From the start, under Section 43(a) of **************** Act, our team and company was mislead and falsely advertised to by Best Version Medias and their sales representative, *********************, we meet with the sales representative in ***********, **. Our team agree that we would not sign up if it was a contract, had terms, or was to expensive, as we are a small company. The sales representative ensured us that it was NOT A CONTRACT OR TERMS, PAYMENTS WERE MONTH TO MONTH, and we could CANCEL ANYTIME WITH NO PENALTIES. We have NOT RECEIVED A SINGLE CUSTOMER from **********************, nor have we ever received a copy of what our advertisement looked like. We asked to not run our ad the month of Oct 2022 and to cancel. Where he claims it was not going to run but we still got charged because we didnt sign an amendment. After no word from *********************, we reached out to Best Version Medias headquarters many times but no one would answer the phone. **** claimed we would not be charged Nov 2022 through February 2023, which if true is a breach of the contract on Best Version Medias end, because of the CLAIM ADS CANNOT BE CANCELLED ANYTIME and not only that, WE WERE CHARGED FOR THE MONTHS BEST VERSION MEDIA CLAIMS TO HAVE NOT RAN OUR AD. STATED MANY TIMES WE NO LONGER WANTED OUR AD FEATURED WHICH WAS IGNORED. After months of no communication from Best Version Media, we were randomly sent an email and voice mail that we owe almost $8000 and then received a phone call by a person who called us and intimidated us to pay saying we owed $10,000 and threatened us by claiming it was sent to collections. We would never have accepted this deal if it would be this costly. We are not the only company to be falsely advertised and lied to about Best Version Medias predatory business practices, lack of communication, and intimidation. Our team is willing to file a complaint with Federal Communications Commissions (FCC) if anymore intimidation is attempted by Best Version Medias.Business Response

I am writing on behalf of our not-for-profit organization ********************** to seek your assistance in a matter of great concern that has significantly impacted our financial health.In 2021, we entered into a contract with Best Version Media ( #E-267092 / NO / 1) for advertising services in their magazine. At the time of signing, we were under the impression that this would be a one-year commitment and would effectively generate leads and ****** engagement with potential supporters for our cause.Regrettably, despite our continued financial commitment, we have not seen any measurable return in terms of leads or phone calls originating from this advertising channel. When we attempted to cancel the contract at the end of 2021 due to its ineffectiveness, we were informed that we are, in fact, tied to a three-year agreementan aspect that was not clearly communicated to us at the onset.As a nonprofit organization, we operate on limited resources, relying heavily on our supporters and donors. This continued financial drain has resulted in an expenditure of $8,000, without any corresponding benefits. Furthermore, our inability to terminate the contract without incurring substantial penalties is causing additional strain on our already stretched resources.We understand that contracts are binding. However, we believe that the lack of transparency during the contract signing process and the subsequent refusal to allow termination without significant financial implications is unethical and detrimental to the spirit of collaboration.We respectfully request the BBB's assistance in resolving this matter. After being contacted directly by a local BVM rep/publisher in the late summer of 2022, the opportunity for this advertisement seemed do-able, albeit on the expensive side. I explained that being my business only had achieved a little over $20K in revenue that year, such a high-priced ad campaign wouldn't be ideal unless results could be achieved. I was shown a presentation highlighting how their system achieves positive success rates due to their targeted publication format.This was based on a 3-year term, as I was told that they only offered two or three year terms. Furthermore, there was no indication from the publisher that a cancellation policy didn't exist, and I felt quite rushed to sign the agreement without the opportunity to read the contract in full.As things began to move into action, I became more and more leery about the potential success rate. Keeping in mind that only gaining 10 to 20 new regular clients in these combined areas would have been enough revenue to offset the expense of running these campaigns, I expressed my concerns to the rep/publisher and was told that "it takes time [6 to 9 months minimum] to have your ad noticed," even though I expressed from the beginning that spending thousands of dollars on what is essentially a soft "maybe" wasn't in my budget. Had this been communicated from the beginning, I obviously wouldn't have proceeded in agreeing to a 3-year commitment that could take up as much as 30% of my overall annual revenue.As of this writing, I've paid $644.15/month for 7 months for 1/8th page ads in 2 small publications to populations of roughly ***** and ***** each, as well as ad postings on ******** and ******* I have received ZERO leads in this period. In short, I feel deceived and taken advantage of.At a bare minimum, I would like to cancel my contract immediately with no penalty. I would prefer to be refunded for part - if not all of the funds I've provided, as their results are non-existent.Business Response

I am a small insurance agency in **********. When, I opened I had a sales representative of this company come into my office and ask me to advertise with this company. I was hesitant since I had just opened the agency and finances were tight. She told me do not worry about it our contract is for 3 years but if you want to cancel it at any time due to financial struggles just let us know and we will cancel it. Well, I kept the ad for a little over a year. Which is when finances became tight. I asked the representative to cancel the ad. She told me the company would not let me cancel the ad due to the contract. And if I wanted to take the ad out of the magazine then I would have to pay off the remainder of the contract. I wrote emails to the company and stated the representative had assured me that I could cancel anytime with no repercussions. The customer service at the company replied the same saying I could pay out the contract. The sales representative mis-represented to me taking advantage of me as a new business owner what would actually happen when I tried to cancel the ad with this company. Now the company is sending the remaining balance of contract to collections under my company. I have done advertising with many companies, and this is the only one I have come across that tries to strong arm another small business into paying a contract that they can no longer afford. Especially after being reassured and by the sales representative. She completely mis-represented the terms and company stance on the contract. I was hesitant to start the ad. If I had known from the start this might happen, I never would have taken an ad with them in the first place. The money they are asking would financially ruin me. And being sent to collections would harm my small business if I needed to get credit or a small business loan in the future. I want the company to dismiss the balance based on how their representative presented the product to me from the start.Business Response

I entered into contract with Best Version Media approximately two years ago I did not understand at the time that there was NO Option to terminate the 3 year obligation early. After a year, I asked about terminating since I had absolutely ZERO feedback from our advertisting. Advertising with Best Version Media has not benefited my business at all. I was told there was absolutely no option to terminate the contract. I have continued to pay the monthly fee, wasting more money on advertising that has not proven to be effective. I have given this enough time to bring positive feedback, how much longer should i continue to waste my advertising dollars on this worthless ad?Business Response

Our client began advertising as an Expert Contributor in their local magazine. This premium ad space allows clients to write articles and be seen as the expert of their local industry. Our rep made it clear that a three-year commitment is required for Expert Contributors before the signing of the agreement. Additionally, our team accommodated our client after they expressed concerns over the price of the ad by removing them as an Expert Contributor and lowering the cost of the agreement. Before this complaint was filed, our local rep made several attempts to contact our client without any success. We have honored our end of the agreement, so it's unfortunate our client is not willing to do the same.

After connecting with a local BVM representative. The opportunity for this advertisement seemed doable. I was told that if I cam on hard times as a business I could opt out of a month or two. There was no indication from the representative verbally that there was a no cancellation policy, and she rushed me to sign the agreement and pay without ever providing me the opportunity to read the contract in full. As a small business owner I truly not only feel taken advantage of but lied to. There was a definite attempt to conceal this part of the contract from me when signing, and no verbal mention of this in any conversation I had. Complaint is filed on behalf of BVM being in breach of agreement with zero communication on my ads before being published. BVM representative breeched laws while dropping the copy of the magazine inside of a person property mailbox without permission or **** stamps. When requesting to have the contract voided, I was told what happened with the mailbox was "asked for" which it was not. there had been 0 prior communication. This Company should be advertised more as an investment opportunity for a local startup rather than paid advertising. There is a company that was added to the Experts that directly compete with our services which we have been providing from the start of the agreement and I am told since the company is titled differently that is allowed. I was unaware as it was advertised as 1 leading industry expert per industry and somewhere they have hidden company clauses outside of what is signed. I would source a local person before EVER suggesting someone else pay money to this fraudulent, dirty marketing "media" company.Business Response

While working with this company, we updated our information. They confirmed and updated information in one section of the magazine but not other areas. I had 3 issues printed (July, Aug, Sept) with incorrect or differing information which makes my business look like the unprofessional one. When requesting cancellation due to their negligence after proper notice (not even requesting a refund), they continue to argue and state that BVM does not feel as though they did anything to breach their contract. Dear Better Business Bureau,I am writing to file a formal complaint against Best Version Media regarding their aggressive sales tactics and a 3-year contract we were pressured into signing. Despite their promises, this advertising channel has proven to be entirely ineffective for our business.We signed a 3-year contract for advertising in their magazine under the impression that it would generate leads and phone calls for our plumbing, heating, and air conditioning company. However, since the initiation of the contract, we have not received a single phone call from potential customers due to this advertising platform. This failure directly contradicts the claims made by Best Version Media at the time of the contract negotiation.We feel that we were bullied into agreeing to this contract. The sales team applied undue pressure, leaving us with no viable option but to sign.
