Hi, Im hoping you can help me. We had a fire in our 5th wheel Jan. 2023 and it was determined it was totaled. The insurance company (National General) called Copart to pick up the 5th wheel. I have tried talking to the manager of the *****************. Location (******************) about them picking up our 5th wheel. When the tow truck drivers came out they had a lot of trouble hooking up. Then they discovered I had a catch plate on the trailers hitch. That is needed in order to be able to tow with my type hitch. It is a slider hitch. I asked them to leave it for me because I would need it to be able to tow the other trailer we were going to have to purchase. We finally were able to find a trailer BUT discovered the tow truck drivers took our catch plate with them. ****************** said I spoke to my drivers about the catch plate and was told that they left it on the grass. Im so sorry but they did not leave it on the grass or we would have seen it. We had to purchase another one for $217.00.Im including the copy of the receipt, and the emails in between my self and ****************** plus the insurance company.Business Response

Copart wouldnt accept any of my buisness paperwork from the *****************. So they wouldnt allow me to have a REAL membership. Only wanted this account to buy 1 vehicle. Well here it is 4 days later that vehicle goes to auction this morning. *** tried uploading everything from my trucking buisness to farm buisness and they wouldnt accept anything that the state has given me. In response to the claim asserted by ************************* about her Copart Membership.One of the prerequisites to bid on prospective vehicles is establishing a member account with **********************. To become a Copart member, an individual must pay the non-refundable membership fee and agree to Coparts binding Member Terms and Conditions. Destiny Lockes member account indicates that ************************* consented to the current Terms and conditions. These Member Terms and Conditions state:
IV. MEMBERS
A. Member Eligibility. You *** sign up as a Member at Copart if you are at least 18 years of age. In addition,state-specific registration requirements and applicable laws, regulations, and restrictions *** further limit Member sign up and vehicle purchasing eligibility. Copart reserves the right to deny member privileges to, or exclude from Copart facilities, any individual or entity, in its sole and absolute discretion.
B. Member Types.
Registered Guests must register and provide first and last name, email address and phone number. Registered Guests have the option to submit a physical address and copies of current government issued photo identification as well as licenses and completed sales tax exemption certificates, if applicable, in preparation of becoming a Basic or Premier Member. Registered Guests *** search inventory, add vehicles to a Watchlist and create Vehicle Alerts, but Registered Guests *** not bid on or purchase vehicles unless their membership type is upgraded to either a Basic or Premier Membership.
In order to bid on a vehicle, you must be a Basic or Premier Member in good standing:
Basic Members must register and provide copies of current government issued photo identification as well as licenses and completed sales tax exemption certificates, if applicable. In addition, Basic Members, must pay the initial Basic Member registration fee. A security deposit *** also be required in certain cases in order for the Basic Member to submit a bid (see Section V.H. below).
Premier Members must register and provide copies of current government issued photo identification as well as licenses and completed sales tax exemption certificates, if applicable. In addition, Premier Members must pay the initial Premier Member registration fee and security deposit.
All Basic and Premier Members who purchase vehicles for resale must provide copies of current licenses and completed sales tax exemption certificates. Basic and Premier Memberships must be renewed annually by paying an annual nonrefundable Member renewal fee and submitting copies of all current licenses (if applicable), and any information regarding change of ownership or address. Copart reserves the right to increase or decrease registration and renewal fees at any time without prior notice to Members.
By agreeing to these Member Terms and Conditions, ************************* acknowledged that she understood that based on state specific registration requirements and applicable laws, she *** not be eligible to bid on a vehicle in a specific state/location. The Copart webpage even provides a licensing overview page that shows the licensing requirements for each state. Had ************************* reviewed this information, she would have known which states she was eligible to purchase a vehicle in as an individual and which states required other licensing. I purchased a 2017 Lexus RX 350 Vin #***************** from Copart ****** , **** location. The vehicle was sold to me as a clean title which was an **** title. I transferred the title from my business name ************************************ to my personal name. Again the title came as a clean title when I went to a dealership it was discovered that Copart had reported the vehicle to NMVTIS and now showing as a salvage vehicle .I contacted the yard in **** the general manager *************************** said that he would not return my $19, 325. I stated that I wouldn't spend over $19,000 on a salvage vehicle. I called repeatedly and he was always "in the yard". I spoke with the title department at the location and I was told that Copart could submit an amendment and this could be resolved. Nothing was done . I emailed the Regional Manager for this location ********************* and he never responded and *************************** stop responding to all of my emails. I contacted the corporate office in Dallas , Tx and the NMVTIS department also refused to submit an amendment. I contacted the ************************ in **** and the vehicle had never been issued a salvage title.The insurance company ********* Insurance never wrote the car off as salvage. ********************* the Compliance Manager at Copart in Dallas , Tx has refused to issue and amendment or return my money. I have expressed on several occasions I can take the vehicle back to the nearest location. The vehicle has been parked since July 11th. Copart has refused to acknowledge the over reporting of vehicles in their inventory to NMVTIS. This false reporting has caused a vehicle worth over $33,000 be valued as $13, 000. After not getting an amendment or a refund I contacted the ********** of ******** Now at this point I'm in contact with *************************** Associate General Counsel for Copart.*************************** is trying to shift the blame on the ********** of ******* NMVTIS department stating they're waiting for a report.Business Response

NMVTIS is a federal database for reporting salvage and junk vehicles that is entirely separate from state laws regarding which vehicles require a salvage or junk title. Therefore, from time to time, Copart, as required by federal law,reports clean title vehicles as salvage to NMVTIS that qualify under the NMVTIS definition as salvage. These vehicles can be transferred under a clean title,as **************** has been able to do, even while they are reported salvage in the NMVTIS database.
Copart makes all members aware of this particular risk from the differences between state laws and federal laws. One of the prerequisites to establishing a member account with ********************** is agreement to Coparts binding Member Terms and Conditions. ****************** member account indicates he has consented to the current Member Terms and Conditions. These Member Terms and Conditions state:
I. DISCLAIMERS
A. Vehicle Condition and History Disclaimer.
Except as otherwise expressly provided by applicable law, ALL VEHICLES ARE SOLD AS-IS WHERE-IS.
Except as otherwise expressly provided by applicable law, all vehicles sold through Copart are sold AS-IS WHERE-IS, WITHOUT ANY WARRANTY, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE OR MERCHANTABILITY. As used in these Terms and Conditions,vehicle(s) means all items posted for sale on Coparts websites and otherwise offered for sale at Copart facilities, including but not limited to cars,trucks, motorcycles, boats, jet skis, industrial equipment, trailers, RVs,etc. Vehicles also includes miscellaneous salvage items that are posted for sale on Coparts websites under the heading Other Goods. However,Members expressly acknowledge and agree that vehicle(s) does not mean or include,and Copart does not purport to facilitate the sale of, any cargo or items of personal property which *** be contained in a vehicle but are not part of the vehicle. Vehicle Information provided by Copart and its vehicle sellers is for convenience only. Copart does not guarantee that any vehicle sold can be legally registered in any state or country, and the Member accepts all risks associated with variations in vehicle title and registration laws between states, provinces, and countries that *** negatively impact the marketability of vehicles purchased at Copart. (For example, a vehicle legally purchased on a clean title by a Member at a Copart facility located in State A *** be required to be sold on a salvage title if Member transports and resells the vehicle in State B.)
C. DMV/MVD/DOR Paperwork Disclaimers. Copart is not responsible for defects,errors, or omissions (i) related to motor vehicle department or department of revenue paperwork not processed by Copart or (ii) made by any motor vehicle department, department of revenue or other governmental entity.
D. NMVTIS Reporting Disclaimer. If this statement from Copart is true then why isnt every vehicle listed as salvage? There shouldnt be any vehicles listed as Clean Title then report the vehicle to NMVTIS as salvage. The issue with Copart still has not been resolved. I purchased a 2017 Lexus Rx350 from Copart July 11,2023. I have talked with ********************* and *************************** from the headquarters in Dallas , **. *************************** refuses to issue the amendment to resolve the false reporting to NMVTIS . This issue is have the vehicle that I purchased as a clean title now show as a salvage vehicle. Copart is refusing to show an record of salvage and it because it doesn't exist. The insurance company didn't write this vehicle off a salvage Copart decided to make this vehicle salvage which is false. Multiple times I have asked for a refund or send the amendment to correct the error, but Copart is holding the position as they're not going to do either. Copart is already under investigation by the ********** of ******* and yet they are still being defiant. This company has robbed me and the public show be aware of the illegal practices that Copart does.Business Response

Last month my vehicle was involved in a car wreck. A local family tow company originally had the car at their location for a couple of days. The insurance company could not find a place to get it in for an estimate or repairs for over a month, so had it towed to "their yard" (Copart). On Friday 6/30/23 I was told that my truck was being declared totaled and was given the details of my local Copart to arrange to pick up my personal items. I looked up the details online and found pictures of my truck already on their auction site including the inside of the truck without any of my personal items. I tried calling but they were closed on the weekend so had to wait until Monday. On Monday 7/3/23 I contacted Copart and was told that they remove all items from the vehicle to take the pictures and then put them back. I drove to Copart after work and was told by the receptionist the same thing, that they removed the items to take the pictures and then put them back. When they let me in the lot to get my items I found out they moved the items to the bed of the truck (with a canopy) but the large items were missing. These items included my full set of golf clubs in a golf bag (that was in the bed of the truck) and my 2 pool cues (that were under my back seat).Copart's response was "I hope you are not accusing us of stealing" and "You need to talk to your insurance about this" along with "Did you call the other tow yard? They could have taken the stuff". I called the other tow yard and they immediately said they would go through the camera footage (which found nobody had touched my truck there). Copart still will not say if they even have footage on their lot. They are now saying that unless I have pictures or video of the items in my truck the day it was dropped off to them that they will do nothing. They have admitted to removing all my items but won't take any responsibility. They should take pictures of items before removing them.Lot #: ********Business Response

They have admitted to removing the items from the vehicle at multiple times over the phone and in person yet refuse to acknowledge that items were missing after they did this. A corrupt enterprise: Their Green light Run and Drive warranty statement is noting more than stated to entice us to pay more for their junk. They lie, cheat, steal, and manipulate buyers. Most of their Run and Drives have blown motors, and did not Run and Drive when checked in at their gate. When reading other complaints. Some did not even have motors. Copart's response: Tough, it has no warranty. Take it or leave it for us to resale again after the storage fees are unpaid for several weeks.Business Response

Below you will find a base outline of the dispute between * ********* and Copart **** Further demanding that Copart **** take a certain action.
FACTS
1:On 01/06/2022 I, * *********, was the highest bidder for a 2014 Ram **** (hereinafter Ram), the sale of the Ram was a virtual sale. Location:Copart **** Address:1880 GA************************************************
2:Total amount paid including all fees required by Copart **** due was:$11,238.00. All Copart **** fees were paid by bank wire on 01/07/2022. I had an additional bank wire fee of $25.00 charged by my bank that was not included in the total amount paid to Copart ****Bank Transaction number : Bidder Name: * *********;
3:Within the bank document for payment it states, Message to *************** * *********. Bidder sold with green R meaning Run&Drive.Salvage Title.
4:Within the bank document for payment it further states, Message to Recipient : * *********. sold with green R meaning Run&Drive.Salvage Title.
5:Within the same bank document it also states Memo: * *********. sold with green R meaning Run&Drive. Salvage Title.
6:Under Lot Details listed by Copart ****, it advertised a picture of the Ram and within the category of Highlights listed the truck is a Run and Drive.
7:Under Copart ****'s written policy and warranty Run and Driveprovides the definition of Run & Drive meaning that the auction marked in its inventory that when the vehicle arrived at the auction yard, and the vehicle:Started under its own operation.Shifted into gear.Moved forward under its own power.The recognized symbol for Run and Drive at Copart **** auctions is a green R within the listing. The green R in the upper right hand corner of the advertisement, directly across from the Title 2014 RAM ****.
8:I arrived at Copart **** for pickup on 01/10/2022 at 10:33am and requested to inspect the truck prior to loading. However, Copart ****refused. I requested the inspection to be assured the Ram did indeed Run and Drive as stated and guaranteed by Copart ****
9:After being refused to inspect the Ram, ******* who identified herself as a Copart Manager, assured me that the Ram would Run and Drive or, I would be provided a full refund. I further inquired about the Ram, stating that on several occasions I had purchased trucks from Copart ****, only to learn when getting the items home that the motors and transmissions were bad and the pictures and statements by Copart **** were deceptive. In two cases, the motors were knocking and transmissions were no good. In all the pictures,Copart **** did not disclosing many dents and missing items. Asitmaybe, Copart Manager ******* assured me again the Ram did Run and Drive as stated on the written post by Copart **** I further explained to the Copart Manager ******* that a 6.7 diesel motor would cost more than $20,000.00 if not running. Again, Copart Manager ******* stated for me not to worry, that it would Run and Drive.Thereof, I signed the remaining papers and was provided the location for loading.
10:After locating the Ram, I attempted to start the Ram for loading.The truck's engine would not even turn over. I had a battery charger. I connected the charger for 30 minutes, but the battery would not take a charge. Therefore, I contacted ************, ** Copart **** onsite office (hereinafter office). The office sent out an employee who worked in the business, identified as the yard man to apply a battery box to jump start the Ram. After several attempts,the employee of Copart **** yard man stated that he was unable to assist. Further stating, that this was a flood truck and most likely the batteries were shorted out in the flood and would need replacing.
11:After further inspection of the Ram, I noticed the housing that provides diesel fuel for the Ram was bent and broken, also fuel wires broken. Thereof, it was [n]ot possible the Ram ran and drove when arriving at Copart **** Since the flood incident occurred prior to the truck arriving at Copart ****, the statement by Copart's employee yard man about the batteries being shorted out in the flood and must be replaced was further evidence the truck did not arrive operational. The Ram was a flood vehicle, but the markings by Copart **** on their post showed the flood line did not pass the right front tire and only the right part of the front end was flooded; however,when inspecting the Ram, it was easy to ascertain that mud was caked in many places underneath the Ram and the diesel fuel housing on the other side. This supports evidence that the truck was flooded on both sides, not just the right front.
12:I left Copart **** and came back with two new batteries. After installation, when I turned on the switch, I noticed underneath the Ram diesel was pouring down from where the fuel diesel housing and fuel wires were broken. The Ram's engine did not turn over, as if it was locked up. Even if the Ram was capable of turning over, diesel fuel could not possibly get to the engine with the fuel diesel housing broken and fuel wires broken. Subsequently, there is no way the Ram could have been tested and should never have been labeled as a Run and Drive vehicle by Copart **** until this major component was fixed.
13:I went back into the office of Copart **** and spoke with the Copart Manager named *******. I explained to her that the Ram was sold as a Run and Drive. That she assured me that it would Run and Drive as listed. I explained to Copart Manager *******, that it would not start because the fuel diesel housing and fuel wires were broken. I also explained to ******* that the Ram was never tested as stated by Copart ****, (or tested and Copart **** made a misleading and false statement) to see if the Ram did Run and Drive. I stated the information provided to me prior to buying, that determined by decision to buy the Ram was misleading and false.Copart Manager ******* agreed, stating the Ram must Run and Driveas stated by Copart **** Moreover, stated that she would refund all of my monies even the buyer's fee. She informed me to have a seat and give her a few moments to get the refund completed. I complied.
14:About an hour later Copart Manager ******* stated that Copart ****had already paid the seller and would not refund the money. She did not explain how Copart **** paying the seller affected not providing the refund. Copart Manager ******* further stated, that her supervisor informed her to tell me, if I refused to take the Ram, I would be charged storage fees daily, and that each day the storage fees would increase. Within no time the storage fees would be more than the amount paid for the Ram, because the storage fees increase daily.
15:After further explaining to Copart Manager ******* that Copart ****on the advertisement for the Ram as in all listings for the Ram stated Run and Drive. The statement was misleading and false. I further explained to Copart Manager ******* that if I would have been told the correct information about the Ram, I would not have bid on the Ram at any price, because the motor would cost more than the amount I paid for the Ram. Further informing Copart Manager *******,without fixing the fuel diesel housing and fuel wires, I have no way to be assured that the Ram did Run and Drive even prior to Copart **** taking possession. ******* stated that she agreed. That Copart **** should provide a full refund, but the supervisor stated that no refund would be given and the truck was now being sold under the new agreement As Is meaning no warranty. Again, I explained to Copart Manager ******* that I bought the Ram because of the statement provided on the advertisement for the Ram. That the Ram would Run and Drive. The statement was provided to me prior to buying. However, after buying the Ram, the law would not allow the guarantee to be altered in order to remove prior written legal guaranteed warranties. Copart Manager ******* repeated her supervisor's instructions, stating if I refused to sign her paperwork, I would be denied access to the Ram. I again explained to Copart **** Manager ******* that if forced to sign additional papers after the sale, stating a different warranty other than Run and Drive, to a new no warranty As Is that it will not remove Copart **** from being held liable nor being ***d for their misrepresentation, negligence, and/or Fraud. Thereof, taking possession of the truck under the threat I would be denied access to the Ram and fees being placed on the Ram if I left it on Copart ****'s property. Copart Manager ******* again agreed, but stated there was nothing she could do. If I refused to pick up the truck,the fees would accumulate to more than the truck was worth within a few months. Thereof, under duress, I allowed Copart **** to load the Ram with their forklift (because it would NOT Run nor Drive for loading) and left the property.
FACTS OUTSIDE OF COPART INC.
16:Once home, I installed a new diesel fuel housing and new wires. The motor was blown/ locked up. However, when I contacted Copart **** and explained, demanding a full refund, I was laughed at. The supervisor stated that the Ram is now mine, that I left with the truck, and the Ram was sold under an As Is warranty. I attempted to explained to the supervisor that prior to buying the Ram and posted on their website, it was represented as a Run and Drive. That forcing me to take the Ram under an altered warranty, As Is warranty, does not cancel the Run and Drive written guaranteed warranty, nor remove them from being liable for fraud and misrepresentation of the Ram prior to buying. The arrogant supervisor stated many before me have tried to file suit against Copart ****, that it is a billion dollar company, global and Copart **** has expensive lawyers on speed dial to assure that individuals like myself never present my case to a jury.
17:Before performing any additional cosmetic or mechanical work to the Ram, I researched and found the following: posted on Copart ****Once a claim is filed, you must obtain written consent of the Copart Select Claims Team at ************** or ***************************************** before altering, repairing, selling, or transferring the vehicle.
18:I contacted Copart ****'s Select Claims Team at ****************** about my situation. I was informed by the individual that someone would call me back and my case would be reviewed. I waited, no call back. I called them again and informed them that I needed an answer,the Ram must be returned, a full refund provided, or I will fix the Ram and file suit for damages. Again, I was informed that I would be called back and a decision would be made. I waited a week, called back again, only to get the same response: *******. Accordingly I accepted Copart ****'s silence as a denial and moved forward to have the Ram repaired. One cannot arbitrate if the other party refuses to communicate.

19:I installed a new diesel fuel housing and new fuel wires for the fuel system. Once I learned the Ram's engine, a 6.7 diesel was blown (meaning that the engine was not operational), the Ram was taken to a diesel shop. After a professional inspection, the diesel shop confirmed that the motor must be replaced. Thereof, , I had the motor replaced and other parts that the shop made mandatory if I wanted a warranty with the new engine. The cost of the 6.7 Cummins engine was just at $22,000.00.
20:Once the engine was installed, I further learned the Aisen Transmission was locked up. It could not be moved forward under its own power, as guaranteed by the Run and Drive written warranty by Copart ****, even if the engine ran. Therefor, a new transmission was installed.

LEGAL ARGUMENT
1:Copart **** knowingly posted Run and Drive on their virtual website auction about the Ram to myself, as other bidders, to view prior to placing bids, buying, and determining the amount to pay.
2:The Ram had a description, and a Run and Drive written guaranteed warranty by Copart ****: Under Copart ****'s Rules and warranty Run and Drive provides the definition of Run & Drive means that the auction marked in its inventory that when the vehicle arrived at the auction yard, and the vehicle:Started under its own operation.Shifted into gear.Moved forward under its own power.
3:The statement by Copart ****, stating the Ram did Run and Drivewhen tested by Copart **** is knowingly misleading and false. It is absolutely impossible for the Ram to start with the diesel fuel housing and fuel line broken, with diesel running out on the ground when turning on the ignition switch. Thereof, not a drop of diesel fuel could have possibly gotten to the engine for it to start.Moreover, because the engine was blown and/or locked up and the batteries were fried prior to entering Copart ****
4:After a minimal investigation, I learned by the prior owner of the Ram, that the engine did not operate when turned over to the insurance company. It was not possible for the Ram to Run and Drive as stated by Copart ****
5:Further investigation of Copart ****, I learned that Copart **** has a pattern of fraud and misrepresenting their vehicle for sale. That Copart **** is masterful at deception and using the statement As Is to conceal their misrepresentation and fraud after a sale. In other words, I buy the Ram under a written guarantee of a Run and Drive, but Copart **** will not allow possession of the Ram,although paid in full, until I sign additional papers including As Is no warranty. Legally, once all fees were paid to Copart ****,they had no legal right to deny possession of the Ram, nor to force me to sign additional papers after the sale and after full payment.In addition, only taking pictures that were misleading and knowingly misinforming all buyers about their items for sale. Their illegal method of selling vehicles as a Run and Drive with the full knowledge that the item did not operate at all. For example: Some complaints with the *************************s, stated once arriving at Copart ****, their were no engines inside the items they had purchased under the written and guaranteed representation of Run and Drive by Copart **** Again, Copart **** would refuse to buy back the item. Further stating the item was sold under an As Isno warranty and it did Run and Drive when tested by Copart ****'s staff. Again, the sale was first sold under the written guaranteed warranty that their item would Run and Drive. It is impossible for a vehicle to Run and Drive with no engine. Each time Copart **** would ignore their posted warranty and statements on their advertisements prior to buying the vehicle as a Run and Drive. Thereafter, use their powers, connections with their local courts, and monies to threaten the buyers about their knowingly false and misleading information to the public. Copart **** is operating outside the realm of statutory law as written, running scams on the public, grossly and knowingly committing fraud, and misinforming the public by their own written guarantee posted by Copart **** on their website for the public and all buyers to view prior to bidding.Moreover, knowingly that all bidders/buyers would raise their bid to an amount more than they would have if the written guarantee of Run and Drive was not applied to the vehicle prior to bidding.
6:Copart ****'s reason is simple, GREED! They will make more money if they misinform their buyers and do not honor their Run and Drivewritten guarantee. Copart **** has never been held accountable. It will be argued by Copart **** that a potential buyer can inspect the vehicle prior to bidding. This was correct in some cases, but most of the time Copart **** will not allow anyone on their property to inspect prior to bidding. However the defense is moot. I am not complaining about the broken side glass, broken front windshield, bad tires, broken head lights, grill, bumper, etc... mostly hidden in their pictures. The legal argument is simple. Copart **** posts their own written website auction forum to the public with a written guaranteed warranty and statement that the Ram for me to view prior to bidding [d]id Run and Drive. Therefore, I placed a bid on the Ram and was the winner (highest bidder). I will prove to a jury,there is no way in h*** the Ram could have possibly been a Run and Drive vehicle, because the diesel fuel housing and fuel wires were broken, and not one spoonful of fuel could have possibly gotten to the engine for starting or inspecting the Ram's Run and Drivewritten guarantee as the batteries were fried also. In other words, I trusted Copart ****'s own written statement to be true and correct.The Ram would Run and Drive. It did not. Copart **** is liable.
7:I presume Copart ****'s response will be delivered with the same arrogant attitude as before, depending on Copart ****'s money and connections with corrupt local state courts wink wink, nod nodto save them. Therefore, to even the odds of dealing with the corrupt local courts, I will file my complaint in ************, ******* Federal Court. The buyer location for Copart **** was in ************, *******. The headquarters for Copart **** is in Dallas,*****. The buyer is located in ************, *******. Therefore, I will file in Federal Court. I will claim diversity. In addition, the amount will exceed $75,000.00.

This is my response to Copart's letter in regards to my letter to the Better Business Bureau (BBB) :
Notice that Copart does not deny my allegations against them. Copart is a very dishonest business. They have gained power, millions of dollars,and have grown into a giant corporation by deceiving the public. It is well known that Copart depends on the local courts to keep complaints from making it to any jury. Many of us that have been scammed by Copart are well aware that local courts are controlled by big corporations. However, I will be exposing Copart and seeking justice in Federal Court, jurisdiction sought by diversity in order to have a better chance at eliminating favoritism provided for Copart. Federal Courts have a better reputation at protecting the public against large corporations as Copart.
The synopsis of my complaint is very simple. Copart sells automobiles to the public as other companies. They sell mostly salvage vehicles.However, they too sell fleet items from large companies that have a clear title. On both salvage and clean titles, Copart has a description of these vehicles. Prior to the public bidding, Copart advertises the label Run and Drive which is a written guaranteed warranty by Copart on many of their vehicles as they did for ***************************** 2014 Ram. The reason is simple. To entice the customer into paying more.
Under Copart ****'s Rules and warranty 'Run and Drive' provides the definition of 'Run & Drive' meaning that the auction marked in its inventory that when the vehicle arrived at the auction yard, and the vehicle:Started under its own operation.Shifted into gear.Moved forward under its own power.
However,when the public arrives for pickup of their item from Copart, they are told that they are not allowed access to their item for inspection, until paid in full, and must sign a new document stating as is meaning no warranty. In many cases, as with ***************************** 2014 Ram, the vehicle did not run and drive when arriving at Copart, and Copart knew this. History shows through previous investigations/complaints that some vehicles, represented as Run and Drive by Copart, did not have a motor inside when picked up by a customer. Therefore the customer was scammed. ********************** forced these customers to take the vehicle as is without warranty or leave it there and lose the monies paid to fast amounting storage fees. Ask yourselves, how do these vehicles Run and Drive without an engine? Also, Copart will purposely take the advertising pictures of items for sale that does not properly disclose the true damages of the vehicles. In other words, Copart is a large criminal enterprise and a lucrative scheme that has been protected by their powerful attorneys and corrupt courts allowing them to prey on the layperson and public without any legitimate oversight.
Let's break down Copart's legal argument as defense by layperson language. Copart cannot deny my claim, because I have far too much proof.Therefore, Copart attempts to hide behind a legal argument, stating that I did not buy the item in question directly from Copart. Copart claims that only a broker shows as the buyer, *******************.Copart's denial is not a legal defense. It is nothing more than a ploy to deceive the layperson. Copart is legally liable. When a contracted party (here a broker) drafts a legal contract involving three individuals, as here: *************************, Copart, and *******************. knowingly that all parties may participate within the rights drafted within the contract, specifically that ************************* may personally bid on any vehicle that he chooses posted within Copart's website by the powers granted to him within this contract,is a 3rd party contract and legally binding to all parties. Moreover, any party has a legal right to file suit against any other party that they deem has breached conditions within their third-party contract.It must be further noted that ************************* was the individual online logged into the website owned by Copart and was provided by Copart, a listing of the legal description that the 2014 Ram did Run and Drive. Also, *************************, not *******************., placed the actual live bids and all parties were aware. Moreover, ************************* was not only the only person bidding, but the highest bidder on the 2014 Ram, and all parties, Copart, *************************, and ******************. were aware of this procedure. Third-party contracts are a normal procedure for Copart. Copart actually lists these brokers within their website in order to gain access to more customers. Copart's legal defense is not supportive by state nor federal statutory law.It is nothing more than wishful thinking.
Under ******* law, a third-party contract is a type of contract in which an agreement between two parties has some benefit to a third party.This third party can be a person or organization not directly involved in the contract.
Here,by writing this complaint to the BBB, my only concern is to alert the public of how Copart is deceiving the public. If I can stop one individual from being scammed by Copart, it is worth it. I will present my evidence in Federal Court and will seek my justice there.

In response to the claim asserted by *********************** about his request to refund his Copart Membership fee, one of the prerequisites to bid on prospective vehicles is establishing a member account with **********************. To become a Copart member, an individual must pay the non-refundable membership fee and agree to Coparts binding Member Terms and Conditions. ****************** member account indicates that ***** has consented to the current Terms and conditions and has been a member since 12/24/2020. These Member Terms and Conditions state:
IV. MEMBERS
A. Member Eligibility. You *** sign up as a Member at Copart if you are at least 18 years of age. In addition,state-specific registration requirements and applicable laws, regulations, and restrictions *** further limit Member sign up and vehicle purchasing eligibility. Copart reserves the right to deny member privileges to, or exclude from Copart facilities, any individual or entity, in its sole and absolute discretion.
B. Member Types.
Registered Guests must register and provide first and last name, email address and phone number. Registered Guests have the option to submit a physical address and copies of current government issued photo identification as well as licenses and completed sales tax exemption certificates, if applicable, in preparation of becoming a Basic or Premier Member. In order to bid on a vehicle, you must be a Basic or Premier Member in good standing:
Basic Members must register and provide copies of current government issued photo identification as well as licenses and completed sales tax exemption certificates, if applicable. In addition, Basic Members, must pay the initial Basic Member registration fee. A security deposit *** also be required in certain cases in order for the Basic Member to submit a bid (see Section V.H. below).
Premier Members must register and provide copies of current government issued photo identification as well as licenses and completed sales tax exemption certificates, if applicable. In addition, Premier Members must pay the initial Premier Member registration fee and security deposit.
All Basic and Premier Members who purchase vehicles for resale must provide copies of current licenses and completed sales tax exemption certificates. Basic and Premier Memberships must be renewed annually by paying an annual nonrefundable Member renewal fee and submitting copies of all current licenses (if applicable), and any information regarding change of ownership or address. Copart reserves the right to increase or decrease registration and renewal fees at any time without prior notice to Members.
By agreeing to these Member Terms and Conditions, *********************** acknowledged that he understood that he was signing up for yearlong membership. **************** states he was unable to bid a vehicle he was interested in; however his membership is active and he is eligible to bid on other vehicles if he chooses. On June 2 we bought on auction a car fro ************ location lot ******** was Friday on June 5 we sent an wire transfer with exact amount we owed for that car wire transfer same day service shortly after we sent that wire got an email confirmation that transfer was successful sent. Little later we got confirmation that transfer is complete we checked same day on copart acc for an payment update and nothing car was showing not payed. Next day I called copart to figure out if money was received they token that not and to wait 1 day sometimes wire transfer take Longer that usually to get to copart acc same day I called **** of America which is my bank and told them what problems I have with wire transfer they confirmed that the money are at ***** Fargo which is copart bank next day I called again the copart to check with the wire status and nothing come in I called my bank again. They opened a trace to track that wire transfer and waiting on ***** Fargo to get back with an answer where the hold is it and I was going back and fourth with both sides copart and my bank my bank was confirming the money are at copart bank after 7 days I sent an email to ************ location explaining that the payment was sent and I am waiting on banks to come with an answer and to put my car on hold till we figure out something I didnt get an answer from management on day 9 they took the car from us and put it on auction again and charging us 1070$ for relist fee we played that car at auction again we won it and we payed 1100$ more taht first auction day 2 after we won the car again money we sent on 5 June appeared on acc as unapplied amount we contacted copart accounting and told them what is happened and that we have to pay more for same car and pay a relist fee they told me that relist Fe can be waived but need to talk with branch manager but the higher amount on car need to be payed as we agreed with new price I called manager from that location she is giving only 100$ creditBusiness Response

Unfortunately, the funds being held was outside of Coparts control. The management team at the Copart purchasing location has agreed to extend a one time courtesy credit towards the relist fee applied to the referenced lot. We appreciate your patience while resolving this result of unforeseen occurrence.
