This complaint is regarding Kemper Auto Insurance not paying us to repair the damage to our truck. Their insured bashed in the door of our truck in a gas station parking ******** of damage Aug 2 2024 Today is Aug 20 2024 Their insured has a commercial insurance policy for this work van.Kemper should be held accountable for the damages done to our property by their insured...it should not be that we will not be paid to repair our truck if their insured doesn't respond to their inquiries. Their insured not responding to them should have no bearing on the fact that they had valid insurance at the time of the damage being incurred to our truck. If they deny further insurance to their insured it matters not to this case... the fact is that they had coverage at the time the damage happened and they are not moving forward on this.I question the motives of Kemper Insurance--It seems to me it should be illegal that they can avoid paying for the damage to our property. Their insured has paid them money to be insured. and now that it is needed they are apparently looking for a loophole so they won't have to pay out on damages. And I should not loose out on getting my property repaired if their insured is not responding to them that is not my fault at all. And their insurance was in force at the time the damage was done to our truck...should they deny them coverage moving forward is neither here nor there.I have video of them bashing in the door of my husband's truck with the door of their van in a service station parking lot. The adjuster confirmed receipt of the video. Complaint: 22171246

I am rejecting this response because:

      1. The adjuster states that he is waiting for a police report.

There is no police report available to be waiting on.

My husband called the ****** Ga police...they did come to the scene they told my husband that the ****** police **** does NOT file police reports or incident reports on private property. The only record we could receive would be a documentation that my husband called the police...no details of the accident damage or description of would be included.

The officer did give the following written information to my husband.

The name and phone number of person who oped the van door and caused the damage to my husbands truck

      ******** ***** Chantex and Her phone #

The owner of the van W***** ***** and his phone #

      Kemper ********************** policy number

      2. The adjuster states his insured has not returned his multiple attempts to get a statement from them and he needs their statement to move forward.

This does not seem to me to be a valid reason that we should be denied the repair of our property by his insured not communicating with the adjuster.

If they dont respond then it should default to them being guilty and our property  should be repaired.

      3. The adjuster also states he needs to know that his insured caused the damage.

i have security camera video of their insured opening the vans front passenger side door striking my husband's truck on the rear driver's side door. I emailed this video to the adjuster he confirmed he received it and could open and view the footage of the accident. It shows the door opening and striking his door and the people in the van exiting the van.

      4. I feel that too much time has passed from Aug 2 - to Sept 5th for this claim not to be finalized and for Kemper ********************** not to pay for the repair of our property.

It is crystal clear as evidenced by video that the ***** door that is insured by Kemper struck and damaged my husbands truck.

The Commercial ***** ********************** Policy was in effect at the time of the accident this was confirmed when  I filed the claim on Aug 2 and again when I spoke with the adjuster on Aug 4th. It should not be that because their insured isnt communicating with them that we should be waiting for our property to be repaired when we have video proving what occured.

      Sincerely,

      **** ******

      Complaint: 22171246

I am rejecting this response because:

The claim has been denied by Kemper.

Their reason was because their insured never responded to them regarding the accident and damage to our vehicle.

Kempers policy language has a totally contrived loophole writem in to the contract which allows them to simple not have top pay out on damages caused by their insured.

It is a totally disreputable dishonest and  shady way of doing business and this should be illegal.

I  contacted the State *************************************** and reported this practice. I was told there is no law on the books that can force an insurance provider to pay a claim. Interesting practice isnt it that we as consumers must pay to have insurance or be severely penalized...but when we make a vaild clain they do not in turn have to hold up their end of the bargain that I believe most consumers feel the have made and continue to pay for every month.

Kemper said that the issue was not that their insured didnt cause the damage-- they agreed it is clear on the video I provided that their insured caused the damage.

Their loophole out of paying for our damages is just that if their insured does't talk with them about it they dont have to pay out to fix our property.

They keep collecting their premiums and the don't have to pay out on a video confirmed damage claim. The insured rates don't go up basically all the parties that damage our vehicle have no consequences what so ever and we have to pay to fix our vehicle.

This is a travesty and should be illegal. It is so disheartening to me that we the injured party get totally shafted by Kemper and the insured that did the damage. That we have no help.

If we utilize our insurance we must pay our deductible with no promise that it will be refunded due to Kemper denying the claim.

********* ***** Canex and ***** ***** who work and reside in *********** Ga and use the van that caused the damage as a work vehicle.

I wonder if the people that they do work for have been just as dishonestly treated by these individuals who clearly are up on the way the system works in their favor when they are behaving towards others in a dishonest and reprehensible manor. I wouldnt want to engage them to do work for me or anyone that I cared about.

And Kemper Insurance should be ashamed of themselves and certainly I would not reccommend them as an insurance provider - far from it- iI advise anyone to steer clear of that company.

I am so dissapointed and feel totally let down by fellow human beings and by an American company with a recognized name in the Insurance industry.

      Sincerely,

      **** ******

I am writing to file a complaint against Kemper regarding their handling of an insurance claim related to an auto accident caused by their insured party. The claim number is 24123612544.Kemper directed me to a collision auto body shop, which provided a repair estimate of $1,500. However, I received a check from Kemper for only $1,039, which is significantly lower than the quoted repair cost. *** reached out via phone/voicemail and email (attached) with no response. Despite multiple attempts, I have been unable to get in contact with Kemper to discuss this discrepancy and resolve the issue.

On 8.30.2022, I was in a head-on collision where Kemper was the at-fault drivers insurance company. We are now 2 weeks away from the statute of limitations. In January 2024 they sent a letter saying they were paying max amount. Without the Settlement Agreement they will get away with not paying and they are now ghosting me. Apparently, according to an attorney this is a favorite trick of Kempers. This was not a minor fender ******. My son suffered a lacerated spleen and liver, broken rib and toes, bruised kidney and lung. I suffered a fractured fibula, pelvis and two vertebrae, a torn PCL, a laceration that goes from my shoulder to my elbow and mass contusions, which took months to heal. I am angry, hurt and deceived by this company and the adjuster. Had ******************************* on speaker phone with my daughter in the car while he promised on his very being that this claim would get paid. I have learned so much during this process with the biggest take away being: hire an attorney and dont believe anything an insurance company tells you.

I purchased the auto insurance, and roadside assistance. KEMPER charges for roadside assistance, however does not provide any information about how to access roadside policy on insurance card, or on the website. When I contacted customer service, the person I spoke with was rude, not helpful, and could not explain why purchased roadside assistance information was not provided with policy. KEMPER , cannot bd reached 24 hours per day, so having to call phone number may be irrelevant during non business hours. This practice is predatory to customers. If the are providing and charging fees for an EMERGENCY services, customer should have access to roadside information, reguardless in writhing, with contact details clearly outlined. 2 staff members have intentionally disconnected call when a supervisor is requested. I will be forwarding the predatory practices to all governing bodies.

I am rejecting this response because:

I did not receive any document pertains to roadside assistance from Kemper or its affiliated or brokers. When I called into the office, the customer service staff advised that no document for roadside assistance were available, via card or correspondence. Can you please confirm with me the date the roadside assistance documents were mailed to my home or electronically? And can you please confirm the name of the party, who mailed the roadside documents. I only received the coverage forms that were emailed, however no detailed information was provided about your roadside product. Please review the phone calls made to your office, where I was advised that you do not offer information about the roadside policy itself. I was provided with a phone number only.

I was rear-ended, while stopped at a red light, by a driver who was insured by Infinity Auto Insurance (Kemper). Although the other driver was 100% at fault, the insurer is stating that I, the victim, have to pay up front for all the vehicle damage repairs and rental vehicle while the car is being repaired. This is a considerable expense in excess of $1,000 out-of-pocket. They are saying that I can get reimbursed at a later date after the rental is complete and a check would be mailed at a later date, after the car has already been in the shop. I won't get my car back unless I pay the shop, even if I haven't gotten payment from the insurance company. I am expected to come up with lots of money to get my car fixed before the insurance company will do anything. Luckily I can dip into my savings to cover the rental and some repair, provided the insurance reimburses me ASAP. For someone living paycheck-to-paycheck, they would not be able to cover these up-front costs. It is unreasonable for an insurance company who is at-fault to tell a victim of an accident that they must pay for repairs and rentals up front and HOPE that the insurer will do what they promise and reimburse. Working people can't afford to lose their car without a rental. Many working people cannot afford to pay thousands up front and hope that the insurer will do the right thing. This company seems to be trying to discourage victims of accidents from getting their damage repaired. For someone who can't afford the up front payments, there is no option to get the car fixed or a rental in the interim. It isn't right. The body shop and rental agency both said that Infinity is the worst as far as mistreating victims of accidents and making them pay-out-the-nose to get any sort of repair. Fingers crossed they will actually reimburse in the end. Also, the repair shop says the adjustor lied about the documented damage they sent across and returned an approval for only a bumper cover (to hide the damage).

I made an attempt to cash in my insurance policy. I was told to send in my W-4 forms, which I sent in 2 of them. Now I am being told I need a W-4R form, which was never told to me in the beginning. Each time I call them it something different they need from me. At this time I believe that they just giving me the run around to avoid giving me my money.
