Beazer has stopped all construction in our neighborhood White *** at East Lake, but did not finish the property. There are still worn construction signs left that they failed to remove. The signs are decaying and falling apart. They had a makeshift parking lot with light pole in it, but removed the parking lot and built homes, but left the light pole where it was. It is touching one of the units and is way out of alignment with the rest of the poles. They left potholes in the road that we tried to fill with cement ourselves. In an *** meeting the representative that Beazer hired told us the roads would receive a top coat when construction ended. When it actually ended, she changed her story and told us we would not get a top coat. There are open holes scattered all over the neighborhood that Beazer did not cover. We have had at least 2 injuries from people falling into the holes. I left a review on BBB and Beazer responding saying these issues would be addressed, but we had an *** meeting a short time after that response and the Beazer representative says the issues are not being addressed and the neighborhood is not being turned over. So whoever responded to my BBB review lied. We are fully built out and sold going on 2 years now. But the builder does not recognize our right to take ownership for our ***. They have a planned additional phase of townhomes on the other side of our gate. However that project is stalled in Dekalb County planning due to impact issues on Shoal Creek. There are no current plans or permits to build. And the builder does not own the land and do not even know if they will purchase it. We are hostages. We just learned that at our annual meeting that rather than require the land owner to put in sprinklers as was the agreement she decided to just use the *** funds we have to pay the landscape company to do so. She gave vague and inaccurate answers to questions and when challenged she hung up on us (Zoom meeting).Business Response

The same issues weve had for years are the same issues we have today. The HOA Representative that Beazer hired relayed to us that she has not been informed about any turnover.

We Had a brand new house build and closed Aug 2022. I have had to call customer care regarding several issues with the home in the first month. The plumber was sent out three times for air conditioner not cooling rooms properly and for the heater not working. The gas was never turned on to the heater. The second time for the heater it shut off due to an issue in which the drainage was not set up right. If the system would have kept running it would have leaked into the ceiling. These issues have been addressed, but never should have happened to begin with. This is poor construction management.The more serious matter is the interior wall cracks across the room ceilings and down where two walls meet. I have cracks all the way across the living room ceiling with paint pealing. There are several cracks in the living room from the window to the ceiling. The interior floor caulking and base boards are separating. Caulking in the master bathroom is coming apart. On the outside of the house I have horizontal cracks on both side of the house. On one side the cracks almost runs the whole length of the house by the windows. The cracks are a stair step fashion. This claim was made Dec 15 to Beazer homes warranty department. I am still awaiting resolution and fixing of these poor workmanship/ construction problems that seem to be getting worse. An HVAC vendor was out on two occasions to remedy the issues with the unit and no further issues have been relayed to Beazer after the most recent visit on 11/12/2022. We noticed a drywall crack that covers a support beam in between our kitchen & living room. The crack is not consistent with the normal drywall/mud tape cracks that are expected after a home starts to settle. Upon measuring the distance from the 2 closest outside walls to the ***********, we measured upstairs above this point and noticed cracking in the drywall where it meets the ceiling at the exact point as downstairs. This is our 2nd Beazer home, and we are familiar with their warranty. We are not looking for superficial drywall repairs. We are skilled enough to fix this on our own if this is the only issue. We are concerned with the beam that is inside of the drywall that is cracking in an odd pattern. We want confirmation that this beam is indeed structurally sound, and not slowly failing. This beam is covered under 10 year structural warranty. Below are our attempts to work with Beazer, and their failure to adequately address this concern.12/28/22 Emailed Beazer ****.12/30 Provided proof ownership.1/4/23 Received call from ***** ************. Asked to stop by. Stopped by for 4 minutes (per my cameras) just for pictures.1/10 Received email from "Beazer on Demand" stating issue was out of warranty and those things were taken care of during 1 yr warranty. Signed "Best of luck" with no name.1/10 ****** immediately emailed On Demand and said not concerned about drywall, just the beam.1/12 Email from Beazer on Demand - email forwarded to *********************** Manager.2/1 ****** emailed on demand to advise no one has contacted us and we are tracking all communications for potential legal action if not addressed.2/2 Email from Beazer on Demand - **** requested the division reach out regarding concerns.2/2 Email from ********************* w/ ************************* copied. Beazer Homes ********** ******************* have researched the claim being brought forth and has concluded that this warranty related claim is not covered under Beazer Homes Limited Builders Warranty. Drywall cracking/ settling etc. is only addressed as a courtesy during the 1st year of close of escrow. In the obtained photographs from the consumer, the drywall cracks are within acceptable tolerances and expectations for drywall and compound. Nothing provided in communication or photographs raises a concern about any structural related issues. I will print this response and place in my home's file in the event that this indeed becomes a structural problem in the future and legal counsel is needed. To respond directly to the business, I would like to say that at NO point did anyone from your company ever come forward and say that this was not a structural concern and was part of settling, please do not lie as I have all of the evidence to prove this. You referenced the 1 year walk through warranty and drywall repair. I replied to you that I was not concerned with the drywall and that I had no issue repairing drywall cracks. Sadly, it has taken this BBB claim to get you to say that the damage that we are seeing is not due to structural issues......which is what we have been asking for this entire time. By Beazer making their decision via photos instead of coming to our home to physically look at this, you have committed to be obligated after any warranty if this concern is indeed a valid structural issue that Beazer has failed to address since we brought it to your attention during the 10 year structural period.

My Husband,*************************** and I purchased a home from Beazer in ********* ******* in the Reserves of Pradera neighborhood in December of ***************************************************************************************************************************************************** it, they sent workers out several times documented and told us they would order what we needed from American Builder Supply, I was initially told that our windows and parts were on back order due to supply chain issues even though the builder continued to build in our neighborhood and installing windows, then i was told they were never ordered but would be, now I am still trying to get my warranty claim on my windows resolved two years and 2 and a half months later with Beazer and American Builder Supply. I had a conversation with my Beazer rep yesterday and he told me that American Builder Supply would't replace my windows and parts because I am now out of warranty. I literally could not believe what I was hearing coming from him as he knows that this has been ongoing for over two years and I have been EXTREMELY patient with them in resolving our concerns and he has always told me don't worry I'll get things taken care of, BOTH Beazer and American Builder Supply have been egregiously neglectful in following up and resolving our warranty concern as my husband and I have followed all of the proper warranty claim protrocols.Business Response

Beazer will communicate once there is an ETA on the new request, then communicate once the material is in and schedule the work to be done. I wish to have an estimate provided to me from a local window company and have Beazer pay for the windows that need replaced and for the labor for installation. They have made no attempt to contact me since the end of April nor did they ever inform me that my windows were lost and needed to be reordered until after receiving an email from BBB today .I want Beazer to except an estimate from a vendor of my choosing and pay for my windows and installation as soon as possible.

I have had several issues with my unit/airflow. Airtron told me I have to shut vents when not in the room or open vents when in the room . I have to put a towel under my daughters closet door because Airtron cut all air flow to her closet. I have to cool my home down in the summer to get my guest room to a comfortable temp. My media room does not cool properly again I was told by Airtron that I need to open and close the vent. All of these solutions were final options provided my Airtron. Airtron told me my unit is running at a max ****** At max ***** my unit is not cooling properly. Airtron told me thst my home was calculated to run up to a 4 ton unit. My current unit is 2.5 tons. I am requesting that my current unit be replaced with a 4 ton unit. The issues I am dealing with is causing me to run my unit more often. With a beautiful Beazer home, I feel I should not have to keep a stick in rooms to close the vents. I dont think this is how Beazer treats customers. Thats why I am bringing my issues to the table . We bought our Beazer home in 2011. Since we bought it we have had several problems, including problems with the A/C system early on. The latest problem we have is the one I am now reporting. We have had FIVE light fixtures fall out of the ceiling, held only by the electrical wires. The boxes that hold the fixtures have broken and failed. The first one was in 2016 and was the light fixture in the dining room. The electrician at the time said the blue box they used was not rated for that light fixture. Then last year, the one over the breakfast table came down. Most recently, a hallway fixture came down. I thought I would have him check another large fixture in the foyer and it was already halfway down! The day before the electrician came we noticed yet another hallway one was hanging. So that is five fixtures that have had the boxes break apart. We cant afford to have every light fixture repaired, and feel that is Beazers responsibility. We are afraid the next ones to fall will be the ceiling fans. We are asking for all the fixtures to be repaired and to be reimbursed for the costs we have incurred for having the others fixed. Our Beazer team has made multiple attempts to find the source of the noise. We have inspected the attic and everything is structurally sound. We see no cracking or evidence that there are any structural defects. The sound only occurs when it is extremely windy outside. We have an appointment for 1/31 to make a final attempt to identify and repair the noise.

Worst decision of my life to buy home from Beazer. I am living in Pine Mountain Park, moved there 4 months back and still trying to settle as every other day Beazer team is there to fix construction issues.1. First thing about this community is their AC system. They have used Rheia AC system, it makes lot of noise. It's very noisy in night and make you uncomfortable. Beazer knows about it and they do not have any solution about this.2. Their builders - they are not at all experienced. They cut the foundation slab as most of the time they miss underground plumbing or electric pipes. And as per Beazer team it is very common to miss these things. So they have damaged almost all the slabs in this community. But they deny to learn and improve.3. In my new home - they have changed garbage disposer, mirrors, wash basins. Paint is not proper.4. It has been 3 months my dishwasher is not working because it was not installed properly by Bezaer. Yes, ********* says it's your builder who is responsible to install it. 3 months and it is still not fixed. 3/7/2022 signed Contract to Build.1113 Aidenbaum, *********** ** Deposit paid $26,000 Beazer Homes committed to build quality home as per contract with customizations and change orders, changes as per pre-construction meeting with construction manager **************, New Home Counselor (NHC) ************, but failed their commitment.From the start of pre-construction until we requested to cancel the contract on December 21st, 2022 there had been 5 construction manager changes, the first two, ************** and Will both quit. NHC ************ quit sometime in December. Construction quality issues and delays due to multiple changes of construction managers, paid custom order changes NOT fulfilled correctly,e.g sound proof room, supposedly foam insulated on the walls, and fiberglass insulation below the floor (between 2nd floor and first floor ceiling). Discussed in the pre-construction meeting with ***** and again with **** during frame walk meeting. Half of HVAC duct not up to code. Frame up inspection issues, not sure if all issues were fixed, as we are not able to schedule our inspector to go back to re-inspect once they supposedly fix it. Sent email multiple times that I need the inspector back to re-inspect the fixes, and if Beazer did not honor request, it will be considered builder breach of contract in my email. Progress pictures received after foam insulation sprayed and drywall in progress shown that new studs used had NOT been treated for termites protection. Most windows not installed to manufacturer specifications.NHC ************ stated he understand our issues, and stated that we can go ahead and request to cancel the contract and ask for a full refund. Found out **** quit via NHC *****, she took over handling of my cancellation. Management refused to refund anything with no explanation. 5 construction managers changes, and 1 new home counselor quit. Obviously, Beazer Homes has issues. Full $26,000 refund requested. Beazer Homes *********** honored this buyers request for cancellation per the contract guidelines. Within the same contract, signed by the buyer, it indicated that the deposit is non-refundable. Therefore, a refund of deposit is not possible per biding contract. I am rejecting this response because:We did sign the contract, but the contract also did stated:
21. DEFAULT REMEDIES: In the event of a default by Seller, which default continues for three (3) business days after receipt of written notice from Purchaser, then Purchaser may, as Purchasers sole remedy, terminate this Agreement, and obtain a refund of all deposits previously placed with Seller as liquidated damages and not as a penalty, whereupon neither party shall have any further obligation to the other.
Thus, my request for cancellation based on Sellers breach of contract and was approved, and with above provision in the contract, the full refund should be given.
Some examples are:
Is breach of change order #6, signed as part of the agreed change order NOT binding? Is total breach of Change Order #6 not considered default by seller? ***** signed CO#6 paying special insulation for sound proofing media room, BUT Seller decided to breach contract and put in NOT Agreed upon type of insulation as in CO#6, and walled it up?
Is partial breach of signed changed order #3, design center options arbitrarily changed by Seller NOT considered a breach of contract. Pandemic and supply issues excuses had been overused.
Also, we continuously indicated to Beazer that not letting our Home Inspector back to re-inspect after the supposedly fix is considered a Breach of contract by the Seller via multiple emails as well as verbal communications.
Furthermore, when requesting for cancellation, Seller was NOT willing to allow it initially, and was delaying it and not providing proper cancellation Form and during this time the new home counselor quit and we didnt hear anything from Beazer. But once Seller possibly has a new potential buyer, Seller asked NHC ***** immediately pushed us to sign the cancellation form ASAP, with the perception that a full refund will be given.Sincerely,

Beazer Homes *********** is rejecting this prior buyers reply. The details listed are all circumstantial and in no way a breach of contract. Beazer Homes has until the date of close to fulfill all contractual obligations, and this home has not closed. Therefore, a perceived breach is incorrect. The buyer always has the prerogative to cancel and that is what happened in this instance. The deposit will be retained per contract.Customer Answer

I am rejecting this response because:The details listed are factual. Having 5 construction manager changes since the construction started in May until December with at least 2 of them quitting the company. The wrong insulation type installed and already walled up is factual, it is NOT circumstantial, see attached CO#6 and see attached pictures. Some added studs are not treated as per code. See attached picture. These are all walled up, before I asked for cancellation. Half of the **** ducts are NOT up to code (see attached Inspection report), as well as multiple windows NOT installed as per Window manufacturer standard/requirements.You meant to tell me that Beazer will tear down the walls and fix it all, changed all the ducts and fix it all before closing???? WOW.
Factually, BEAZER is NOT denying the details stated in the complaints, just stating details listed as circumstantial as per Beazer and they have until closing to fix it all. Be real.Review the photos attached (unfortunately, I can only upload some due to BBB size limitation) These photos are from Beazer New Home Counselor ********************* who had also quit the company, and I am just including them here as factual information.A breach is evidential when as buyer, we indicated via written notification as well as verbally to the **** and Will that if Beazer did not accommodate the return of inspector to inspect if those deficiencies listed in the report are fixed, it is considered as breach of contract, it is in the email chain that Beazer is still using ********************* email to correspond. Not fixing all those deficiencies and having it all walled up is considered a breach of contract, as it is very probable that it will NOT be fixed as everything is already walled up,painted, completed by the time of closing. Stating that Beazer Homes has until the date of close to fulfill all contractual obligations, and this home has not closed. Is NOT factually true as well. Per the contract, section 21,and here it is again
21. DEFAULT REMEDIES: In the event of a default by Seller, which default continues for three (3) business days after receipt of written notice from Purchaser, then Purchaser may, as Purchasers sole remedy,terminate this Agreement, and obtain a refund of all deposits previously placed with Seller as liquidated damages and not as a penalty, whereupon neither party shall have any further obligation to the other.Sincerely,
