I have a loan with Lendmark i opened in 2019. The amount of the loan has fluctuated since opening the account. I have been harrassed multiple times ove rthe account when i made clear to lendmark what was happening. They gave me a few options and i have made payments here and there as i stated i would. I asked to have me co signer removed because she has had a death in her family and also has had health issues. We both have been harrassed even with keeping up and letting lendmark know what all was happening. I want my cosigner removed. Ive been paying roughly 3 yrs on this loan and didnt have any fault until covid. Which i made sure to contact the company lendmark and let them know what was going on. Still myself and my cosigner were harrassed. I would only like her removed so i can contuine paying the loan and she can be left alone during the grieveing process.Business Response

I was dealing with landmark financial services since 05/2021. I had the vehicle for almost a going year and managed to make payments rather on time or all the time. In October of 2022 I had made payments for the month and following for November when I no longer had the car after being towed on October 8, 2022 illegally. While my car was in the tow lot of ******************* I had several struggles after promising a November payment to get the car out of their lot. This company offered me a $2,600.80 loan towards my vehicle to further assist me with money and others. The loan I had not even gotten a chance to apply for before I got ignored and the matters of explaining how the car was towed kept me out of contact. This company gave me great regards of how their system wasn't ****** moderated to an updated style that was allowing me to make online payments. Several times in October and November I asked if payments were received the way my bank statement showed and no response again. Complaint Issue: In October of 2022 I had made payments for the month and following for November when I no longer had the car after being towed on October 8, 2022, illegally. While my car was in the tow lot of *******************, I had several struggles after promising a November payment to get the car out of their lot.
The last successful payment made on your installment loan account was on June 30, 2022. We have attempted to contact you on several occasions in order to assist you in bringing your account current since July 2022 to no avail. You contacted us on September 24, 2022, and informed us your car had been towed and will no longer be making payment.
Complaint ******************* offered me a $2,600.80 loan towards my vehicle to further assist me with money and others. The loan I had not even gotten a chance to apply for before I got ignored and the matters of explaining how the car was towed kept me out of contact. This company gave me great regards of how their system wasn't ****** moderated to an updated style that was allowing me to make online payments. Several times in October and November I asked if payments were received the way my bank statement showed and no response again.
You contacted us on September 19, 2022, inquiring about applying for additional funds and were advised that because your account was delinquent additional funds would not be an option. I recently fell behind on payments with lendmark due to some financial issues. I made them aware of this in December and requested to opt out of texting solicitation. Lendmark has since sent me at least 10 text. On some days multiple times. This is a clear violation. I received a call today confirming a violation and they spoke to the employee who continued to text me however, nothing else can be done about the clear harassment. I would also like to know my other options with filing a formal TCPA claim.Business Response

I have a loan with Lendmark. The company fraudulently reported an increase in my balance to Transunion which decreased my credit score. I went to the local branch to inquire about the increase that was reported and the loan specialist stated that it was fraudulently reported and she told me to file a dispute. The loan specialist also printed out my payment history to show my on time payments to send to the credit bureaus. Lendmark should not be able to go into clients accounts and report false information. This information negatively affected me and if I did not monitor my account closely they couldve done it more times with more money reported. Complaint ****************** fraudulently reported an increase in my balance to Transunion which decreased my credit score. I went to the local branch to inquire about the increase that was reported,and the loan specialist stated that it was fraudulently reported, and she told me to file a dispute. The loan specialist also printed out my payment history to show my on-time payments to send to the credit bureaus.
The balance on the tradeline increased as Lendmark must report not only the principal balance, but interest accrued and any outstanding fees. As interests accrues daily with this simple interest loan, at the end of November 2022 and December 2022 the balance was higher than it was on the month prior if because at the time of reporting no payment had been made or made late and interest was still accruing.
We have pulled your payment history and you have had several late payments and NSF fees added to your account for payments that have been late or returned by your financial institution unpaid. If the late payments are cured within 30 days, then it will not be reported to the credit reporting agencies. You have made late payments however they were not late enough to be reported. If you believe this is inaccurate, please provide a full credit report from Transunion as the snippet provided is insufficient, to the ********************** Lendmark Financial Services LLC, *********** ************************************************************ 30014.
Lendmark is not in any way trying to manipulate the customers credit score and is reporting the customers account status and applicable fields to the CRAs in accordance with the Consumer Reporting Resource Guide and in accordance with Fair Credit Reporting Act.

When you first registered with our payment portal there were still some minor program issue that have since been resolved. We can verify that you have been successfully registered, have logged in several times since the issue first occurred, and were able to make payments.

You entered into a loan agreement with Lendmark on May 27, 2016, original loan amount of $2480.00, *****% interest rate, with 42 monthly payments of $87.17 for a total of $3577.14. The last successful payment made on the account was in the amount of $190.00 on July 13, 2017, leaving an unpaid balance of $2474.01 on the account. On December 12, 2017, your account was forwarded to home office due to non-payment and assigned a home office account number of ******** which is linked to your original loan number. Your account was charged off on March 26, 2018, and sold to Plaza on 7/31/2018.
We can confirm the information reporting to the credit reporting agencies regarding your account is accurate and under The Fair Credit Reporting Act Lendmark is obligated to accurately report this information to the credit reporting agencies. Complaint Issue #1: I would appreciate if this creditor would cease any collection efforts and stop reporting this item on my credit as a result of the account being charged off and closed.
Currently your account has a status charged off due however this has no bearing on Lendmarks ability to collect on this debt. Lendmark still has a legal right to collect the debt.
Complaint Issue #2: They shouldn't be able to report late payments on a closed/charged off account that they've written off to bad debt.
Under FCRA an account in collection/charged off will appear on a consumers credit report for up to years.
You have requested that Lendmark correct the trade line information reporting to the credit reporting agencies associated with your installment account. We can confirm after a thorough review of your account that the information reporting to the credit reporting agencies is accurate.

I am rejecting this response because: I am aware that the negative item will remain on my credit report for 7 years. Tge complaint is that any account that has been closed and/or charged off can not legally be reported as a current missed payment. I spoke with ******* today, who is with Lendmark and she has advised that they've not reported late or missed payments to any credit bureaus since 2019 and that this account was charged off in 2018, however recently Lendmark has reported late, missed payments which has also recently dropped my credit score. Lendmark should not be reporting late or missed payments on a charged off or closed account. I've submitted proof that they have and I'm asking it be updated on my credit report.

Complaint Issue #1: The complaint is that any account that has been closed and/or charged off cannot legally be reported as a current missed payment.
A review of your account and the documents you submitted has been completed. It has been verified that Lendmark is not reporting any late payments to the credit reporting agencies on your charged off account. We can confirm that your installment account status is charge off and reporting no late payments.
You have requested that Lendmark correct the trade line information reporting to the credit reporting agencies associated with your installment account. We can confirm after a thorough review of your account that the information reporting to the credit reporting agencies is accurate.
