I have contacted the LexisNexis *************** to have my data DELETED and REMOVED from their system multiple times. They are still holding data on me and reporting on my report. This company should not have any of my personal information and multiple requests to DELETE my file from their database has been ignored. 4/19/22 Consumer #******* Letter confirmed suppression. Today 8/24/22 Report still contains my personal information. I have requested to have ALL INFORMATION DELETED from this company as I have not authorized them to sell any of my data to anyone and also disregards the California Consumer Privacy Act. I am again requesting ALL of my personal data to be deleted in their system. I want confirmation in writing.Business Response

Better Business Bureau:
I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because:This is NOT acceptable. This company should not have any information, my permission for any data was never authorized and they are selling it to various companies. I received an Opt-Out letter for MARKETING materials, however this company is not authorized to house any of my information. I ask that this be opened and disagree with this response. There are several complaints on this company and them selling personal data. Please advise.

LexisNexis Risk Solutions **** takes complaints from consumers extremely seriously and we have a robust process in place for resolving such matters, including a Legal review of all responses and handling by our Operations Escalated Response Team.
For Better Business Bureau (BBB) complaints, we continue to use a generic response for posting on the BBB website and a mail a more fulsome response to the consumer. We have taken this approach to safeguard consumer-specific data; the BBB has confirmed that this is the better approach.
If the consumer does not agree with the BBB website response he or she can then reject the case on the BBB website; however, it keeps the consumers data safe.
And to reiterate, a separate letter is sent to the consumer with the specific details of the resolution.Initial Complaint

I worked with LexisNexis in January 2016 to get a Clue (Original case #: ***** In 2015) report as I had been requesting an insurance quote from StateFarm who said I have claims showing up under my maiden name but it under a different social security number, however it still comes up under my consumer report. They had claim dates of 5/10/2011, 2/8/2014, and 9/3/2014 through ***************** which I have never had. Back then I had requested a CLUE report and this person, ***********************, who is not associated with me was detangled from my persona. I worked with them again in Sept 2021 and I am working them currently. I received new reports, I went through their dispute process, I received a letter saying it was accurate. I am continuing to run into problems when I have to answer public records questions recently trying to wire some money from my bank and being asked public records questions that were not related to me and it once again is the same person and issue I had in 2016. I do not know how to permanently end this problem. Additionally, with this round, they are saying the data is accurate.Business Response

On 06/082022,07/06/2022 and 08/06/2022 I disputed with TransUnion and Experian about bankruptcies reporting on my credit report, I asked both credit reporting agencies how did they verify the bankruptcies as accurate they both stated they verified with the courts, I then sent a letter to ** bankruptcy court here in ******** and asked how do they verify bankruptcies with credit bureaus they sent a response back stating they do not verify bankruptcies with any credit reporting agencies. July 28, 2022, I sent a letter to the courthouse asking do they report to the credit bureaus and I got a letter stating They do not report any bankruptcies to anybody. They never did a fair investigation according to the 15 U.S.C ******* ************************************; The term investigative consumer report means a consumer report or portion thereof in which information on a consumers character, general reputation, personal characteristics, or mode of living is obtained through personal interviews with neighbors, friends, or associates of the consumer reported on or with others with whom he is acquainted or may have knowledge concerning any such items of information. Better Business Bureau:
I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because:To whom it *** concern,
Your letter did not explain if you received my written permission to report the Public Record IAW The Privacy Act of ****. Per you letter, you acknowledge PACER is a system of record used for bankruptcies:
PACER is the system of record for bankruptcies. Please be advised that while the **** Bankruptcy Court *** not provide information directly to consumer reporting agencies, bankruptcies are a matter of public record and can be obtained from PACER, which is an electronic public access service that allows users to obtain case and docket information online from federal appellate, district, and bankruptcy courts and is provided by the Federal Judiciary to allow public access to court information.
The Privacy Act of ****************************************************************************************** a system of records. A system of records is any grouping of information about an individual under the control of a ************** from which information is retrievable by personal identifiers, such as name, social security number, or other identifying number or symbol. Under the Privacy **** **************** *** not disclose information without consent unless certain exceptions apply to the disclosure. The Privacy Act provides protections to individuals in three primary ways. It provides individuals with:
the right to request their records, subject to Privacy Act exemptions;
the right to request a change to their records that are not accurate, relevant, timely or complete; and
the right to be protected against unwarranted invasion of their privacy resulting from the collection, maintenance, use, and disclosure of their personal information.
You *** have been given access to PACER, but it did not remove my rights under Federal Law. You disclosed information without my written consent and the Court of Record did not instruct you to provide the information to the three credit bureaus. I was granted access to PACER, but that does not give me permission to find other individuals Public Records information to report to other parties.
I am not arguing that you did not have the right to access any information pertaining to me that *** have been found in the system, but you did not have the right to report the information found in the system either. You made a profit from the information which again violated my rights.
Please provide me with a detailed letter explain what Federal Law provided you with the right to sell & report my information.
The information in PACER *** have been reported by the Court of Record, but provide me with the letter from that same Court of Record stating it has verified any of the information directly with Lexis Nexis. Also, provide me with the letter from the Court of Record authorizing you to report any information to any other party or parties. According to the information I provided, the Court of Record (Bankruptcy Court) does not validate or give any information to third parties. You are choosing to ignore this item by using a loophole stating you were given access to PACER which any person can gain by paying the fees to gain that access. It was not given to you freely, you had to pay for to receive access to PACER.
Again, provide me in writing the Federal Law that gave you the right to sell & report any information stored in PACER about me. Provide me with the letter from the Court of Record authorizing you to report any information about me. Provide the letter from the Court of Record validating that information (your reason saying its valid because its in the system of record does not meet the standards under FCRA to continue validating the information or your actions because it has not been validated by the actual holder of the debt, the Bankruptcy Court). Provide me with the letter, if any, I provided Lexis Nexis giving permission to look up any information pertaining to me in PACER, or giving permission to report the information to any credit agency (Equifax, Experian, Trans Union). Provide a detailed letter covering all items I have requested via ** MAIL & email to *************************.
*********************In order for the BBB to appropriately process your response, you MUST answer the question above.
Sincerely,
*******************

LEXIS NEXIS has a false record on file for me. This false record is making things extremely difficult in getting a new Mortgage. Note this record is not and never has been on any of the three Credit Bureaus, only their false records. I have been trying to dispute this for months, submitting all the documents and information they request, but they wont even look at the issue or contact anyone to confirm or remove it. It has greatly affected my home search as I need this resolved and interest rates are continuing to skyrocket and my wife and I have lost one home already due to this. False report is on page 52.
