I was contacted by this business via text message claiming that they hold a collections account for a Care Credit card in my name. I have proof that I settled this debt with the original agency 3 years ago and no longer owe anything on the account and it has been closed. I don't know how they got my information but this This is fraud and harassment and I'm demanding they cease and desist.Business Response

We have documented that the consumer is disputing this debt on the grounds that it has previously been paid. While we would normally request documentation from our client to be able to investigate the consumer's dispute and assist the consumer in resolving the dispute, unfortunately since the consumer expressly stated that we are to cease and desist, we are not able to assist the consumer any further. We have placed this account into a cease status, pending recall by our client. Credit Control, LLC will perform no further collection activity regarding this account.
Regarding the consumer's concerns with the credit reporting of this account, please be advised that at no time has Credit Control, LLC ever reported this account to any credit reporting agency. Any credit reporting of this account would only be handled by the current creditor, LVNV Funding, LLC. The consumer would need to address any questions or concerns regarding the credit reporting of this account directly with LVNV Funding, LLC.

I've been calling this company for two weeks now to settle a debt. I've tried calling them back after missing a call the first week and the number go back to a message box. They called me today about a ***** bill. I dealt with a lot of medical bills last year from over a dozen providers so, fair enough, I likely forgot this. They tried to say they’d refuse to verify the debt for me unless I guaranteed payment, which is illegal according to the Consumer Financial Protections Bureau. I paid ***** directly. We are in receipt of the complaint of ******** *****, forwarded to our office through the portal on February 20, 2022. Upon receipt of your correspondence, we documented this complaint and forwarded a copy to our client, ***** ***********.
In reviewing our file and speaking with the representative who spoke with consumer, we find that the representative misunderstood the consumer's request. The representative believed the consumer was asking for a "balance due confirmation", which is a letter sent to confirm an agreement to pay the full balance of an account in 1 payment. We have reviewed the conversation with the representative, and apologize to the consumer for any inconvenience as a result of the misunderstanding.
We have reached out to our client and requested documentation to validate this debt, and have placed a hold on any further collection activity until such time as the validation is provided to the consumer. We will not resume collection activity unless and until this documentation has been sent to the consumer. If we are not able to obtain the documentation from our client, or if the account is recalled by our client, we will close our file and return it to ***** ***********.

Credit Control LLC is claiming I owe a debt of $2,609.55 account **** however they have not showed verifiable proof that the debt belongs to me. Reference account was illegally oppende by exwife and was included in a divorce settlement and creditor refused payment because they sated they no longer owned the account 12/10/2021. And would not provide new ownership. Account was stricken from divorce settle after 3 months of attempting to settle during divorce mediation. According to the Fair Credit Reporting Act, Section 609 (a)(1)(A), Credit Control LLC required by federal law to verify, through the physical verification of the original signed consumer contract, any and all accounts that you post on a credit report. Otherwise anyone paying for their reporting services could fax, mail or email in a fraudulent account. I demand to see verifiable proof from Credit Control LLC original consumer contract with my signature on it) that you have on file for the account listed above. Their failure to positively verify this account has hurt my ability to obtain credit. Under the FCRA, unverifiable accounts must be removed and if you are unable to provide me a copy of verifiable proof, and you must not place this account on my credit reports. Our client provided us with copies of the Terms and Conditions for this account from 2016, a copy of which we have mailed to the consumer. I am rejecting this response because:
the debt amount is not was was owed when the account was tried to be payed off during the divorce. ***** refused payment. For over 6min tha stating they don't own the account and would not provide information on who owned the debt. This account was illegally opened by my ex wife and was attempted to be settle during the divorce because it was opened illegally creditor refused to settle debt and claimed they did not owned debt and it was recorded during divorce settlement. 6 months of contacting creditor to get account payed and they refused .. There is no proof the debt is real and amount owed is not even acccured as stated during divorce debt collector added ove le $100 of fees on a debt they claimed they did not even own during the divorce yet ***** claimed had sold it already. So either creditor or debt collector is lying about when the account was acquired and sold and the amounts are incorrect as the dates from court document are after the account apparently was sold and debt collector denies having the accoutn back then but the paper they just send me stated account was sold way before my divorce was settled. On their previous answer debt collector denied owning the debt on the paper they send me stated they owned the debt before the divorce was settle so clearly they are lying.

We are in receipt of the complaint of ******* *******, forwarded to our office through the portal on February 16, 2023. Upon receipt of your correspondence, we documented this complaint and forwarded a copy to our client, *** ** ***.
In reviewing our file, we find that this account was placed with our office for collection in September of 2022, at which time we sent our letter of representation to the consumer. We have not had any contact with this consumer, nor have we received any response to any of the letters we sent to the consumer, prior to receipt of this complaint. As a result, we were never made aware of the consumer's dispute of this account. While our normal course of action would be to request documentation to provide to the consumer so that we could assist the consumer in resolving the dispute, unfortunately as the consumer expressly requested that we remove their name and information from our file, we must cease and desist and therefore we are unfortunately not able to provide the consumer with any further assistance. We have closed our file regarding this account and are returning the account to our client.

This false debt was sold to Credit Control LLC from *** ******* *** and this is the 3rd company they have sold this false debt to. Please see previous BBB complaint #******** (1/23/23) and BBB complaint #******** (2/13/23). This debt is not mine and has never been mine. Please enforce them to stop selling this debt and falsely billing and threatening me. When they answer to the BBB that they will not pursue this debt, it does not mean that they will not sell it. Upon review of the consumer's complaint, the consumer seems to believe that the FDCPA restricts a debt collector from sending a collection letter outside of the state in which they are located. As you are no doubt aware, this is not the case. Credit Control, LLC is fully licensed in every state which has licensing requirements, and we perform nation-wide debt collection activity in servicing our clients. Regarding the consumer's request that he receive no further communication from Credit Control, LLC, we have closed our file regarding this account and are in process of returning it to our client. We are in receipt of the complaint of *** ***, forwarded to our office through the portal on January 6, 2023. Upon receipt of your correspondence, we documented this complaint and forwarded a copy to our client, ********* ****
In reviewing our file, we find that on November 16, 2022, we received a complaint through the CFPB portal from this consumer, stating that the consumer believed this account was the result of Fraud, and asking that any credit reporting regarding this account be deleted from the consumer's report. Upon receipt of that complaint, we closed our file regarding this account and forwarded a Fraud claim to our client, so that they could initiate their investigation into the consumer’s claim. On December 6, 2022, our client returned the account to our office, advising that they had completed their investigation and deemed that this account was not Fraud.
Per the consumer’s request, we have requested a copy of the application from our client and will forward a copy upon receipt.
Regarding the consumer’s concerns with the credit reporting of this account, as stated in our response to the consumer’s previous complaint, at no time has Credit Control, LLC ever reported this account to any credit reporting agency.
