos of my car. I didn't know what he was doing initially. When he walked away from my car, I went to ask what he was doing. He said he gave me a ticket because he thought I didn't plan to go and exceed the time limit. I explained to him that I didn't go because I was waiting for him to leave. He suggested calling their company's service number, but the company didn't accept the appeal through a phone call. I submitted an appeal request on their company's website, but no response. They charge $120 if no pay within 10 days. I don't know what to do. I came back to my vehicle within the time limit. However, waiting for their staff member to leave resulted in exceeding the time limit. I entered my car before he came. He didn't ask me if I was going to leave and he didn't show his identity to me before the ticket was issued. If I had known he was waiting for the time and issued the ticket, I would have left before 3:15 pm.Business Response

On August 16 I was visiting my aunt in ********* and parked in lot 4809A. Im a mom and was holding my 5 month old baby who urgently needed a diaper change as well as a change of clothes as he had gotten car sick due to motion sickness. I parked as close as I could to the meter to get faster access and go to the bathroom to aid my baby. When I got to the meter I put in my credit card and it said declined which was strange and should have not happened because I had more than sufficient funds, I then tried to call Diamond Parking to let them know what had happened, my baby was throwing a tantrum so I asked my cousin to try her card since my baby needed attention asap. She put her credit card and it said declined as well. I asked her to accompany me to the bathroom which was steps away from the meter as at that point I needed help with my baby and asked her to call Diamond as we walked to let them know that the meter was not working and what had happened but no answer from Diamond. We rushed back should have not been more than 4-5 min and we had a ticket on the dash. I then called my bank and they told me the transaction went through but was pending as thats how it usually works with credit cards. My cousin also called and had a charge for the same amount and was also pending. I then called Diamond to ask and let them know and instead of finding someone to speak to I only encountered rude agents *********************** was one of them who was offensive and made me feel bullied. I had to hung up because this was unacceptable. Im just a customer inquiring and not someone who calls to be mistreated. This was unfair for me, I was in a vulnerable situation and instead of being empathetic Diamond parking chose to tell me that maybe I dont have the ability to use meters. I know these agents are trained to respond that way but its not fair for the clients who did encounter an issue with one of their meters. Terribly disappointed with the lack of values from all agents I spoke with.Business Response

I am sorry to hear about your frustrations and experience with us. Our goal with any customer, is to provide the reason the notice was issued to prevent it from happening again in the future.
Please note that the machine chip readers, as directed, you must leave the card inserted the whole time until the machine says to pull it out, otherwise you will get a declined error. This process can take a minute or two. If the card is pulled out before the transaction finishes then a declined receipt will print as we have collected no funds but your credit card provider has still got a notification of the transaction trying. This puts it as pending on their end. This will drop off once confirmed that it was not processed. Also there is 4 different payment options at this location. I understand the hurry however, parking must be paid to park. We will reduce the notices as a one-time courtesy to $45. This will hold on your account until end of business day Monday Sep 18th,2023. To receive this courtesy please call our office at ************ and quote your reference number. Thank you!

I am rejecting this response because I attempted to pay many times, left my card for more than 2 minutes even after it said to remove my card as it said on the sign. I asked someone else to also run their card through, I then went ahead and attempted to contact somebody while I was there for less than 10 minutes. At all times I had the intention to pay as Im outlining here. To top that I had an extremely rude representative on the phone who if I didnt hung up would have continued bullying me. The fact that ** asked to pay still is just unacceptable. I think its only fair to remove this tickets based on all the events here.

I am sorry you feel we do not have empathy to your appeal,however, having issues with the machine does not negate the fact there are other ways to pay that were not utilized. Two of the options are stickered on the front machine (pictured), PayByPhone and ParkMobile. If one method is not working more are provided to prevent a customer being unable to make payment. Diamond Parking must uphold our contractual obligations to the property owner by enforcing parking notices. This notice is valid.I did offer a reduction as courtesy with a deadline. That deadline was ignored/rejected. Unfortunately the notice will remain outstanding.

You are acknowledging that your machine did not work properly (the fact that there is a sign in the machine shows it was faulty) You are aware that I wanted to pay I showed you the card statement from two different people. This means we wanted to pay. You know I was in a vulnerable state carrying a baby and you respond being in a rush is not an excuse to not pay. Your employees are trained to mistreat over the phone which is why I had to contact you through this method.
Im trying to inform you and tell you the situation and you dont seem to understand . Its not the money is the principle and the way that you treat your customers . Im in the process of bringing this case and the service you are providing to the media. I have already connected with other people that had a similar issue as me with Diamond parking and have a follow up call with a reporter from ********** in the week.

I have since learned the parking fees were not paid on site. I am willing to pay the initial parking notice fee of $41.50 each but we did NOT receive a ticket on either car that day, and I only received notice by mail after 60 days when each notice is now increased to $83 each. Im fine with paying the $41.50 for each but Im firmly convinced Diamond Parking utilizes predatory and illegal practices to increase fine amounts. Complete scam organization. They will ticket you while you're still in your car paying to park. Their business motto is "100 years of 'service'" (added emphasis on service mine) but I'm not sure what "service" they are providing A. charging someone $63 to park in a near empty parking lot for four hours or B. ticketing people sitting in their car deciding if they want to park there. Im not going to submit it again. The fact you have a ***** rating in yelp (one 2 star review on 172 one star reviews) as well as a plethora of other negative ratings every place you have any parking leads me to believe you do this quite often and should not be given the benefit of the doubt as a company ever. Hello,I am filing this report as I believe the company Diamond Parking Service is attempting to unethically collect undue fees from customers for supposedly invalid parking. I parked today(Friday 8/25/2023) in a lot in the Capitol Hill neighborhood, the **** 13th Ave parking lot. Paid for an hour of parking(12:35-1:35pm) with the posted app in the lot "ParkMobile", app zone 770538(I have a receipt proving my payment for parking at this location). I can validate my whereabouts at the time at a local in close vicinity to the parking on 13th Ave.Upon my return at 1:30pm, I find a ticket dated 8/25/2023 Time: 1:15pm. The ticket states "no advanced payment" and that my car is located in lot A458, on ****************** After a quick search I discovered that the mentioned lot A458 is nearly a mile away from where my car is actually parked. I want to bring awareness to possible unethical business practices designed to extract undue fees from customers who ignore or fail to dispute the false charges. If this is a mistake I will give Diamond Parking the chance to rectify and null the ticket before I pursue further action in this matter.Business Response

Rec'd a parking ticket from Diamond. Signage on site (**** Kingsway) states 1 hour parking *** for ******* Customer **********************. I purchased items from ******* & did not park more than 1 hour. The signs states "for unauthorized parking" a fine of $70.00 plus tax would be imposed. The ticket issued was for $80.00 & a handling fee of $6.50 for a total of $86.50. The sign does state the ticketed vehicle could be subject to extra costs to collect unpaid tickets, but does not mention any other fees. I have attempted to resolve the issue twice with Diamond. It appears they never reviewed my appeal & have sent me a standard response, as it indicates I did not shop at ******* (I provided a receipt showing that I did). They also did not respond to my question about the discrepancy between the posted rate of $70 & the amount I was charged of $86.50. When I attempted to followed up with my concerns I was advised they will not review the matter further as my appeal has been denied. I don't feel I should have been issued a ticket as I have provided documentation to support I shopped at ******* and was not parked there for more than one hour. I am also concerned that Diamond has contravened the Competition Act of ******, notably Section 74.01(1) by posting a sign stating the fine will be $70.00 and then charging $86.50. I have pictures of the ******* receipt, the parking ticket and the sign onsite.Customer Answer

Hello,
Please note the notice was issued to the vehicle for unauthorized parking. This facility is strictly reserved for customers only while doing business. Drivers/passengers are not permitted to leave the property without their vehicle for any reason or length of time before or after going to ******** as clearly stated on the posted parking rules signs throughout the location. If a driver wishes to conduct errands off the property they are permitted to do so by parking in the pay section of the lot. You submitted an appeal online on Aug20th and were responded to on Aug 22nd to the email address provided by you. It was denied as there was no attachment as stated and you were requested to submit the receipt to our general inbox. This was to be reviewed as a courtesy. Once received it was used as a one-time courtesy cancellation as the ticket was still valid. It has been noted and we will bring to the property managers attention regarding the update of the rate on the signage, however for reference, this would not be means for cancellation but a possible reduction of the $10 difference. I parked in downtown ***** on July 28th 2023 and used the ParkMobile app to pay for my parking. I was standing by my car as I was parking, so that the app can pick up my accurate location. I paid for two hours, from **** to ****. I returned to my car and found a ticked from Diamond Parking for 41$ and some cents, stating I did not pay for my spot in advance. The ticket was issued at **** pm. I contacted Diamond Parking and explained the situation, and attached a screen shot of my e-receipt. I received a reply from ****************, stating that my fine was reduced to 16.50$, but due to violating their terms, I still had to pay it. I replied back and asked what terms did I violate, and he stated that I paid for the wrong parking lot. Again, I used an app that uses GPS to track my location to pay for this, and I was standing by my car as I was paying. I have two witnesses who saw me do this. I have not received an answer back from ******, so I am please asking you to help me with this. I have made every good faith effort to pay for that parking spot. Somebody is running a scheme to make more money off that parking lot, i have seen at least 3 other cars with tickets in their windows that same night.Business Response

Paid the parking fee to park in the lot behind PF Changs ************ ************** ****. I am from out of town. I never received a reciept and at that moment didn't think to check my card to see if it went thru.
