I am a sole proprietorship that was erroneously billed the sum of $1235 for 3 restocking fees. I was told by another auction IAA, upon their investigation that my account was hacked. I would expect this dealership to have looked further into this matter. It is unconscionable to hold my dealership and myself responsible for what I did not purchase. This borders not only on bring unfair ethically, but it shows how you treat a customer unfairly that has patronized your dealership for years. It is unfair to be left on hold, told to send emails to various parties, even the General Manager, who do not acknowledge my email, and work for resolve amicably with said party. In response to the claim asserted by *************************** regarding relist fees and vehicles that were purchased at Coparts auction. One of the prerequisites to establishing a member account with ********************** is agreement to Coparts binding Member Terms and Conditions. ********************* member notes indicate that ************************* consented to the Terms and conditions on 3/11/2009, 3/27/2009, 5/02/2009, 8/12/2009 and again on 9/04/2012. These Member Terms and Conditions state:
H. Bids Entered.Once a bid has been submitted, it cannot be retracted, deleted, or cancelled.
E. Account Activity.Members are responsible for all account activity, including, without limitation, all Preliminary Bids and Virtual Bids submitted under the Members username and password through Coparts websites or through terminals located in kiosks at Copart facilities. A Members account *** not be transferred or assigned to any other person or entity. The Member shall promptly notify Copart in writing in the event the Members account, membership I.D., or username and password are used without authorization. The Member shall be responsible for all account activity and charges incurred prior to Coparts receipt of written notice from the Member of the unauthorized activity.
D. Relist Fees.In the event a vehicle is not paid for within the time specified by the Copart facility where the vehicle was sold, Member agrees that Copart ***, in its sole and absolute discretion, cancel the sale or relist the vehicle for sale, and the Member shall be responsible to pay a relist fee plus any collection costs,including court costs and reasonable attorneys fees. Relist fees *** vary by facility. The Member agrees to verify relist fees prior to bidding on vehicles.
By agreeing to these Member Terms and Conditions, *************************** acknowledges that he understood the referenced risks.Copart asks that the BBB closed this case as everything was presented to *************************** prior to becoming a member. I greatly appreciate you taking the time to assist me as a representative of the BBB to be a buttress in me getting resolve fir my dealership
This matter is not resolved as of late. I was offered to pay $700 plus dollars to bring the account current. However, Mr. ************************** who is the current manager was not on staff when the incidents occurred. It is not true that I was asked to verify relisting fees being billed to my account. Furthermore, immediately when the incident occurred and my account was compromised I called your office immediately and came to the ********** location and spoke with the office representative at that time. The representative never offered to issue me a new member ID. I made them aware of the incident at IAA. This was disclosed to Copart immediately. I was bluntly told that it was my responsibility. If Copart has the ability to pull recorded conversations from this time period it would be warranted. This is a travesty of having to be prove my innocence over what steps I took to remedy this situation.
It is as if small minority business owners get the brunt of receiving a lack of regard when it comes to resolution. It is difficult to pay $758 as a small business owner for a debt I did not manifest. Notwithstanding, ****************************** never once returned any of my several phone calls since April 13th. I emailed him several times as well. Not until I reached out via email to the Regional Manager, ************************** did I get an offer of paying $758. If this fee is paid, how will the company going forward put appropriate measures in place so other patrons, mist especially small business owners,will not encounter an experience such as this anymore? How will Copart going forward make all patrons feel valued, even if they are a small business owner i.e.
having phone calls returned, having emails responded to in an appropriate time frame , not weeks later, holding staff accountable fir having the same protocol for all customers.
I really would like resolve with Copart. I would appreciate a designated date and time for ************************* or ***************************** to call me.

Copart is trying to salvage our vehicle our insurance company sent it there we requested a second opinion now we can't get copart to take it to the body shop we requested first they said we had to make a decision and we told them we wanted to keep the vehicle now they are saying it will be by the end of this week there is no reason for them to keep itBusiness Response

My name is *********************************** with **************** in *******, **. I purchased LOT # ******** from the ******, ** location on Tuesday, April 4th, 2023. I won the bid from an online auction at the price of $575.00 for the vehicle plus all fees and shipping costs from there to my business in Newport. I received the vehicle on April 12th, 2023, from a courier of ***************, whom delivers for Copart in long haul situations. The driver had me sign his tablet to accept the condition of the vehicle, and then left. Two weeks later, I still have not recieved ownership documents of this vehicle, VIN *****************. I have contacted Copart ****** Services, who always transfers me to the yard in ******. The General Manager, *******, explained to me that the driver recieved the title to the vehicle at the time of pickup. I contacted ***************, whom told me that they do not carry titles for vehicles with them due to the security concerns of doing so. I contacted Copart Back, who transferred me back to the yard in ******, who then transferred me back to ***************. I contacted copart back again, to again get transferred back to the yard, and back to *******. She told me this time that the car was a peddle vehicle, and that if the title was lost, a duplicate could not be obtained. I contacted my local county clerks office, who told me that without title, the vehicle cannot be done anything with. I now have a lawn ornament that I cannot do anything with, because copart and *************** have lost the title to my vehicle, which I was promised a title for. I wish to either obtain a title for this vehicle, or get a full refund including my towing fees, and take the vehicle back.Business Response

On 03/21/2023 I bought a 2011 ****** Reefer trailer lot# ******** vin# ***************** from ******************************************************* They stated that the primary damage was rear end but when I went to pick it up I noticed that the trailer was twisted and I could see that it definitely has been a roll over with extensive frame damage. Had they listed it in the description that it was a roll over I NEVER would have placed a bid on it let alone ********, and they only took pictures of the inside of the doors that hardly shows any of the damage because its all on the outside of the doors. How can they not take better pictures of the actual damage. So very disappointed in the buy.Business Response

Copart and its vehicle sellers expressly disclaim the accuracy or completeness of any and all information provided to Members regarding vehicles, whether provided in written, verbal, or digital image form (Vehicle Information). Vehicle Information provided by Copart and its vehicle sellers is for convenience only.Members shall not rely on Vehicle Information in deciding whether or how much to bid on a vehicle offered for sale through Copart. Vehicle Information includes but is not limited to: year, make, model, condition, ACV, damage amount, damage type, drivability, accessories, equipment, mileage, odometer disclosures, vehicle identification number (e.g. VIN, HIN, and serial number), title, repair cost, repair history, title history, and total loss history Vehicle parts may be missing. Copart does not guarantee that vehicles meet or can be modified to meet local emission and/or safety requirements. It is the sole responsibility of the Member to ascertain, confirm, research,inspect, and/or investigate vehicles and any and all Vehicle Information prior to bidding on vehicles.
Once a vehicle is removed from Coparts premises it is accepted AS-IS, and under no circumstances will Copart be liable for subsequent claims of damage or loss of any kind or nature whatsoever.
*************************** came out to inspect the vehicle before bidding he would have been fully aware of any issues associated with it. The webpage advertisement even provides a list of Inspector Services,who for a fee will come out and inspect the vehicle and provide an in-depth report after the inspection. All these tools were available for ******************************* to utilize, but he failed to use any of them. ******************** picked up this vehicle on 3/30/2023,knowing that it would be labeled an As-Is and not returnable once it left the Copart facility. In 2021, I sold a vehicle to Copart under Cash4Cars in the ******, ** region. After the vehicle was sold, I was charged six times by ********************, as they had parked the car illegally. After appealing to the courts for almost two years, I was still charged a fine and the credit score of the original registrant was impacted. These practices should not be tolerated, as I am sure I'm not the only customer this has happened to.Business Response

In response to the claim asserted by *********************** about his request to refund her Copart Membership fee,one of the prerequisites to bid on prospective vehicles is establishing a member account with **********************. To become a Copart member, an individual must pay the non-refundable membership fee and agree to Coparts binding Member Terms and Conditions. ***************** member notes indicate that *********************** consented to the Terms and conditions on 3/22/2023. These Member Terms and Conditions state:
IV. MEMBERS
A. Member Eligibility. You *** sign up as a Member at Copart if you are at least 18 years of age. In addition,state-specific registration requirements and applicable laws, regulations, and restrictions *** further limit Member sign up and vehicle purchasing eligibility. Copart reserves the right to deny member privileges to, or exclude from Copart facilities, any individual or entity, in its sole and absolute discretion.
B. Member Types.
Registered Guests must register and provide first and last name, email address and phone number. Registered Guests have the option to submit a physical address and copies of current government issued photo identification as well as licenses and completed sales tax exemption certificates, if applicable, in preparation of becoming a Basic or Premier Member. Registered Guests *** search inventory, add vehicles to a Watchlist and create Vehicle Alerts, but Registered Guests *** not bid on or purchase vehicles unless their membership type is upgraded to either a Basic or Premier Membership.
In order to bid on a vehicle, you must be a Basic or Premier Member in good standing:
Basic Members must register and provide copies of current government issued photo identification as well as licenses and completed sales tax exemption certificates, if applicable. In addition, Basic Members, must pay the initial Basic Member registration fee. A security deposit *** also be required in certain cases in order for the Basic Member to submit a bid (see Section V.H. below).
Premier Members must register and provide copies of current government issued photo identification as well as licenses and completed sales tax exemption certificates, if applicable. In addition, Premier Members must pay the initial Premier Member registration fee and security deposit.
All Basic and Premier Members who purchase vehicles for resale must provide copies of current licenses and completed sales tax exemption certificates. Basic and Premier Memberships must be renewed annually by paying an annual nonrefundable Member renewal fee and submitting copies of all current licenses (if applicable), and any information regarding change of ownership or address. Copart reserves the right to increase or decrease registration and renewal fees at any time without prior notice to Members.
By agreeing to these Member Terms and Conditions, *********************** acknowledged that he understood that she was signing up for yearlong membership. ****************** states he was unable to bid on a vehicle he was interested in; however his membership is active and he is eligible to bid on other vehicles if he chooses. i bought a 2016 impala from copart paid everything in full look over all that they posted .. when time to get the car it was missing the whole catalytic system including the mufflers .. I called them also about why they charge me for storage when I bought the car at night when they was closed and the and delivery it up when they open. the worst part was they put me on hold and never came back .. then I found out they knew about it ..I told them why did you not put that online telling people who may want it that the whole system is gone and let that be them who wanted .. I also found out that at this location theft is high .. no one called me back and all I want is my whole system back or they pay the company I will go .. who have time to saw off a catalytic system .unless it was a worker or some whoever they know.. I want store credit or the pay half of the bill or ******...... in these photos on one side no muffler and the other side is one but it had to have cut it off because it is not on in the pictures ...number 5 picture is the driver lifting it up at the yard it is not there .. which means they know .. the whole system is gone how some one will cut it out from the top and the bottom unless they had a way to get in the car ..I have the left side , right side ,and the hood where it was cut out...Business Response

Additionally, all member fees are outlined in the Member Terms &Conditions which you signed upon becoming a member. You have the availability to see the fees listed in detail by logging into your Copart member account, Clicking on the My Account tab, then at the bottom of the menu you will see a Member Fees section. there is a fraudulent misrepresentation that's being run by copart - ***********. i recently won this auction at copart los angeles Lot # ******** on 11/14/2022 and completed the purchased thru a.better.bid. Its for a 2015 s550 being represented as it runs. which means that car can be turned on. can idle. - this 2015 s550 does not run - does not idle - this 2015 s550 is beyond repairable condition - this 2015 s550 was bundled from different auto parts just enough to make it to the auction and make it look as complete to resell for a fraudulent profit . as an example: front end is from a 2008 w204 ******** benz, radiator is from a 2008 w204 ******** benz, frame was realigned and just connected with one screw, engine oil retainer was glued, hoses are all cut, electric wires all damaged, both front headlight are burnt and broken, glued and many other things to list, this car has sustained an enormous accident with a severe damage that put it beyond repairable condition- its 100% totalled.this is fraudulent misrepresentation being run by copart with another dealer doing illegal assembly of cars from different car parts just enough to make it look legit to the public and selling it at that auction with copart assistance for a fraudulent profit.Business Response

better.bid was my broker in that transaction .
whats important is that vehicle is a copart - *********** lot and was fraudulent misrepresented to scam the public .

In response to the claim asserted by ************************************* that was purchased at Coparts auction was misrepresent as ***************. One of the prerequisites to establishing a member account with ********************** is agreement to Coparts binding Member Terms and ********************************************* account indicates that she consented to the current Terms and Conditions. The definition of Run and Drive when you see it on the website advertisement states:
At the time the vehicle arrived at Coparts location, Copart verified that the vehicle started, (ii)could be put into gear, and (iii) was capable of moving forward under its own power. There is no guarantee, representation, or warranty that the vehicle is in roadworthy condition or can be driven lawfully upon the highways of any state. There is no guarantee, representation, or warranty that the vehicle will start, (ii) drive, or (iii) move forward under its own power at the time the vehicle is picked up at Coparts location. It is the Members sole responsibility to ascertain, confirm, research, inspect, and/or investigate the vehicle prior to bidding on it. Once the vehicle is removed from Coparts premises, the Member accepts the vehicle as is
The R&D label does not guarantee that any vehicle is safe to drive without first undergoing repairs, nor does it guarantee that any vehicle will ever be roadworthy again. The R&D simply states that, at the time the vehicle was brought to a Copart yard to be prepared for auction, it could be started and moved forward a minimal distance under its own power. No guarantee is made as to the operability of an R&D vehicle at the time it is retrieved.
Our T&Cs point out that the information we provide is for convenience only, and that burden is placed upon the member to gather information on the vehicle prior to bidding on it. This information can be found at section I.A of our T&Cs and reads:
Copart and its vehicle sellers expressly disclaim the accuracy or completeness of any and all information provided to Members regarding vehicles, whether provided in written, verbal, or digital image form (Vehicle Information). It is the sole responsibility of the Member to ascertain,confirm, research, inspect, and/or investigate vehicles and any and all Vehicle Information prior to bidding on vehicles.
Had ************************ came out to inspect the vehicle before bidding she would have been fully aware of any issues associated with it. The webpage advertisement even provides a list of Inspector Services,who for a fee will come out and inspect the vehicle and provide an in-depth report after the inspection. ************************ had this vehicle secured from our facility on 3/22/2023 knowing that it would be labeled an As-Is and not returnable/refundable. All these tools were available for ************************ to utilize, but she failed to use any of them. I paid 99.00 two years ago and joined so I could bid on cars then it would not let me bid so I ended it they just took another 99.00 on my credit card this morning that I did not authorize.Business Response

In reviewing your member account and notes on 3/15/2022 you selected to save your payment details to your member account as well as selected auto pay for renewal invoice. Due to this selection is why your payment method on file was charged for your annual renewals. Our records do not indicate that your have cancelled or closed your Copart membership. If you wish to close/cancel your Copart membership please email [email protected] with your account details; you may also request a refund for the renewal fees that were set up on auto renew in error.
