      February 25, 2023 I financed a car with Lendmark Financial Services LLC in *****, *******. 3 months later the motor went out after an oil change and the car lot I got it from told me there was nothing they do to help me. I called Lendmark and they informed me that I would still be responsible for making my payments and that theres no other option I have for trying to get another car. I am a fault for deciding to no longer make payments per my contract, however, I am a single mother, without a vehicle to make it to work on time to pay for a car and insurance and possible repairs without other bills falling behind. Though, that is my own personal issue and do not seek sympathy, when Lendmark called me on July 9, 2023 verbally voluntarily agreed to surrender the vehicle to avoid them garnishing my check and sueing me. ******* or " Milenda Im sure thats not her name because when she called me a week later she said I am following up with you on our call last week, once I recalled the call and said that I am still waiting to have the car towed to them so she could then write a repo. She said then changed the story and said that the ******* person was then ok vacation and didnt update her notes from the call and that the last notes was they were going to file legal. I just find it disheartening and stressful to have to be sold a dream just for them to call back and make it seem like a call never happened. Because, if the call never happened (because she didnt note it) why follow up with the call if in your last notes stated that you were filing legal as if I agreed when I didnt. As I previously I am a young single mother and as stressful as life already is for I would really like to have this disputed some way. I would much rather to volunteer/ surrender a repo.

      You entered into an installment loan agreement with Lendmark on February 27,2023 to purchase a 2016 ******* Santa Fe, the amount financed was $11, ****** which was to be repaid over 60 months. The last payment you made on this account was May 18, 2023.

      Lendmark provided financing to you to purchase a vehicle from the dealer of your choice. You purchased a vehicle from Interstate Auto Sales and after reviewing the title, insurance, and car appraisal associated with your vehicle there wasnt an indication of motor issues. You stated that the vehicle is now inoperable and whenever there is an issue with a vehicle purchased by customers, we advise you to resolve those issues directly with the dealership.

      As of July 24, 2023, you have dropped the vehicle off at your local branch and completed a voluntary surrender agreement. A voluntary surrender does not void the obligations set out in the installment loan agreement and you are still responsible for making the monthly payments until the terms of the loan agreement have been satisfied.

      Hi, I took several loans with this company over 5 years or more ago (don't remember exact dates). I paid off each loan except for the last loan which was under **** atbthe time. On this last loan I paid monthly for a long time. Then I lost my job due to medical reasons and the disability insurance paid off more than half of the loan on top of the payments I made. This company has been harassing me, calling my phone over 100 times. This is abuse in every way and now I received a letter from a law firm claiming I owe over ******. This is absolutely ridiculous, they claim I owed ******************************************************** ******* in interest which is more than I even borrowed and on top of that ****** in Attorney fees. I will try to contact the disability insurance to get a copy of what was paid and it will be hard to track the numerous payments I made to them while I was working. And at this point I don't trust that they will be honest about what was paid. This is a complete crime to try to charge me over 3 times what I originally borrowed after I made many payments and my disability insurance paid off a majority of the loan. I will appreciate any assistance or direction on how I can handle this. Thank you.

      You renewed your previous installment loan account on March 30, 2016, with the following terms: $7325.67 financed, *****% interest, repaid over 60 months. Due to being unemployed you received insurance benefit payments from September 5, 2017, until July 2, 2018,and when these payments started you were two months delinquent on your regular monthly payments. Additionally, we were notified by the insurance benefit service provided on July 23, 2018, that the *** benefit payout on your account had been reached and no further payments would be made.

      With the last payment being on July 2, 2018 and us not being able to successfully contact you to bring your account current the account was charged off on March 25, 2019. Due to our inability to contact and account delinquency the matter is now being handled by the ********** of ************************************, please contact them directly at ************ for potential payment options.

      The last call to you from Lendmark was placed on October 31, 2022, however we have restricted your telephone and email to ensure no further contact as of July 20, 2023.

      I am rejecting this response because the fact that I received a notice stating I owe 3 times the amount borrowed is a complete abuse of power and a scam.  Lendmark claims I owe ****** which is completely ridiculous and I was given no credit for any payments made. This had to be illegal and I do not owe that amount.  I am a struggling single mother of several minors and Lendmark should not be allowed to do this to me.  This account was closed years ago and I have no idea how I owe almost 20 grand.  The last call was not in Oct of 2022, I received calls from Lendmark well into 2023 which has caused me extreme anxiety.  I was being harassed constantly for this ridiculous amount of money that I do not owe.  I completely reject the response because this is a money grab and I can barely pay rent so I don't know why I am being charged triple the amount of original loan with no credit for what was paid.

      THEY have not reviewed all 4 credit bureaus nor have they reported the information correctly in compliance with the ***** UNDER THE **** THE CREDIT REPORT MUST BE REPORTED WITH 100 PERC MAXIMUM ACCURACY. IF this BBB COMPLAINT and the rejection of your response does NOT RESOLVE my issue I will file a ******** ATTORNEY GENERAL COMPLAINT, CFPB COMPLAINT, AND A COMPLAINT WITH the **** of financial institutions. After getting free advice from an attorney I am not currently represented, he advised me to ask the original creditor LENDMARK to provide evidence showing it is illegal or in violation of the **** to delete an account as part of a CONFIDENTIAL WRITTEN AGREEMENT.       On June 28th, I spoke with **** at ******* Financial services for 24 min 39 sec In reference to a loan and a soft pull which would not affect my credit, as suppose to a hard pull which would. **** explained to me that a soft pull would be first before, I decide whether to move to the next step a hard pull, given the fact that I was approve to go to the next step of the loan process. I received a voice and a text message to call **** back on June 29th. I'm thinking this is about the soft pull, but when I returned the call I was told the loan was not approved and I needed a cosigner in so many words. I'm still thinking that was a soft pull. When I checked my text messages there was a message from credit ***** about a hard pull. I checked credit karma, and seen Lenmark Financial did a hard pool. I called Lenmark Financial, waited for ****, to return my call. When **** called me back ****, said I told her to go forward and do the application. I did not tell **** to do a hard pull before contacting me. I was waiting on **** to call me back, and let me know the status of the softpool before, I agree to the hard pull and process the next step of the loan application. I would not have a loan application fully processed with a hard pull on my credit, when I can do a softpull first that doesn't affect my credit and be sure, I can go to the next step of the loan process to do a hard pull on my credit score.

      Took out a loan for $3100.00 10/2021. Nobody explained the ridiculous amount they charge for interest. In all this time I have paid approximately $2600.00 but yet they are still showing that I owe like $1900.00.       You obtained an installment loan with Lendmark on October 23, 2020, which is to be repaid over 40 months. The interest for this loan is calculated using the daily simple interest rate. This means that interest accrues daily on the unpaid portion of the principal balance. There have been some instances of NSF check fees and late fees accessed to your account for payments that were made late and/or returned unpaid which would attribute to the principal loan amount not decreasing significantly. The interest rate was explained to you at the time you agreed to the terms of the loan agreement, should you need a copy of your account documents you can make the request through your local branch.

      Additionally,the telephone calls being made to you are attempts to make contact in order to bring your installment account current. We have reviewed the calls placed on your account and can verify they were made within Lendmarks policy. Further,your telephone number has been placed on the do not call list.

      I purchased a trailer from ******* and financed it through lender, Lendmark filed a judgment for the full amount left on the loan I cant sell the trailer without the title they refuse to pick it up and sell it but Im not able to pay the amount they are requesting this is ludicrous to put a judgment on me with you have the title to the collateral and the address on the contract is were the trailer is located.The trailer needs to be picked up and sold it should sell close to the amount owed with the fees the. If they are a difference then I could work out an arrangement to pay it.I will refuse to talk to them on the phone at this point all point of contact should be done but email or regular mail.

      Predatory and deceptive lender ! Opened account for a personal loan in 2021 for a little over ***** dollars. Since that time I have paid over ***** dollars to Lendmark financial and my loan balance is actually more today ( almost two years later) than when I took the loan. I refuse to pay another ***** until my account is updated properly to reflect the money paid and the correct balance is shown. Do not do business with these people !

      *****************************, you opened an installment loan account on June 28, 2021, with the amount financed $5,774.19 at *****% interest rate, to be repaid over 54 months. The first payment was not due until August 12, 2021. As this is an interest-bearing loan,interest is accrued daily. There have been several instances of NSF and late payment fees being accessed to your account due to returned payments and payments being made after the due date.

      All payments were applied in accordance with the terms of the loan agreement, which specifically states that payments will be applied to interest and principal prior to any other charges that are due on the account. A copy of your payment history has been sent to you by mail for your review.

      Lendmark services was notified of my unemployment as early as July of 2022. I provided substantial evidence and the proper paperwork to be emailed to that branch in a timely manner. Notified branch managers as to what paper work was needed between August of 2022. In August, I notified the branch of them filing the unemployment paperwork. They told me that it wasn't processed yet and opted for me to fill out an agreement of deferment. For the rest of 2022 this branch told me that they were handling the submissions for my unemployment insurance as they were behind on processing information. In Nov, I called to check up as I heard nothing new and they never mentioned any issues. I called again in May and they did not have any knowledge of any paperwork I had signed and had no information in regards to the previous months work of communication as well as the paperwork they were supposed to submit. Because of this I had to call up the insurance agency my self where they discovered I had all the paperwork dating back to July of 2022. Now I have found out they have wrongly charged off my account April 2023 and still admit to the fact that I did not do my part. By the time my unemployment insurance was applied, my account is charged off and now I am being threatened to owe ***** or else I face potential legal actions. They never properly submitted my paperwork nor did they admit anything and wrongly charged me off and did not process my information in a timely matter.

      Lendmark Financial Services, LLC (hereinafter referred to as Lendmark) is in receipt of your consumer complaint. We have had the opportunity to review the complaint and will address the customers concerns as follows.

      On May 13, 2022, you refinanced your prior loan with us and obtained a new loan. The first payment on this loan was made on June 13, 2022.

      On July 1, 2022, you contacted Lendmark to inform us that you were currently unemployed and as a result unable to make timely payments. We reminded you that you had chosen to purchase an ********************************** (***) policy with Securian Financial (hereinafter referred to as insurance service provider) when you refinanced your loan. We also mailed the insurance service providers *** benefit claim form to you, which you were instructed to complete and return directly to the insurance service provider. At that time we also granted a deferment of your July payment while your claim was being processed.

      On July 21, 2022, you were contacted by a Lendmark employee to inquire about when you would be submitting the completed claim forms and supporting documentation to the insurance service provider. On July 29, 2022, we were notified that your *** claim was submitted to the insurance service provider and awaiting the necessary supporting documentation to validate the claim. During the processing of the *** claim you were contacted by the insurance service provider requesting the additional documentation both by telephone and in writing. ********************* service provider never received the requested documentation supporting the claim and the claim was denied around November 2022.

      In December 2022 a new *** claim was submitted to the insurance service provider using the same information provided in July 2022. However, again the insurance provider never received the supporting documentation necessary to validate and pay the claim. As a result, the new claim was denied in January 2023 due to a lack of supporting documentation.

      On April 26, 2023, in accordance with our accounting policies, your account was changed off as we had only received three payments on your account since it opened in May of 2022. Throughout this time period we attempted on numerous occasions to contact you in order to make arrangements to bring your account current or understand the status of the insurance claim with the insurance service provider. We were unable to successfully contact you.

      In May 2023 the insurance service provider was able to contact you and at that time you provided the necessary documentation, and the claim was resolved resulting in the insurance service provider making payments that totaled $1,169.05 to your account on your behalf in accordance with the terms of the policy and the supporting documentation supporting the claim. These payments were applied to the remaining balance on the account. After the *** claim payments were applied,the remaining balance owed to Lendmark was $5066.66 (principal, interest, and late fees).

      You have requested Lendmark to cancel your installment loan account and we are unable to accommodate your request as there is still a remaining balance after the insurance benefits were applied to your account. At the time the account was charged-off, neither Lendmark nor the insurance service provider were able to contact you and you did not contact us. As a result we had no other option as we had no indication if the claim and supporting documentation would eventually be filed and the claim paid by the insurance service provider

      I am rejecting this response because: this statement sent to me is saying that I was contacted numerous times. I have call records from my phone with both incoming and outgoing dialing numbers that shows the last time the *********** branch called me was in September. The dialed calls show that I reached out to them after it was told that I was difficult to get a hold of. In Nov multiple times as well as December.  To add I talked to securian insurance in May. Upon talking to a representative it was found that they received nothing from last year when all my emails show I was in response to them. The last communication via phone was on their behalf was September. If I was not able to be communicated to why was none of this information given to me when I called upon November and December? I understand I have a debt on this account but the issue is I was wrongly charged off because these records and account from securian show I made the effort to make sure all my information was processed efficiently .

      I am rejecting this response because:
      This is an issue that the *********** branch did not submit any of the work and was also not in communication with me as much as been mentioned in the previous statement. I am simply asking if there is anything proving that they reached out to me to process the unemployment documents since I have records of reaching out to them to make sure everything was processed correctly.  I am rejecting this because this makes me look negligent when I did everything in my ability to receive unemployment insurance on time to avoid charge off.

      i know the credit reporting laws my loan was only 22 days past due. i was very rudely treated because of fundings come in late. They threatened me to report late even though it wasnt even 30 days past due. i have attorneys who defend my credit if it is reported incorrectly. I will *** this company. you have no professionalism at all!
