A young man came to my home and talked to me about pest control services. I was already seeking service, so when he offered me service for only $45 a month, I was interested. He told me to sign a form and that the contract would be sent to me to look over but it was never sent. *********** signed me up for two service plans, even though I expressed interest in ONLY around my house. They started charging me $45 twice a month, and when I called to ask them why they said they had two signatures on the form. I was also told since there are no bugs in the winter that my next service wouldnt be until July and that I would continue paying the monthly fees- I was not told this when I agreed to the service and they told me they couldnt prove what the salesman told me and Im in a contract they said I could pay the $500 to cancel. So basically- *********** is charging me $45 twice a month to service july- august. I have no idea how this is even legal and am very upset. They also said I only have a few days after the last service in June to call and cancel or they will automatically re-enroll me in this service that I dont want. I feel like I was scammed and signed into a contract that was misrepresented and everyone I talk to has an excuse to why I have no rights in this matter.Business Response

I am rejecting this response because: the contract was misrepresented by the person I signed it with. I do not want to do business with your company. This has been an issue for a LOT of other people and I am very taken aback by the lack of professionalism of this company. My indoor package was closed because I was not aware it was even opened. I agreed to my perimeter being sprayed and NEVER received the emailed copy. I was also told that what I signed was only to show interest and the real contract would be forwarded to me to review before I signed which NEVER happened. I was also told I would be charged $50 a month for the OUTDOOR package that I wanted and was charged more than once. Again, this contract was completely misrepresented and I feel very taken advantage of.

On 07/22/2022 a sales representative came to my home and offered me a discounted service. He pressured me by telling me both of my neighbors were enrolled (which was a lie). He told me it would be a 12-month contract paying $50 every 3 months making me believe I was only going to be charged per time that they came to provide service. Upon checking my bank statements, I have seen $50 charged to my account every month even though I was made to believe it was a one-time payment every three months. I attempted to cancel via online only to discover there is a $200 cancellation fee even though this was never disclosed to me by the sales rep. I have been deceived and was made believe something which was not true. I just want to cancel it without any cancellation fee. Thanks.Business Response

The **** representative came to my property in *******. Spoke with my gardener & literally acted like his life was on the line if he didnt sign his 200th person for the month. Apparently my house was his 200th victim. Anyway my innocent gardener provided him the property owners information as he asked which is Me. Then he proceeded to send me a contract to my email. I opened the email but noticed its a contract. I told my gardener I dont want a contract and to tell them I dont need the service. Keep in mind, I only live on the property half of the year. So my gardener told them no one would be home not to come. On 9/19 as I reviewed my camera, some guy came and dropped a flyer in front of the door, no big deal. My gardener saw it the next day and told me. Nothing was done to my yard or anything. Now it is 9/20, this company started calling me that my bill was past due. I asked what ****. Oh the guy proceeded to tell me **** provided services and is owed money. I told him I dont want their ************************ didnt receive any service. I never agreed for this service and I dont want it. Then he told me once I opened the email that was sent to me I entered their contract. I was transferred to a supervisor who canceled this service. But now Im being harassed daily 2-3 times per day to pay a $200 cancellation fee on service that I never signed up for. How is this legal? Make it stop.Business Response

I have a Bi-Monthly service agreement with Hawx Smart Pest Control that started on April 16,2021 for $89.99. Every time they came to service my house, they billed and I paid. At the start of this current inflation, they billed me $54.99 that came out of nowhere. When I called the company, customer service told me they start billing everyone $54.99/month just to fight the inflation. I did not want to pay that amount because it was not justified. I am a victim of the inflation as well. They kept sending emails about this bill, but finally I got on the phone with customer service that told me a different story. She said the company has changed the structure of the billing. She said I was going to pay $54.99 per month but I can request service at anytime with no more charge. On September 15, 2022 I paid $ 54.99 plus a service fee of $0.82, which amount to a total of $55.81. On September 21, 2022 they have services my house, and today (September 29,2022), they sent me a bill of $89.99 for the service, which was what I was paying every other month, Now I have to pay $54.99 and then $89.99 whenever they spray my yard. It is a rip off. Not only am I not going to pay that amount, I also want them to cut my service without sending my name to collection. This company is a scam and they need to stop treating customers like that.Business Response

On June 17 they came to my door to see if I needed ******** control, They offered me a one time spraying for $40 and had me sign a I- pad I couldnt see because of the sun and told me if I had anymore bugs just let them know. Turns out I signed a one year contract that they never informed me about! And now they say I owe them $450 to get out of it!!!! The Salesman that came to my door totally miss represented the company by not informing me that I was signing up for a one year contract and he knew we could not read the screen, which is a total scam and I dont think is Legal.Business Response

Hawx Pest Control engages in predatory sales practices and does not provide or explain disclosures they make you sign to receive service. They charged me for a month of service that I did not receive. Then when I went to schedule service for a subsequent month, they charged me late fees for 2 months of service that I previously paid. I am now moving, and they state that in order to not be charged tomorrow for the next month, I must provide proof of my new address via a utility bill or a lease. I explained that I am selling my house and purchasing a new house, so these types of verifications take much longer than one day. I requested to speak with a supervisor and was hung up on. I expect them to provide service for the month I was charged and no one provided service and remove any erroneous late fees from my account.Business Response

A door-to-door representative from Hawx Pest Control knocked at my door in the afternoon of July 27 2022 offering outside pest control (mosquitoes etc). The price was too high, in addition I did not want the full treatment he was offering spraying the lawn (we do not want bees tp be harmed) and that if anything we could just spray the walls of the house; the gentleman then said he could do that and reduced the price to $40 per treatment every 3 months, cancellable any time. I accepted and signed for this service on his phone. As requested by him, I gave a $40 check (#*** on my *************** account), and the service was performed one hour later. Also, the same day, I received on my email ***************** an email from Hawx entitled ' We're planting a tree in your honor" ; nothing else.Today September 29 2022 just before 1PM EST I have received a call from Hawx to tell me that I owed $121. I said this was not correct and had already paid the $40 for this quarter, although I have noticed lately that the check #*** had still not been deposited. The lady at Hawx said that the charge was $40 every month despite the service been performed quarterly which I disagreed with. I said that I was cancelling and would take take of the $40, to which she replied there is a cancellation fee in excess of $200 as per contract - a contract that I have never received. I said that I would not pay that and she replied that it was up to me, and she hung up.I immediately called back Hawx to clarify the situation, the first person that attended my call told me that an agreement had been mailed to me on July 27 2022 with the conditions including cancelation, and that my account had just been closed adding to the $121 the cancelation fee (not sure what is the total, over $400 then instead of the $40 treatment sold to me). Although I stressed that I never received this agreement, she said there was nothing she could do. I asked to escalate this to her boss. He denied everything.Business Response

Account Number: ****** June 2022, a Hawx rep showed up at my door to offer me services. I've informed him that I am only interested in resolving a ********* Bee situation outside and possibly mosquitos, all outdoor. He insisted that he can take care of that problem and offer indoor services too. The rep also stated that I can cancel anytime and I will only be charged once services are rendered and that is for each charge to my card per month. My card information and payment was provided on a tablet (as well as me signing up for service) and services were rendered in a few days. An email was sent to my email address and ended up in my junk mail folder and I've never had a chance to review anything, especially because of my busy work schedule. Since then, that email has automatically been deleted from junk mail folder and now they have sent me this agreement to review and basically say, HERE'S the FINE PRINT that you have agreed to, so YOU OWE US THIS MONEY AND EARLY TERMINATION FEE.After the first treatment, I've received another charge about 3 weeks later, (charge was less than 30 days after the first initial treatment and appointments were two weeks away from after being charged). I was unaware of the deceptive practices to get me as a client and then charge whenever convenient.I've decided to cancel the service after 3 months of paying $99 and am now being told that I'm under two separate contracts that have an early termination fee in the upwards amount of $407.99 combined. $209 for Outdoor Package and $198.99 for Indoor Pest Control. I've never needed indoor Pest control, nor have I ever used it. This is a bait and switch scam where I am being forced to pay for services that I didn't receive and Hawx is making sure that they make money off of deceptive practices. I'm willing to let bygones be bygones and part ways for the work received and paid for. I'm not paying termination fees.Business Response

The sales person came by early in the summer, and was super friendly. Service seemed like a good deal for the price. I asked him multiple times about being able to cancel whenever without termination fees. Two days later, he comes back and says he messed up on the contract and couldn't offer the same level of service for that price. I signed a new contract, but I neglected to ask him about the cancellation policy. Figured it would be the same as the previous policy.Honestly wasn't thinking about cancelling until the second month, when we saw that the bugs weren't being exterminated. Thought, maybe we just had a lot of bugs. Called them, and they sent someone out. Fast forward to Sept, and the bugs are back. What's worse is that the company didn't even show up to perform their Sept spray.Called up to cancel and they said there were fees. On August, I sale person came to my door step from Hawx Pest Control to sell their services. She told me that there is a discount if I get the general service right now and the outdoor bundle will be included free of charge. The total payment was about $45. I agreed and gave my credit card details and was asked to sign on a tablet. I saw more services planned for upcoming months and asked about what are those. She said you can cancel them anytime, what she did not told me is that there is an over $200 cancellation fee. I am convinced that I am signing to agree paying for an initial service. I had no idea that I am signing for a 12 months contract. Next month, somebody came to our house to do the mosquito service. He confirmed that this is included when I asked him. Then, I am charged $60 for that service and another $44.99. I called them asking what are those charges. They said you agreed to pay $45 monthly for general service even though I get serviced every three months and also the outdoor bundle is included only for the first month, then I have to pay $60 every month and if I cancel, I have to pay cancellation fees. None of these were explained to me at the time of sale. I am deceived by the sale person who came to my door. She convinced me that this is a one time service and I am free to cancel upcoming services. There was no way for me to read all the details on a small tablet, so I chose to trust her. I've got my lesson now. I should never trust to people coming to my door to sale something. I am tricked into a long term agreement without knowing it. I do not want to get any further services from Hawx Pest Control and I am not willing to pay cancelation fees. I demand a refund for the extra charges that I was not aware I agreed to pay.Business Response

Per agreement that you signed, the General Pest Control is a quarterly service for at least 12 months, we have the customer pay monthly instead of having them pay a larger amount every 3 months to help make it easier. The Outdoor subscription Outdoor is seasonal, in your area we treat for 6 months, April through September. Outdoor is also monthly charge for a period of 12 months to help break it down into smaller payments as well. If you would still like to cancel with us, there will be a cancellation fee.

Your General Pest fee would be $199.01 and your Outdoor Package fee would be $249. You do have the option to call our Customer Solutions Department, where they can use their tools given to arrange a solution where one of your subscriptions has the opportunity to be closed without an Early Termination Fee, while your other subscription remains active. As you have received services for both subscriptions, we will not be refunding any of the charges made to your account.

I am rejecting this response because: The business refuse to accept that I am deceived to sign their contracts by their sales person. I simply can not accept to receive service from this company and definitely refuse to pay their ridiculously high cancellation fees for both contracts. I am not satisfied with their service, the way they do business and their approach to customers. I will escalate this case by filing a complaint to our local consumer protection office, Missouri Office of the Attorney General.
