I am writing in response to a letter from Lendmark Financial Services dated 08/24/2023, received on 08/28/23.This correspondence from Lendmark Financial Services indicates a denial of a $2000 consumer loan request.However, I made no such request, neither of Lendmark Financial Services nor of any other agency, and a quick review of the past 12 months' of complaints submitted on the BBB site reflects at least SIX similar complaints!The letter indicates that the denial was based on information you obtained from Equifax regarding my creditworthiness.Both the supposed request for credit/loan, along with the hard inquiry you conducted, was completed without my ever having asked for same, or providing permission for you to complete this process.I sent a formal response to the listed, local Lendmark Financial Services office, and am submitting a formal complaint, here, asking for the following remediation from you:Immediately remove my name and contact information from your database;Immediately request that any hard inquiry be removed from Equifax and/or my Credit Report; and,Do not ever run another credit/loan request on me without my expressed, written request that such be completed.Business Response

I am not liable to any debt to Lendmark Financial Services. Lendmark Financial Services is currently violating my consumer rights under the ***** I have documents that my auto loan was satisfied in full by **************************** on November 22, 2017 in the amount of $8230.90. After the account was satisfied in full, without my knowledge Lendmark Financial added additional fees and expenses. I had full coverage insurance with ******************** and Nationwide honored our contact and paid the lender for the total loss incurred. Nationwide submitted a payoff demand and paid that demand in full. Contact ***************** Associate ********************* Phone ************ Furthermore Lendmark Financial has ignored numerouse claims by myself to investigate and update this information to reflect accurate on my credit report causing me much hardship. The difference in an auto loan paid as agreed to an auto loan listed as a Charge-off is great. It has caused my credit score to remain in a poor state no matter what I do. I will enclose two separate credit report pages , one from Experian and one from Equifax showing that different information is being reported to different credit agencies. I filed a complaint against Lendmark financial last year against Lendmark and they came back with a settlement. The agreement was to pay 3 months and I would get my title back and they would remove the original balance from my credit. After 3 payments that never happened. I tried contacting them, ***** specifically and he said he couldnt discuss anything via email. I work business hours and I could not get ahold of him. He gave me an alternate phone number and the manager that answered said he did not know why ***** gave his number out. I have yet to get answers since October 2022. I cant login, Ive called and emailed with no contact. I have no bills or anything from them via email and I never signed the contract. This has been unprofessional since the day I was threatened by an office manager last year. I need my title to sell my car to buy a new one. I am a single parent who needs a reliable car and I need my credit to be updated as they promised. I would like this debt to be canceled and the balance to be removed. Around June 2022, there was an agreement made between you and Lendmark, whereas you would repay the total amount due by making an initial payment in the amount of $ ****** to Lendmark on or before June 24, 2022, and upon Lendmarks receipt of said initial payment,
Lendmark shall dismiss without prejudice the collection actions. Accordingly, after you would have made three consecutive payments, we were going to bring your account current. You made one payment, then missed all subsequent payments. We have tried to contact you by phone on multiple occasions to no avail. We also sent you out a settlement agreement to sign and return to us that we never received back.

Paid off my motorcycle loan on 7/21/23 with a direct deposit payment. Per the state DMV website the lender is required to immediately release the lien to PennDOT when it is paid off and they will send the title out the next day. Lendmark is beating around the **** with me and telling me they will not release the title until 8/4/23 because of some policy they have, but this policy goes directly against what the state website says.Business Response

Entered by BBB staff LO Consumer states she received a statement saying no payments were due until January ****. The payments are on auto pay. She called them and advised them that they are taking $200.00 out of her account monthly but the statements do not reflect the payments or the balance owed. She spoke with them yesterday and they told her she owes $1300.00 and the bill will be paid off in December 2023. She asked for a manager but she was told the manager was in a meeting so she was unable to speak to them. I opened a title loan with them in Dec 2018 for 5k, refinanced a few months later for 1k, making my total loan through them 6k. Fast-forward to July 2023, my car was wrecked and my insurance deemed it a total loss, got a payoff amount and my balance was still $6,084!! From Dec 2018 until now, I have paid them a total of $12,277!! How can I have this high of a balance?! Come to find out, they added these bogus "insurances" to my loan. This was done without my consent or knowledge!! The more research I do, I find out there are MANY lawsuits, some class action, for this very reason! "Insurance packing" is what it's called!!! Since my loan has been opened for 5 yrs, I've already paid the whole premium and there's "nothing they can do" to take these bogus packages off and refund me the $2018, which I was told was the total cost of this insurance! I would have NEVER signed up for these, as I have these through my employer!! For a short time in Feb 2021-May2021, I was unemployed. When I contacted them to let them know this, they NEVER told me I had this "IUI" insurance, which is unemployment insurance, so I know for certain these are bogus! If I had been paying for these, I should have been able to quit paying my monthly payment during the time I was unemployed, but was told I still had to make my payments!! Why wouldn't they have advised me then, that I had this insurance?? Because I never contested to them in the first place!! I talked to some district manager and he said there was nothing I could do, and that they will give the title over after they receive the $5k check from my insurance. Of course they will accept that!! But I'll still be on the hook for a little over 1k! This company is a scam and preys on people and their tactics are totally unethical and I plan to join a class action lawsuit. I will not EVER do business with these people again and I'm for darn sure not going to fatten their pockets anymore than I have been!! I don't know how they sleep at night!!Business Response

On December 26, 2018, you obtained a personal installment loan which included the purchase of optional involuntary unemployment insurance (***). You made a request to cancel the *** on July 19, 2023, at which time our branch cancelled the insurance and credited your account with a partial refund for the remaining term of the policy. After reviewing your account in connection with this complaint, we believe that you should have been advised by our branch to file a claim against your *** policy while you were unemployed between February 2021 and May 2021. While we are not certain whether the insurance company would have paid the claim at that time, we have decided to refund to you the full amount of the premium ($1347.37)and the associated interest ($1555.31) collected on that amount. The refund will be applied as a credit to your account.

I am rejecting this response because:I have called several times since receiving this response and the ******** that you advised was going to be credited, still has not been and nobody has been able to help because they're not authorized to do so. I also was told at the very beginning of this dispute that I would not be charged any interest or late fees for July and August payments. This should have stopped the moment I opened this dispute more than a month ago. I have been trying to get this paid off and the balance at the beginning of July when I disputed this, minus the credits you mentioned I would be receiving, should be what I'm working with. Not today's payoff amount. Who can I talk to to get the rest of the ******** credited, along with my late fees and interest from early July? So I can finally put this behind me. No one has been able to help over the phone. My payoff as of this moment is $4,768.31. based off the credits I'm supposed to be receiving, my payoff should be right about the ***** to 3k **** please, who can help?
