I parked at *********************************** in **************, **** on October 28, 2022. The ticket states that I walked to ***************** in **************. First, I would like proof that I, in fact walked there. Second, I am completely disturbed by the fact that this company has a legal right to follow me to a destination. This is stalking and harassment. To follow me off of a property that they are putting tickets on cars at is completely offside and has caused me extreme anxiety.

      Hi,

Thank you for your email.  Please note that this location is private property and all parking rules have been created by the property owner(s).  Diamond Parking is provided a list of specific rules and is contracted to enforce by ticketing and/or towing based on the challenges the location faces due to unauthorized use. The parking rules posted on the property state that drivers can only park their vehicle while they are a patron of ************* on the property.  If a driver leaves the property without their vehicle at any time they will be subject to ticketing and/or towing. When a patroller witnesses this act,he is contracted to issue a ticket to that vehicle. Diamond parking does not follow persons off the property.  Only, to be eye witness to the infraction and note a comment to describe the violation on the ticket.  A provided receipt to show you did in fact conduct business would be reviewed as a courtesy as the ticket is valid.  This can be submitted to our general inbox ************************************ for further review.  Thank you!

*************: There is no way anyone could have determined if I went to *****************, as it states on the ticket, unless I was followed.
As per our laws in ******:L, stalking and following without consent is illegal:
264 (1) No person shall, without lawful authority and knowing that another person is harassed or recklessly as to whether the other person is harassed, engage in conduct referred to in subsection (2) that causes that other person reasonably, in all the circumstances, to fear for their safety or the safety of anyone known to them.
Further, if I required a printed receipt from the business I received service at in that parking zone space, it should state this clearly on the sign in the parking lot.
I mailed my cheque today to your Diamond company and request a full refund as soon as possible. I also suggest to BBB that parking attendants not be permitted to follow/stalk citizens for the sake of making money. It makes me feel fearful and anxious and I am terribly upset that someone says they did this. Further, I suggest Diamond Parking state on their sign in the parking lot that receipts are required from businesses in that area.

      Sincerely,

On Oct 27th I parked in a stall operated by Diamond Parking and paid as required. I park at this exact same location often as my work is close by. This location only recently implemented a new (pay online) payment system sometime between Oct 13 and Oct 27th, as on Oct 27th (the date of my Payment Notice) the payment machine indicated that only payment online via QR Code is now accepted. I scanned the code from the sign at my location (image attached) and paid (image of receipt attached). Upon returning to my vehicle, I discovered I received a parking violation notice from Diamond (Payment Notice image attached), Ref# ********.It is clear that there is some signage/pay system error at this location. For reference, attached is a copy of my last prior receipt for parking at this exact same location, on Oct 13th. Note that this receipt indicates the exact same Location Code = C236 as indicated on my receipt for Oct 27th.When I next return to this parking lot, I will have to pay exactly this same way until the signage/QR code is fixed or the payment system is fixed as I have no idea why this happened and I paid in good faith for my parking, as I have at this exact location without any issues prior. Please review and fix this issue. I assume with this info you will certainly cancel the Payment Notice (Ref # ********). Thank you kindly in advance.

      Hi,

Our goal with any customer, is to provide the reason the notice was issued, find a mutual resolution and to prevent it from happening again in the future.  If you notice on your payment screenshot, the license plate says ******.  When the patroller runs the report for payments, he is unable to recognize this as a license plate and a ticket issued as your plate will not show as paid.  We do see that your payment has been made for parking and your notice has been cancelled.  Please ensure that you enter your plate into the app for recognition on patrols moving forward.   Thank you.  Have a great day!

On Saturday 10/29/22 I attended an evening event at a local establishment in downtown *******. This was my first visit to ******* since March 2020/Covid. There was no available street parking nearby. I needed parking within reasonable walking distance due to physical limitations related to a major surgery. I remembered there was parking available at the ************* (closed ********** as we parked there many times for free when attending events, prior to Covid, with our local ************************. There were 6 vehicles parked there - and a large vehicle had pulled in just before me. I did not see any large signage or posted notice that the parking lot was being managed by Diamond Parking. I did not see any details like a kiosk or cash box for payment, or numbered spaces common to paid parking lots in ******* or ********. Nor did I notice the people who parked before me making any payment. Bottom Line: I was unaware I was expected to pay to park in this lot. I parked at 7:15 and upon return found a ticket on my windshield issued at 8:21 pm. The other vehicles parked next to me were gone. I then saw two small signs posted on a small section of chain link fence indicating paid parking with a QR code. This signage was not visible previously due to cars parked in front and around it. I attempted then to scan the code to pay and the code did not work. The ticket Ref#********** was for $46.50! And if not paid in 15 days would be $76.50! Frankly it is exploitive to charge such amounts. I did not willfully fail to pay. I attempted to pay - although there are NO rates posted for parking - once I became aware of the situation. However the scan/pay process failed. A business expecting payment should follow equitable and fair practices by advertising clearly expectations for payment; including the amount charged per hour. And it is inequitable and unjust to offer only one method for payment - requiring a smart phone and credit card to make payment.

      Hi,

Our goal with any customer, is to provide the reason the notice was issued, find a mutual resolution and to prevent it from happening again in the future.
This location is private property and has the parking rules posted.  It is to be monitored at the request of the property manager, and Diamond Parking is provided a list of specific rules and is contracted to enforce by ticketing and/or towing based on the challenges the location faces due to unauthorized use. Please note, on this lot ************************ you are not permitted to leave and patron ************, or elsewhere besides ********************** while parked here.  Being witnessed doing so will result in a ticket and/or tow. There is ample signage not only in this area, but throughout the rest of both properties stating these rules. Please also note the caution painted on the driveway property line warning that you are about to leave the shopping centre into the neighboring ************. This is again, not permitted, and why we are contracted to enforce.  I have attached a ****** map snippet and circled the signs just in the area you parked for reference.   This notice is valid. Thank you

      Complaint: 18328033

I am rejecting this response because:

I have attached 3 photos.  The third is where I was parked.  As you can see you can not attend the businesses from the back-end, it is for staff only.  The only way to use this parking lot and go to the businesses is to walk out and around.  This lot is inappropriately ticketing cars who use it, knowing customers must walk around.  This is clearly evident when I was told that my parking appeal was denied for a parking lot I did not park in.  (See below)

APPEALS AGENT COMMENT(S): Thank you for your submission. The parking rules for this location are very strict. The signage provided clearly states this is for Wendys customers ONLY, WHILE in the restaurant. Which means, if a driver leaves their vehicle in the parking lot and leaves to walk anywhere else other than Wendys, their vehicle will be subject to ticketing and/or towing. The maximum allotted time is ONLY for while they are in Wendys. This is not permitted for visiting Wendys and combining visits to other neighboring stores as well. As this is the vehicle license plates first notice with our company, if the driver has a Wendys receipt/transaction slip from the day/time on which the vehicle was issued a notice, please forward a copy to ************************************. Once received, we will consider and review. If there is no documentation to be submitted for review, please consider this notice valid. The notice will remain open and payable in our system.

There has been no response to the query about the parking lots location, the requirement to walk around as these are business owner doors and not customer doors.  When I requested a response about this not being possible and that the sign does not indicate "no-walk offs" (because it is not possble) I was told:

"It does say on our signs.  Just because you never read it doesnt mean it wasnt there. If there is no receipt to show business was conducted at Delta shopping center this notice will remain open. There will be no further communication."

This does not seem like a company that is trying to find a mutual solution.  If I was properly and fairly ticketed this would not be an issue.

      Sincerely,

      *****************************

I was on a business trip and had a business meeting in which I parked at parking lot #****. I tried paying for parking via the ** code around 5:45pm when I arrived and parked, but the ParkMobile app showed an error message "Payment not accepted" and did not allow me complete the payment. I tried this multiple times before heading to my business meeting. Once I got the opportunity again to try paying via mobile, it was at 6:16pm, and I was able to finally get a payment through via the app for the amount of time that I was going to be parking there. Upon returning to my car after my meeting, I found a ticket on my car with a timestamp of 6:13pm. I submitted a dispute since I felt it was unfair to not have the ability to pay for the parking from their ** code and then get ticketed for $66.50 even though I had made every effort to pay for the entire time I was parked there. It took almost a full week to get a response, and their support rep asked me for the end time from the parking receipt. The problem was that there was no end time listed on the parking receipt. I provided literally all of the information and documentation I had, including the emailed receipt. Given the information and documentation I provided to the support rep, I'm baffled why they can't look up this transaction and understand that I paid for the parking. Given how slow the pace of email communication was with the rep, I ended up just paying the $67.50 in order to not get charged the $103 after 15 days, but I would like a refund of that $67.50 and to have this penalty removed. Why even ask a customer to provide information that's not available from receipts using their payment process to prove I paid for parking there? It feels like they are unnecessary hurdles that make it harder to dispute or prove anything within the timeframe before penalty increase.Parking Reference Number: ********* Authorization ID: ****************************** start: 6:16pm License Plate: ****** License ***************

      Hello,

Thank you for your email.  Our goal with any customer, is to provide the reason the notice was issued, find a mutual resolution and to prevent it from happening again in the future.
Please note that this location is private property and all parking rules have been created by the property owner(s).  Diamond Parking has been hired to enforce these parking rules as posted on the property due to the unauthorized use on the facility. The lot is clearly signed. I have attached a picture of your vehicle parked in the driveway in front of the sign stating it is unauthorized to do so.  Diamond Parking must uphold its duties to the owner and enforce accordingly.  It is the drivers responsibility to be aware of where their vehicle is parked at all times. This ticket is considered valid.  Thank you.  Have a great day!

I parked in a lot on a Saturday afternoon for a business that was closed. There was a sign for pay by phone above the spaces I was in. I attempted to use this feature, yet when I attempted to pay, it said it was not accepting payment yet i came out to a ticket from Diamond parking on my card. I was parked on the south side of the building, parallel to the drive through. How can this business advertise a payment method, not accept it, and then charge you despite your efforts to pay? In addition, this business forces you to pay before you can appeal your ticket and follow pedantic rules to appeal. Do better.

Thank you for bringing this matter to our attention. After researching the Pay by Phone rates, It appears this was an error on our third-party payment system which could have been having technical difficulties on the day you parked with us.

However, because you were unable to pay for parking on this day, we will refund the parking notice payment you made on October 8th,2022.
