Can you take a look at this case, the customers rebuttal is the same complaint as the original complaint. In our response, we explained the terms listed within the singed contract to utilize our financing services, and as a courtesy we refunded half of the amount he paid in finance charges. Since the rebuttal we have made several more phone and email attempts to offer a full refund, but the customer was unresponsive. There is really no other information we can provide that we havent already. Thanks

I financed tires through this company in the amount of $1491.79, I was told if I paid it off in 90 days, There wouldn't be alot of intrest applied. Unfortunately I was laid off from my job due to the economy at the time and wasn't able to pay them off in 90 days, However I still continued to make payments. To my surprise I seen the amount to be charged over 6000 dollars. I continued to make payments. Recently I had a bad car accident, And totalled my truck. I no longer have access to my tires, And I reached out to the company to try to find a solution. I have paid to date, over $1800, Which is more than the original financed amount. The only solution they offered me was a payoff amount of over 3 thousand dollars which is more than double what I originally financed and would bring my total to almost 5 thousand dollars for merchandise I no longer have access to. This company is predatory and I do not see how it is legal.Business Response

I purchased a dog from brookside pups on 7/24/22 I was told by the sale rep. That if I pay for the pup in full within 6 months O would be able to avoid expensive finances charges. I did not receive any papers other than what was given to me in the store. When I tried to fully pay for the pup on 2/1/23 American first finances. Tried to charge me the full price of the finances time/charges. I was not aware of any early penalties for pay before 18months nor did I receive the early pay out option. A contract was emailed to me on 2/3/2023. It was not the same agreement made in the store. I believe that I only owe a remaining balance of 200. My monthly payment of 136.01 was made consistently on time for 6months the price of the dog is 1034.01. American first finances is asking me for 1800 for reasons that is not clear too me. I offered to pay the balance in full. American first offer a settlement and a negative credit report.

So this finance company say that I have to pay for the first 2 month of payment for an item that I donated due to the payments being so high. The payments are 1,182.62 a month for a set of rims and tires. Now, I have spoken to several different employees and I was informed that I would not have to pay the bills if the donation was completed prior to my billing date.. I tried submitting the paperwork from Nov XX XXXX to get this stuff taken care of.. I did not receive a call back from. The return department until Tuesday Dec 6th 2022 about the items I had donated. Thats 8 days after my first payment was due.. when I emailed the receipt 10 prior to my billing date. I want this account closed and off of my credit report due to me not having an item that I'm being billing for.. I have called numerous times trying ro speak with the return department and all I kept getting was they will return your phone call once the account had been settled..Business Response

The business has collected on two different occasions earlier than the contract agreement date. They pulled money out of my account that I had set aside for a different bill due. I have never been late or missed a payment the two times I've done business with them. Unprofessional, messy bio and they have broken trust and I will not do business with them going forward. Not to mention there was a legal contract so I don't understand how they are able to pull money early then the agreed time. It messed things up on the bill that was due on that particular day. I do not accept this response because I am still getting different information from different reps when I call American first finance. Then I receive voicemails from a total different representative's name saying they cannot reach me, but I have been on the phone several times with different reps attempting to resolve the problem. I am still confused at this point and have not been asked for documentation as stated in the response letter from the business. I can provide the email receipt and bank information that shows the payment was taken on Thanksgiving Thursday instead of Friday, then I was told I would be given a credit and a refund, but I did not get that and later received an email stating the credit was simply a push back on the buyout option date. It was not a credit. I am still convinced I will not do business with them anymore going forward because this is been too much of a hassle, and there has not been consistent information . Now in this response later, sent to me from them it says your account has been closed out with zero balance. We purchased a sofa set from ********************************* in October of 2020 in the amount of $1649 for the whole set. With delivery, the total with tax came to approximately $2185. This was in the middle of the pandemic and we had just moved to our new home January 2020. We used American First Financing to make this purchase and started making payments starting October 15, 2020. We stopped making payments November 1, 2021. Unfortunately, I did not take the printout of the evidence until now and my bank statements only go back 24 months. When we signed the paperwork and looked at the interest rate, we were told by the sales person that it was a typo and that would be fixed internally and that the rate of interest was 13.5% which although it was high, we were willing to pay.
In October 2021, I became curious as to when the payments for our sofa would be over and I called American First to get an end date of payments and they told us that it would not be until this year. I asked what the remaining balance was in the hopes that perhaps we could pay this off with one final payment and they told me approximately $2500 would pay this off. This shocked me considering the fact that I was fully aware of what the sofa set was worth. I told them we were making payments for over a year on this and there is no way we have a balance of $2500 on a set that only cost $1650. I was told that we signed paperwork that said the interest rate was 135% and that this was what it is. I logged into the website and removed my billing information the following month after the November 2021 payment was made.
To date, we made payments totalling $3406.99 for this purchase, payments were taken twice a month. This is twice what the actual item was worth. Well over the 13.5% we expected to pay in interest.
We have a couple of issues:
First issue: American First has employed predatory lending in this instance and when contacted to resolve, they refused. Charging 135% interest to applicants in the middle of a pandemic when my wife lost her job at one point during the pandemic is equally deplorable. Additionally, they have now put the account in collections despite having collected close to 66% interest. This practice is disgusting.
2. They have employed a collection agency to harrass us for the balance. When I've explained that we do not need to pay anything further after paying more than 50% interest on, they did not care to resolve and remove the remaining balance.
I am uploading our receipt from *************** and my wife's bank account statement, which is where the payments were taken from.
We would like this to be reflected in my credit report as closed and in good standing. We want the harassing calls from the collection agency to stop. We also want their BBB rating to be lowered
We are also taking this to the FTC as the 135% interest rate is actually the definition of predatory lending.Business Response
