I started receiving calls the begining of June, demanding payment from a loan provider EZ Money Loan servicing. When I didn't respond, they began calling my husband relentlessly. They asked him to provide my social security number which he said no to. He then requested the representative to provide additional information, the original contract, etc. and was told, they don't have that information available and wouldn't be able to send. They said the loan defaulted in 2021 and that I owed $3000, I have no knowledge of this loan, it is no where on my credit report, and I am not showing in collections to anyone, we pay our bills.. They told my husband they would settle this matter today for $700 or would take me to litigation. This is fraudlent on all levels and the calls need to stop.Business Response

I am rejecting this response because:If I were the responsible party why would you just remove it from the system after threatening legal action and demanding a payment of settlement after weeks of harassing phone calls. I'd like an acknowledment of fraud. Based on what I'm seeing from multiple complaints on the BBB, this same form of fraud is happening to others. It isn't right and this company should be investigated for their practices.

On 06/21/2024, I recieved a call to my cell from someone claiming to call from *****************. The person on the other end of the phone could not pronounce my name, but after I did correct my name, she proceeded to tell me that she was calling in regards to a debt that was discharged in a bankruptcy in 2018 I believe. She threatened me with a lien, even after I asked that she contact my lawyer. I am requesting that the company no longer contact me, rather contact my lawyer as they do have their information. I do no appreciate the lies or being threatened.Business Response

I am rejecting this response because:The account may be listed under my Maiden Name Tierra Days vs my married name ***********************, but when your very rude rep called me , she was sure to address me as ************************* , in which I corrected her and told her that it was *****. Furthermore , she also had my address , and was sure to state back to me what it was. They should not be contacting me anyway. This bankruptcy was in 2017, discharged in 2018 and the debt was included in the bankruptcy. I also advised the rep to contact the attorney who handled the case .

I am rejecting this response because:The resolution I am looking for is that you will remove my information from your system, and apologize for the very rude and ***** threats made by your employee , which is that she was going to file a lien against myself and my property. She also made mention that the debt in question could not be included in a bankruptcy , which is not true. Ive been fighting with not only this company but other collection agencies for years over this and do not feel that they should have been able to Violate my rights by trying to collect on a debt that was discharged in 2018 by a federal court!

I finally contacted Aquarian asset management after continued phone and email harassment threatening legal action and income garnishment. Told they represented a creditor for a 2012 incurred debt. I spoke with ******************************* and in May 2, 2024, settlement of $558.50(including $10 fee). I was told I would receive my copy of the final settlement papers within 4 weeks. That time has passed.When questioned as to the original creditor was, I was given inadequate and vague answers.In 2012, I was unemployed and homeless and cant imagine applying for money of any amount from anywhere.More the fool I am for being suckered into this apparent scam.Business Response

Received a phone call on June 11th, demanding payment from a loan provider EZ Money Loan servicing. They say I owe on a debt from 2018, but that makes the debt uncollectible due to statute of limitations. They say they were hired by a law firm that filed a suit against me in a district this company will not name. They wont give me the alleged law firm's name. They also refuse to send me a written debt validation letter which is required by law and texts and emails DO NOT satisfy that requirement. They call incessantly even after telling them to stop calling as long as they refuse to send a validation letter. They make threats of ensuring all my money is taken and property put with liens.Business Response

I keep receiving calls stating I have a case number. I've been ignoring the voicemails, however, I got tired of the calls and decided to call back. This company is claiming that I owe money for a loan I never received from easy money loans through Aquarian asset management LLC. Ive had no account or dealings with either of these companies. There is a "settlement offer" letter offering me to settle for ****** and if I do not they will contact my bank for extraction. I owe these people nothing as I have not applied for a loan. There is nothing on my credit report, nor is there a deposit into my account at any time. They are either fraudulent or someone has fraudulently applied in my name.Business Response

I've received a couple phone calls regarding a debt of a payday loan which I did not take out. The company for one just trying to get any information out of them was combative from the beginning of the call. This attempt on a debt that was said to be done 12years ago in 2012. I don't have any debts from 2012 and it would be out of the Maryland Statue of Limitations to collect on a debt and would not be reported on the credit bureaus after 7 years. I also filed for bankruptcy in 2022. None of those items included any kind of pay day loans. I have been receiving calls on my work and personal phone but when I ask them about it now, they say they don't see anything yet, I'm still receiving phone calls. I don't understand why you all are calling me when I don't owe you anything and have no record of this pay day loan to reference. There is no record of this loan for this attempt. The first rep hung up on me, the second was rude in so disrespectful and the last lady actually providing me information and saw the bankruptcy and apologized for the other reps bad behavior and said she noted the account. Not even ****** later I received a call from a different phone number on my personal phone and when they looked into it stated they don't have anything in their records. If you owe money to someone, the person is called a creditor, and what you owe them is called a debt. The creditor generally has 3 years (4 years if the debt is owed for the sale of goods) from the date the debt becomes due to ask the court to order you to pay. A court order to pay a debt is known as a judgment. If the creditor does not go to court within the time limit, then the court generally will not order you to pay the debt. Read the Law: Md. Code, Courts and Judicial Proceedings 5-101; Commercial Law 2-725If the creditor does go to court within 3 years, and the court does order you to pay it, then that person has 12 years to collect it from you, unless the judgment is renewed. -To get a judgment, a creditor must bring the claim to court within 3 years after the debt comes due. Read the Law: Md. Code, Courts and Judicial Proceedings 5-101 A creditor may not start a debt collection case after the 3-year statute of limitations. For example, if you had a debt that became due on January 1, 2016, the creditor would have to file the debt collection case before January 1, 2019. They would not tell me who the debt was with. I was suspicious since I knew I didn't have any debt on my credit report other than my CCs. They would not answer my questions and kept asking for my SSN. I believe this is a SCAM. I would like to know who is saying I have a debt with them. They would not tell me.Business Response
