On July 2nd, a Hawx rep came to my home to offer services, even though the front door clearly states "No Solicitors". I had just moved here and another company out that charged me $100 for a 1x/year service. I was unhappy with them, so I decided to go with Hawx. That being said, I was quoted a quarterly charge of $40, which I would pay each time they came out. Cost wise it was comparable, but with the added benefit of coming out 4 times a year. I was even shown the chart of months they would come and when I would pay. Come Aug, I received an email stating I have a balance of $40, which should not be the case until September when they come out again. So I called and was for the first time informed it was a monthly charge, not quarterly. I stated this was not disclosed to me prior & I could not afford a monthly charge of $40 as my wife just passed away right after we moved here in June. I am now struggling to pay our bills with the loss of her income. The rep then told me I could cancel, but it would be a $210 charge to do so. Another thing that was not disclosed to me prior. I was also threatened that they would send this to collections multiple times if I did not pay, despite my pleas to work something out with them to not affect my credit as I now need to move from my current rental for affordability due to my wife passing away.Since that rep said there was nothing he could do, unless I had a recording of the conversation the rep and I had (who records every convo they have), I said I will call another number for your company for help. When calling back, I then found out that first rep had charged the card on file (WITHOUT AUTHORIZATION) for the cancellation and Aug. fee for a total of $249.99. I was then transferred to Billing, who would not reverse the charge and said nothing they could do. This all occurred today, 8/29/22. I have since stopped the charge on my CC. Clear misrepresentation of services and shady business practices on top of charges.Business Response

On June 28, 2022, a sales rep from Hawx Pest Control knocked on our door to sell services. He said the price for a visit from a technician would be $45.99 and was asking us to commit to two service dates, the first immediately and the second in three months. We understood the price for these services would be $45.99 each. My wife and I specified that we did not want more than two services, and in fact we very succinctly repeated that. He acknowledged. He then gave us a contract to sign (which he did not disclose was radically different from our mutual verbal agreement). Upon receipt of our monthly Mastercard bill, we discovered we were being auto-billed monthly for an ENTIRE YEAR of services at $45.99 PER MONTH. We immediately called the company and complained that we were misled. The retention department agreed that we should be allowed to terminate the contract without paying a cancellation fee, but the accounts manager steadfastly refused to do this. We asked to speak with his boss. He said his boss doesn't take calls. We dispute a charge for service not yet received and have cancelled the Mastercard account number to prevent Hawx future automatic withdrawals from our card. (We have since seen on a consumer website numerous complaints against Hawx just like ours from around the country.)Business Response

This reflects your quarterly service schedule for 4 treatments as well as your monthly billing rate of $45.99. Quarterly billing is available to you if you prefer to be removed from monthly billing. If you would like to receive treatment monthly, warranty services are available to you at anytime in between your regularly scheduled services at no additional cost. We do ask that you contact us to schedule this as it is not an automatic scheduled service. You received a discounted initial rate based on the 12 month agreement. This amount is to be applied to the account when canceling prior to fulfilling services. At this time the account is active. Please let us know how you would like to proceed.

I am rejecting this response because:They do not acknowledge the substance of our complaint. The proceed: Dismiss the contract that we signed under false pretense, waiving the cancellation fee and any other penalties. We did not contact Hawx for service, they came to us via a young rep on a hover board at our door. We were kind to him and wanted to give him a break. The rep asked us to just give his company a chance by agreeing to TWO SERVICES. I, (******) said, Just so you understand that this is to be ONLY TWO SERVICES. THIS IS ALL WE WILL AGREE TO. I EVEN REITERATED THIS! I was sitting on the edge of my couch and he was standing 5 feet away facing me. My husband, ************************** and signed the paper the rep **************** The rep did not tell us that the paper was contrary to our mutual agreement. We did not learn this until our credit card statement indicated something quite different.a year??? ******** and I got on the speaker phone together. One person with **** agreed that the contract should be cancelled under the circumstances. She said we should talk to the door rep. She gave us his number. His box was full and would not accept calls. Then we were given a Manager who not only wouldnt resolve the matter of a contract under false pretense, he actually said I couldnt prove my story unless I had a ring camera. I was shocked. I asked to speak to his boss. He said his boss does not accept phone calls. Thru the help of BBB, Hawx has sent their email saying: Our records show this (contract) was received and viewed. Viewed? No, it was not viewed and the company email contract came after we signed for the representative in our house. Important to reiterate: The representative himself ASKED us to accept two services. The word representative means that this person represents the company. If that employee does not explain the company terms, there is deceit in the solicitation. The representative did NOT explain the terms of the contract. There are at least a dozen identical complaints about Hawx on consumer affairs.com, several calling them a scam. We have had one service from Hawx for $45.99. In addition, Master Card has paid an additional $45.99 billed. That takes care of the cost of two service agreed upon with ****** representative. We regard any further attempt to bill us as predatory. Termination of the Hawks contract without cancellation fees or other penalties is the only satisfactory resolution.Business Response

Sales rep came to our door selling pest control. We discussed the flies in the back yard. I suggested that the service may not work for us because we dont have any trees or shrubs to the product to stick to. The gentleman assured me that it would work and if not I could discontinue the service. He gave me the monthly rate and no discussion about an initial discount or cancelation fee. I called a few weeks after the initial service to cancel because there was no reduction of flies. The rep said to give it a bit more time that it had to build up. Again I stated that I thought the lack of trees and shrubs for the product to stick to was probably the issue. Again they come out and things dont get better. I then cancel with the rep who came out. He assured me he would get it taken care of. I tried to call to make sure the rep did in fact get it canceled and could not get in touch with anyone. and now 2 weeks later another service person comes by...and also says he will get it canceled. I immediately called and finally spoke to customer retention. I explain the situation and that Manager just kept repeating that I signed an agreement so I would be charged $160 cancelation even after I explained that his sales person misrepresented the service and the price.Business Response

I have expressed my dissatisfaction with Hawx due to there inability to eradicate the mosquitoes and ants in my backyard a number of times since starting services in May of this year (less than two months time frame). I called last week (7/14/22) to request cancellation and was told I can not cancel per the contract and a supervisor must come out to analyze the property prior to cancellations. I was told I would receive a call 24 to 48 hours to schedule a visit for them to come out. On(7/18/22) a pest control guy came out who was not a supervisor and stated he was sent out to exterminate spiders. I explained to him that I was supposed to have a visit from a supervisor. He said he would see if could get one to come out and went back to his truck. I called customer service and spoke to a woman and stated that a supervisor was supposed to come out to analyze my property and instead someone came out for service and that I need to speak to a supervisor regarding cancellations. She (was not a supervisor) stated that if I cancel that I will have to pay $400.00. I explained to her that it makes no sense to pay for a service that is not beneficial and my family is constantly being bitten every time we go outback and that I was not paying $400.00 and she proceed to get smart and said well we will take you to collections and so forth in a nasty tone and I hung up on her. I called back and spoke to a different woman (requesting to speak to a supervisor again) who had me on hold to review the notes. After she came back she said she was getting the number to transfer me to a supervisor. I was transferred to a 3rd lady who stated that I would not be able to speak to a supervisor because they don't have a number and that she would have to take notes and send them over for a supervisor to decide if they wanted to reach out to me. Then she informed me that the person who got smart whom I hung up on had terminated my account. No luck getting a sup. & I have a $556.09 cancelation bilBusiness Response

I agreed to hire this company for pest control in June 2022 for the summer. Their salesman quoted me a rate of $80 per service, and guaranteed free services in between if the pest problem wasnt resolved. After the first service, there was no difference in the pest problem. I called them to come back and was told no. They couldnt come back until next month. In July they came back and still the service was useless. I informed them it wasnt having any effect and terminated the account. They refunded me the $80 for July. I noticed a charge last week of $80 for the month of August. When I explained that the account had already been terminated their service associate told me that wasnt true and that they would not refund me for August, despite not actually performing the service, and also that there would be an early termination fee. I never agreed to a long term contract with an early termination fee. I told their salesman Id try them for a month and see if it worked. On Friday 7/31/22 between 5-7pm an individual from Hawx Pest Control came to my door. He said they provide a pest control service and can perform a treatment this weekend for $39. I agreed and wrote them a check. One of their employees came by that weekend earlier than expected and left before I came home and saw them.the service was for my home at ********************************************************************** On 8/29/22 at 5:25AM I received an email from Hawx showing 6 additional scheduled services going to January ****. I was invoiced for each of them for an additional $39 per service. Bait and *************** An employee who was very nice, named ******, was full of promises. He told us we were getting the full yard (1 acre) package. He told us they would spray our trees up to 8' and spread granules on the yard to prevent ticks, fleas, etc. At that price I figured it's cheaper to use them than for me to buy the material (which I normally do). They were supposed to come the next day at 11am, but were a few hours late. No big deals. But, then the guy who shows up just has a handheld pump action sprayer. Are you kidding me? I was totally duped. I called ****** (or at least the number he gave me) with no response. The guy with the ********** pump sprayer just asked where our "problem areas" were and only did a few spot areas. It was not full coverage in the yard, not even 1 percent of our yard, there was no spraying everywhere inside the house, just the door jams. Talk about disappointment. I explained to him what ****** told me and he looked at me like I was the idiot I was believing that they would actually spray all my trees up to 8'. I expected a truck with a drum of pesticides and a hose hookup to walk through my yard and around my house spraying away. Nope! Nothing like that. So, realizing I was duped I called their customer service and said that I will pay for this first "treatment", but that I don't want to see a Hawx Pest Control person again. I was told that there is a $200 cancellation fee and there's the big gotcha. Had they done what they were supposed to I would be writing an amazing review. I'm an honest person and my mistake was trusting their sales rep that showed up and told us what we wanted to hear. He was from Utah and we were from Utah so we figured you can trust someone who claims to have an upright and religious background.Business Response

I was misled into a contract with hawk pest control the sales man that came to my home pretty much pressured me into signing the contract to begin with I told him I wanted him to come back to speak with my husband the only reason why he convinced me into signing the contract was because I was only going to try them out for 6 months and to my surprised after the damaged was done I realized the contract said one year thats lie number one lie number two was that I would be getting charged two separate payments of $54 every two weeks and thats not true also im getting charged 114 every Month. I had an ant problem and decided to go with Hawx to try and get rid of them. First treatment they do talk a good game but don't believe the hype. Amongst the hype they also make you put in a review on ****** while they are standing in front of you basically telling you things to write. This is why there are so many 5 star reviews. At that point you have no clue if what they did is actually going to work or not. Well in my case it did not! In fact I had them come out 3 times and had no improvement whatsoever. I decided to cancel as I did not want to waste any more money on them. Well they charged me $200 to cancel! I don't feel like I should have pay that since you didn't provide the service you guaranteed. Plus should have been refunded my 2 months service of $40 each since thier service didn't work. However they would not budge and said they have to charge that. I literally was charged $200 within 2 minutes of getting off the phone with them. So $280 total wasted on a service that didn't work. Basically they try to box you in so you don't cancel. Very unethical business practices!Business Response

My complaint is very similar to the 40 some negative reviews that can be found here on the BBB site. In May a sales guy talked me into accepting a trial first treatment at promotional rate($79), and provided no paperwork. I paid using a debit card. After that they asked me to update my account with a credit card. Instead I sent a $39 check for the limited treatment we agreed to on the phone. Hawx cashed my check but never came back to perform the second treatment.In July and *********** continued to send emails billing me for an additional $39. Now in *********** still has not returned during the three months of summer. So I emailed them my cancellation notice. They don't respond to email complaints other than say call their office; and when you do they just say you have signed a contract and must continue to pay.Today, August 26, 2022, I received an email stating my balance due is now $78.59, and that a finance charge of 1.5% will be assessed if not paid within 30 days. As far as I can see, Hawx engages in shoddy, high pressure sales tactics. The business is aptly named as Hawx is a PEST.Business Response

I am rejecting this response because:
The details of your contract are in direct conflict with what was presented by your door to door sales person. Regardless, Hawx never performed the second service for which I paid. You say my contact is still active. I twice gave you notice to cancel and you never refunded my payment for the second treatment. At this point I have given up seeing that $39s. I will be satisfied never to hear from Hawx again.
