Back in 03/24 I went to a car repair shop to have some repairs done. On the website they advertised financing with American First Finance company. Having already spent more than $2000 on repairs in less than 3 months, I thought it would be a good idea, like I have an account with ******************* Tires. The loan amount was for about $1100. I signed the agreement for auto debit for about $80 to be auto debited from my account every two weeks. No problem. The balance was decreasing. Around June the balance was about $550. Great. Almost done. Then I saw an email or statement for July and the balance was now more than $1000. I didn't understand. So, I went to the website and pulled up my account online. I was puzzled. I called them yesterday to inquire about the clerical error. When I spoke to the representative, he told me that that amount was indeed correct. I asked him, how did it go from approximately $550 back up to over $1000. He said there is a clause in the contract that if the account is not paid off in 90 days, there is a per diem rate of about $4.50 or roughly $5 per day added to the amount until the balance is paid off or the contract comes to an end. So basically, someone takes out a small dollar loan like mine for $1100. I have paid them more than half already by auto debit every two weeks. They have now added on more than $600 because they begin charging you the $5 a day from the start of the loan. What company that is supposed to be for the underserved community comes in and starts adding $300 per month until the loan is paid off. When you sign the loan agreement, they set it up to pay the $80 per pay period when you sign up for the loan. Why are they setting this amount up, if they know that they are auto deducting only $80, when it should be more, so that the balance of the loan is over a 90 day period to cover the initial $1100? They KNEW that how they set that up, no one would realize that. This seems quite illegal to charge $300 extra per month!Business Response

AFF is a predatory lender that hides fees and terms, charges exorbitant interest rates outside of legal limits, and is currently facing a class action lawsuit for these exact reasons. I paid my loan amount with interest and you are now trying to charge me double what I originally owed. You have made it impossible to update payment information and you have the wrong name on my account. I have filed a dispute with transunion. Extremely frustrating as I had already paid off one loan with this company, only to be scammed. DO NOT TAKE A LOAN OUT FROM THIS COMPANY. YOU WILL REGRET IT.Business Response

On 9/15/2022 I took a loan out with American First Finance in the amount of $3,000.00. Yesterday, August 8th, 2024, I logged on to the American First Finance Website to see my progress with paying off my loan. Yesterday the website had that a payment of $147.39 is due on 08/09/2024 and that my Early payoff amount as of 08/08/2024 was $307.04. I called American First Finance yesterday before paying off the account to see how many more payments were left and she told me 3 payments. I decided to pay the early payoff amount of $307.04 to save on interest. I put through the payment and the website congratulated me for paying off the loan. This morning, I see that not only was I charged the $307.04 but also the payment for $147.39. I called this morning and spoke to ****** and she apologized for the misinformation on the website. ****** says the only thing they could do is refund me my payment of $307.04, but this would reopen the loan and I would have to pay the remaining balance at a higher interest rate. I find that to be totally unacceptable. I feel that weather or not the information on the website was correct or incorrect, that was the information they provided to me and that information is what I based my decision on to pay off the loan early. I feel American First Finance should take accountability for what was presented on their website. I feel the early payoff amount of $307.04 should be honored and I should be refunded the payment for $147.39. If the early payoff date is prior to the payment due date then thats what my payment should be based on.Customer Answer

Back in December of 2023 . I had applied and got approved for $600 from AFF while Shopping once I got approved I figured I could do a little bit of gift Shopping since graduations will be coming in may of 2024 (5 months) away so I went ahead and got myself a portable JBL speaker witch was 149 plus taxs. I also Seen a moto Razer 2023 flip phone unlocked. So I got that as well and was gonna save it for my neices graduation. Witch was at the end of May of 2024. 5 months away if that. So since it is advertised as unlocked everything is fine it works and ect. I went ahead and put it aside till the time came to give it to my neice. The whole time I am paying on each product with no issues no complaints. Then We get to the day of my Neices graduation May 27th of 2024. I went and gave her the phone and a card along with a few other things. The following day we went to take the phone to get activated. To find out that The phone that I had been paying on and still was at the time. Was a phone that was Stolding and could not be used at all. Basically I had been sold a phone that someone stold and sold the company.up on finding out this info and going to another phone carrier to make sure it wasn't a mistake. I Contacted AFF immediately. And this is were things go down hill. I had explained to the whole situation to the first *** I had spoke with over the phone to basically be treatedlike I was lieing then I was told I would have to file a police ***ort .So upon doing what I was told I had to do. I had got a call from AFF customer compliance and was told that the 1st *** I spoke with misunderstood .and thought that I met someone had took the phone from me myself. And that was not the case. So upon speaking with a gentleman named ***** and being told numerous other things. And them taking over 1000 dollars. I'm told they don't have to give me a dime back and they won't issuea refund s for the phone that was stold . My amout was a little over 480 and they took $1105.27 from me.Business Response

I did get a refund after I had no choice but to file a complant. The way AFF treats there customers .and the money they take is just wronge on so many levels. Hopefully the BBB will take time to look deeper into AFF. They are robbing people blind.Initial Complaint

I received received financing from AFF on 4/1/24 for a loveseat(***********************)asking price of $999.00(over priced),plus $199.00 delivery fee which they brought out the wrong loveseat(a chocolate leather),and came way overdue.I paid in $736.00 til now and have 101 days to pay off $635.10 8/12/24(extended as a courtesy),as I paid off another account prior to be informed that on 8/13/24 I will have to pay $4,000 minus my $736.00($3,200 plus)for balloon fees,and fees not even stated on contract for a set that is ***** is very absurd to myself and this company is getting away with this unlawful fees to satisfy there business causing consumers financial burden if they cant meet the 101 rule and after speaking on a recorded line today 8/7/24 the representative could not tell what fees comes to $4,000,he just said you signed the contract read it and sent it over to email which is attached to this complaint.Business Response

I am writing to formally dispute the inclusion of American first finance on my credit report, which has been reported without my consent. Furthermore, my personal information was used in a data breach as a result of this unauthorized reporting. Below are the pertinent details of the issue: Unauthorized Reporting: I did not authorize American first finance to access or report any information to my credit report. This violates the Fair Credit Reporting Act (FCRA), specifically Section 604 (15 U.S.C. 1681b), which outlines the permissible purposes for obtaining a consumer report. Data Breach: My personal information was subsequently compromised in a data breach. According to the ***** Section 609(e) (15 U.S.C. 1681g(e)), consumers have the right to receive a copy of information in their file that may have been used in the breach. I have had a catastrophic failure to my truck and it needs extensive ***airs, I contacted American first finance who the ***air company recommends and filled a apply for a loan, they stated that I was denied because I had an open loan woth them, I asked "if I pay that off will I bo good then?" The *** said "yes if you pay this off we can continue" and then transferred me to a different department where I paid off the previous loan amount, I was then transferred back and told that I was approved for 1/4 of what I applied for. I could've spent my $919 on ***airs instead of paying off a loan I was current on but based on the iincorrect nformation I was given by the *** I choose to pay off my loan. This is a dishonest loaning process in my personal feeling and I was blantly and intentionally deceived in this processBusiness Response
