We signed just for the fuel card, not to do business with them, never signed for the factoring, didn't take any credits/money with them. We never signed a contract with them, they don't want to give us the letter of release * termination of the UCC. Please help us ASAP, we cannot get accepted by another factoring company until will have from them this document. The problem is that we didn't give them permission to have a factoring contract with them, this is what concerns me the most, that now they created so many problems, without having our signature for this factoring. You can call the manager Mathew directly at ###-###-#### / ###-###-####or his office number (employee Peter usually is replying) at ###-###-####. They change their phone number very often and promise that will provide this letter but they really don't. Their company just answer to see if you are a new customer, after I talk with them they put your phone nr in black list. Please help us to get our rights by having this document. *** ****** Is a name we don’t have in our system. So first please tell me what name we can find you under, and then I’ll look into your file to determine what is going on.
Second. UCC does not stop other companies from doing business with you. Although many Factoring companies require that they have the first place position before they will work with you.
third, UCC filings are for companies to announce there intend to do business with you if there is any interest shown and you are approved. We specialize in giving loans and helping small trucking companies get started and don’t do credit checks. You qualified with us, showed some interest, so we filed to show our intent to work with you. Which also approves you for factoring. But is not the reason for the filing.
That being said. Sorry to hear you don’t want to try us. This process might not have gone smooth for you, but we are the best in the business and save customer thousands with 0 interest loans for fuel, and cheep but excellent programs.Initial Complaint

This company asked me about fuel cards. I did not know anything about them or was interested in a fuel card. I did not see anything wrong with getting a fuel card. But this company somehow enrolled me into their factoring. I never requested factoring or signed up for factoring. They asked me about fuel cards only. I have NEVER factored anything with this company. Somehow they file a *** filing on my company. I have been asking for 2 weeks now to terminate this contract. The customer service tries to prolong the process for some reason. I am not happy with their service at all. I have spoken to *******, **** and ****. You have a 0% interest line of credit approved for fuel. Your call shows you said you were interested in using it and getting all our discounts. Which is why the UCC was filed.

I am moving from one factoring company to another one and this company called Fleetsmart apparently filed an UCC1 on my name without any authorization on my side. I am requesting them LOR and they are refusing to give it even when I called the, / send emails explaining them I NEVER filled any application or signed any document with them. They are pushing me to use them as a factor or make me wait a long period of time for the release, even when i never had anything to do with them. This is beyond legality here.
I want them to cancel the registration they apparently made on my company and get the UCC1 removed. I need the LOR ASAP.Business Response

Fleetsmarts provide my business NK TRUCKING LLC mc no. ******* *actory service. At first they didn't mention any thing about needing any clearance certificate from my previous trucking company. When I signed up and start sending my invoices then they said need the certificate. I can't provide them so I asked them to give me letter of release. That way I can get directly paid from brokers. Now fleetsmarts want to charge us $2500 for letter of release. First they were saying that they need to get paid from the brokers first then will give us letter of release. Now Fleetsmarts got paid from all the brokers on open invoices and now start saying that we need to pay $2500 fee for letter of release. No where in the contract or when I talked to them while signing up they mentioned anything about $2500 fee. I have $5000 worth invoices pending to get paid which i can't without letter of release. Sorry to hear you’re not happy with the service. All loads have to be verified before purchase and there are several ways for that to happen. But if there is anything wierd or off with it, they need to be certified. As for the 2500. There are several legal documents that need to be prepared and submitted to the government to accommodate the UCC release. 2500 is what we charge for the services. You are welcome to have the documents prepared by your own legal team, but that is the cost to use ours. At no point did we agree to cover all legal document costs for your requests. As long as you don’t owe us any money, once your lawyer has completed the documents send them to us and we will get them signed. You can always talk to your customer Rep to see if the legal department would do the paperwork for less.Business Response

We see that payment sent to us from TQL.
We had cancelled that load with the broker when we were disengaging our relationship, but they sent it to us anyway. We have processes in place to return those funds to the broker, and then the broker can pay them to the new factoring company or where ever the new NOA has signified.
As you can assume, this happens when carriers move from one factoring company to another and is quite common. We are working on getting it returned. What about load #190011894? Should we be expecting that payment too or was that broker given a new NOA with the LOR provided?Business Response

Company has filed a fraudulent UCC claim against my company without an extension of credit. In fact our agreement specifically states there was no request for credit and all transactions were guaranteed by a business credit card not through Fleetsmarts.
Company front line agents will not connect with actionable reps to resolve the issue. Callbacks are not made as requested.

this company was given the opportunity to take action and be done. Instead they continued to lie and deny responsibility for fraudulent actions. Their response still refuses to acknowledge what they did was at least deceptive and unacceptable and in reality was a form of fraud.while I acknowledge they have removed the fraudulent liens against my company I will accept nothing less than an acknowledgment that their actions, documented not only by my experience, but by multiple reviews of their company on multiple forums show a pattern of deception and fraud against business other than just my own.
I had repeatedly turned down their offers for factoring services as their terms were unacceptable. And over a year ago I stopped using their fuel services when they became with them over a year ago due to a lack of follow through with basic services they promised to deliver on direct payment which was the ONLY business I had negotiated to do with them, turning down their hard sell factoring services. They didn’t deliver, I quit using their services. My complaint it their manner of deceit that was a blatant attempt to tie up my business assets and prevent legitimate business services with other available services providers. And a blatant violation of the UCC filing rules for the state of MN and the general principles for which the UCC rules exist.

First off. Sorry for any inconvenience. ************ Call this number and let your customer rep *********** and they will give you everything that you need. The lien is for the credit line for the 0% interest fuel line. UCC filings are for companies to announce there intend to do business with you if there is any interest shown and you are approved. All the being said. Closing the fuel line is no problem, and Im happy to send you all the phone conversations where the Ucc was asked and agreed to.
Also ask your rep about the fuel discounts, you should have gotten a pretty big savings on fuel. But the discount wont show on the pump receipt, but on the receipt we sent to you. You should notice a difference in what you paid and the pump receipt.

I would like to file a complaint against Fleet Smart for unethical business practices. Despite our contractual agreement stipulating a maximum service fee of 2.5 percent, Fleet Smart has consistently withheld payment from me and failed to adhere to the agreed-upon terms. Furthermore, there have been instances where Fleet ***** has taken more than the agreed percentage, resulting in financial losses on my end. These actions by Fleet Smart are not only unjust but also demonstrate a pattern of dishonesty and exploitation. My deepest apology. I have looked into the account and you are absolutely correct. There was a clerical error that put your rate at 3.5 instead of the 2.5.
Earlier today you wouldve gotten an email from our accounting staff notifying you that we had caught the error and the funds have been replaced in your account as of two hours ago. Again my apologies for the air on our side. But you will see that that has been made right. As for the holding of purchasing loads. I can only see one time when that happened. And this time was due to paperwork that was needing to be submitted to our underwriters. that process (once we are informed) it has to be completed before we can continue to purchase loads. Once the completed process was done, the loads were purchased, and Funding continued. Again Im sorry for any inconveniences that have been caused. I have made repeated attempts to get in touch with someone, anyone with this company, no one has contacted me. First of all, I am sorry for your struggles as it appears this has been going on for sometime. Our records indicate that someone from your company has been calling for over a year in regards to this matter. I have research your company, and I can assure you we, nor any company we do business with has a UCC filed against your company. Whoever has that filing against you is not us. I would like to inform you that there is an easy way to get this resolved with whoever has that against you. if you go online and look at your states UCC filings through the government, they will have a section in which you can dispute the filings and will then require proof of the filing from whoever filed it against you. If they do not respond, then they will automatically release your lien. below, I am attaching our address as it is important to me that you can see that we are legitimate business with a legitimate address. I was told that they would let me out of this contract by the General Manager. Tell have been holding my money forcing me in to bankruptcy. Lost my car, about to loss my home. First of all, I am sorry you are in this situation. Looking into your account it looks like at least one if not more of the loads that were submitted were problematic and not meeting the requirements for us to buy them. We do have a team working on it as fast as possible. However, we cannot release you from your contract until all money that has been submitted on your behalf has been paid. I see several attempts from your account manager to contact you with no result. So please keep an eye out for there call so we can workout the load problem.
