This company is trying to hold me under there company even though my contract has ended. I am a trucking company and Fleetsmarts was my factoring company, Since November 11th I’ve been trying to recieve paper work to release my company to my new factoring company and they are avoiding contact with me. This is hindering my business because I can’t get money for the loads I’ve ran because Fleetsmart won’t provide paperwork for me to go with my new company. I have called, left emails and messages. Hello,
When you signed the contract to factor with us and have a fuel credit line with no credit check you agreed to allow us to file a *** on your company.
Due to the nature of those two products we as a business are liable for loss and in order to hedge our risk we file a UCC-1, all other factoring businesses in the industry will do the same thing. It is not just a practice that we employ.
If you would like to go elsewhere with your business that is up to you, but we would need to complete a buyout of the loads that we have funded you and have not been paid by the broker.Customer Answer

I'm a truck driver and I used to run loads and process the payments. Through Fleetsmart.net.but sometimes they would withhold the payment for no reason. And make me late for deliveries. I had to to appeal to my ************* recover a money that they owe me. I have tried several times to obtain a letter of release from Fleetsmart, to no avail.this time I requested the General letter of release from Fleetsmart, through my dispatcher. And they say no. This Blue Water Capital / FLEETSMARTS company has not provided the services promised. I have repeatedly requested permission to terminate the *** lien filed on my company and requested to cancel services over the past ************************************************************************* any way. They are blocking my ability to get paid on future accounts receivable and I want it terminated to ensure that I can continue to do business and to be paid on the work that I do. Yes, I have a business. Which Fleetsmarts does Factoring and I use their fuel card. I just signed on not even a whole month. Theyre keeping my funds not dispersing them on time and I currently have $2500. Thats tied up with them because they put the wrong name On the transfer, not once but twice back to back this is a new business and were suffering from it. Call my case manager. No one answers the phone and when they do, no one seems to know anything about nothing. My bank sent the money back over a week ago and I still have none of my funds I think theyre committing fraud, and I would like to be let out of this contractBusiness Response

This complaint is being filed because this company is holding onto money that is owed to me and prior weeks when they were paying me, they were taking beyond the time limit that theyre supposed to pay me and giving me my money. They are bringing my company to the ground with these tactics. Im constantly on the phone with them daily complaining and they give me the runaround. Theyre hiding information and will not tell me why they will not give me my money and they are operating on ethically knowing that they owe me money and I dont owe them anything and theyre refusing to pay me my money in a timely manner that will not cripple my business. This is very true i got many calls from the agent to sign up and how they can beat the price i advise them no they offered the fuel card even if i didn't want to factor this was months ago i then found out they placed a *** without my consent when i called i was told that can leave at any time but because they offered me a fuel line i have to stay there but i reminded them that i never used or even got these so-called cards i then was given email to make the request the customer service team behind that email is rude and argumentative with you on why they won't release you I then got a call from ******* an account manager he advised me that he would send me a LOA and place me on a call for the manager review of the company i then emailed him the next day and his reply was he had to check with his manager so at this point is like Im stuck because they refuse to release me i know if has to be a form of harassment or something because you placed a *** on me without my consent its so many red flags about this company i was told by joy that i can leave at anytime i had no obligation i have the text messages and recorded calls from her and ******* stated i would get my release now know one has responded to me and have been forced to factor because no one can pay the loads because they are block and now broker wants to even work with them to fund the loads due to they have another company that i was first with funding me now they have created the worse problem i just want out from themBusiness Response

I am rejecting this response because: i have ask several times and have been told by ******* ***** that he would send over the *** due to i was already working with a company he stated that he would send the buyout to the company and release me but instead he stop responding and now Im being forced to use my money to fund there gas card after i stated i already have a fuel card and i didnt want my business credit ran they prefilled out the information told me if i didnt agree with using 25% of my money on there fuel business everytime that they will not release my funds how can you hold my funds and refuse to release because you want me to invest in your fuel if i dont want it i honestly feel that this company should be investigated for fraud these people place *** on people businesses without a sign contract after that they dont release you forcing you to have to use them for factoring because they dont respond to get a release then they force you in to getting the other products

I have told your this company several times that i was working with OTR solutions and that i needed the buyout so i can be released but instead the company has went against me but trying to retain my load payout by not processing because i have ask to leave causing my company financial hardship that i feel now to seek compensation because they are now holding my load processes because i have asked and file this complaint with the BBB the company *** stated they have not received any buyout .. this company responded back with a solution but once i closed it thinking they resolved the issue they will continue to not give me the release like they have stated so until they have sent my *** and company buyout that i have said a million times i work with ************* to send it there then i will agree to closed this complaint if not i will go as far as i need to against this company for obtaining a *** when i stated to joy that i already had a company the only reason they got my loads now is because it cause my company financed hardship waiting on them to send a release they then told me just let us fund the few loads and you can leave at any time now you are holding my loads that are submitted to keep me from getting paid through any other company

I am rejecting this response because: This has become the worst experience ever months later we are still going back and forth in reference to this matter no buyout has been sent to OTR or me and no one has reached out to me so again this is the same thing we been going backwards about so until this problem is resolved i will keep trying to get away from this company i have now reached out to the state where the *** is file to further investigate all the *** this company has placed on people before they even comment to an agreement the only reason people agree is because they make it difficult to get the *** off so you either agree so you can get funded or you dont get funded fight every day to get it removed and cause your business hardship nobody wants to go out of business so they have no choice but to stay at this point Im giving this company 7 days to present the buyout and the *** if they have not done so by then i will take the BBB offer for legal consulting

Hello,
We can not provide you an LOR while we have open invoices for loads that have been purchased.
If we were to do that and you were to move onto OTR or another factoring company it is highly likely we won't get paid for those loads in which we paid you.
I am working with our sales team to make contact with you and OTR to get a buyout executed.Additionally, you should know this part of the contract you signed with us, "Blue Water does NOT require exclusivity to participate in factoring services. (You can sell loads to us or to any other factoring company, but you may not sell the same load to multiple factoring companies)."
So please feel free to begin sending loads to OTR, but until all of the loads we have purchased are closed we can not issue and *** any other factoring company in the industry would behave the same way.

This is exactly what i was talking about every message has been a different requirement on how and why they havent or wont submit this point is if i would have got this the last 2 months i have requested it then there would not be any invoice i had no choice but to process them because it was causing a hardship and i would have been out of business that would have been another issue then i was just advised if the reason why you want me to get a buyout is so that you can charge me a fee to leave why should i have to pay a fee when i been requested this since the day i got notified it was a *** i was told it was place on my business so i can work with you in the future but i stated to joy a number of times i was working with someone else and she still applied for the *** to block me from working with anyone else then was told i can leave at anytime but then everyone refused to get it so again i was forced to process or lose my business now my business is being held and the buyout has to be done with a fee so that your company can rob me out of my hard earned money this has to be the biggest scam ever to make someone pay to leave when they didnt ask to be here and ever since i have reported this company they have delay payments been rude to me and lied i had reached out to the broker myself to see if they can verify my loads they advise me everytime that they responded already but this company makes up the excuses that no one responded thats the reason for the delay but the brokers send proof so you can advise me how to do the buyout because i dont want to wait until then because when that time comes you will then have another excuse on why you dont have a LOA also no company will do any factoring with a company until they are clear from one company and you know that because if that was the case i would have been processing my payments through *** so please stop making assumptions that i can go anywhere. This has been a nightmare i hope no one ever has to go through all these reports about this company doing the same thing should raise concerns on how this company gets away with this i am going to start reaching out to everyone that has left a review with the same issues and we are going to be a team against this kind of work Im not stopping until Im free from this place

I am rejecting this response because: Im just completely tired of the back and forth i have reached out to the buyout teams by email twice no response from them and OTR said the buyout cant happen because you have open invoices so you wont accept the buyout so many different responses to this matter but the *** from OTR name is ****** ******.. i reached out to the broker and have proof that the broker had verified the loads but your team decided to keep saying that they didnt respond back i sent my proof and then they still delayed the payment after i noticed it wasnt delivered like they said they the *** *** was rude said just send the buyout i told her dont be rude this is a business i have waited over a week for it to be processed and your team lied and said the brokers didnt ***ly and in fact they did and they had the proof to show Im honestly done with factoring i just want my account done and at this point i can figure out the rest

I understand and agree that the constant back and forth is frustrating.
Here are the facts of the situation. Right now you have 6 open invoices with us for loads we have funded you on for a total of $3,900.00. All we need from either you or another factoring company is that amount.If we can get that amount we can close the invoices and bring your account with us to a zero balance and issue an LOR and let you be on your way. We have to hedge our risk in these cases and need to ensure we collect before issuing an LOR, because if we let you go without collecting then the likelihood we do not collect increases significantly.

I was shopping around with different companies for fuel cards and factoring, gathering quotes and offers. After receiving persistent phone calls from Fleetsmarts, I asked them to send me an email regarding factoring and mentioned that I was interested in a fuel card with a credit line. My logic, as a new business, was to build credit. However, I did not sign a contract for factoring or give permission for a credit check on my business. Based on my research, I understand that without a signed contract, Fleetsmarts is not authorized to file a UCC with the state government. From my understanding, they illegally filed a UCC without my consent.
I am now requesting a letter of release but have been unable to reach my assigned “account manager” or speak with anyone in a position of authority within the company. I’ve asked to be connected with the UCC department, but all I get is the runaround. This seems to be a typical business model that focuses solely on profit with no regard for customer service and could puts hard working startups out of business!Business Response

as for UCC filings I would encourage you to look is why the government has them and. What they are for.
You have a 0% interest line of credit approved for fuel. Your call shows you said you were interested in using it and getting all our discounts. Which is why the UCC was filed.

In February of 2023 my company had one phone call with Fleetsmarts to discuss the POSSIBILITY of doing business with them. Due to multiple instances of witnessing some questionable business practices, we did not agree to do any business with them. Even though I was very clear that no business would be done with them, they placed a UCC lien on my company.
