Fleetsmarts have a UCC file on my company file #****-104-8831-2. I asked them to remove it many times and now its been couple of month and they ignoring my calls and not answering to me. Our last conversation was that they promised me to remove their file and send me a release email but they never did and since then they are not responding. I cant do business with nobody because of it and I need this situated asap please.Business Response

First off. I am sorry for any inconvenience you have experienced. I have been unable to find any information about you in our system. If you can provide me with your DOT number and or the company name that you are under in our system, I can have all phone records, emails, communications and contracts pulled. As well as any attempts you have tried to call our system pulled up to verify your claim. Please keep in mind, once we release a UCC the state department can take up to 2 weeks to make the changes public. Once I have you info I can provide you with all your phone records and communications.

This company has put a *** On my business OTE MOVING AMERICA LLC Profile and I never had any dealing with them , no products or any other services ! Sorry to hear you are frustrated. On ***** at 6:12 pm a representative from your company showed interest in using our products. You have a 0% interest line of credit approved for fuel. Your call shows you said you were interested in using it and getting all our discounts. Which is why the *** was filed.

We specialize in giving loans and helping small trucking companies get started and dont do credit checks. You qualified with us, showed some interest, so we filed to show our intent to work with you. With also approves you for factoring.
That being said. Sorry to hear you dont want to try us. This process might not have gone smooth for you, but we are the best in the business and save customer thousands with 0 interest loans for fuel, and cheep but excellent programs.

Better Business Bureau:One of our business Reps did Show interest for this service , However the company just filed the *** without signing any documents which cause us to thing it was a fraudulently activity due to it just being a inquiry our business is a partnership so it raised concern that someone would sign for such product without all authority but it has been resolved the company was fast to fix the problem

November 2023, I applied for a "Pay at the Pump" fuel card. Meaning, my credit card would be attached to the fuel card as a method of payment. I DO NOT have a line of credit with this company and I have a letter from them stating such. I also never used the account. This company placed a UCC Lien against my company without my company having a line of credit. Now, I cannot get a factoring company because of this lien. All factoring companies require to be in first place when placing a UCC Lien. This lien needs to be removed immediatelyBusiness Response

My recommendation is you at least try the service. You will find that the rates and the service is better than any other *************** out there. If you start using the service and then decide that we do not provide a good service, then we will let you out of your contract. I had initially signed on to their fuel program, and had a UCC filed under my company for factoring. After back and forth with their sales rep they said I had no choice but to factor with them. Fast forward to now, I was able to convince them to let me go, but now the have stopped replying to the factoring company that is trying to buy me out. First off I am sorry that youve had a bad experience. It sounds like there is some confusion so I would like to help. To get the *** removed please call this number ************ and ask for *******.
second. We cannot block you from getting a factoring company. And any ***************** that is telling you this is not being honest with you. If you are dealing with the factoring company that requires that they be in first position all they have to do is call us and get it a subordination from us. This is the same-day service. The filing that we submitted was not for Factoring but for a credit line to use our fuel program. You qualified for the line of credit and so it is in place. Once our reps know that you would like to cancel your line of credit for fuel, and you dont want to use our ***************** , they will send you a release form. We also will notify the state in which you reside. Depending on the state that you are in this process for the states, side of things can take a couple of weeks. Please let me know through this channel if everything does not go smoothly and I will make sure incorrect any issues. But again, whoever is telling you, you cant do service with another customer because of us is not being honest with you. These filings are for any company to do if they intend to do business with you. Do keep in mind that because we have the lowest rates and are taking a lot of the customers out there from our competitors, most of our competitors are badmouthing us, and our making life hard for those who do business with us. For this, I am sorry . But obviously I cant control them. Please feel free to look up the laws on these filings independently of whoever youre talking to. On 2/20/2024 I realize that my company ************* SERVICES LLC has a UCC filled by Fleetsmarts on 12/27/2023. I got in touch with the allegedly account manager "***" to request a letter of release since I've never signed any documents such an application or agreements for their services which include factoring and fuelcard nor ever express any interest on using them. While spending more than one hour on the phone been transfer from one representative to another seeking help to get my letter of release, instead of sending the aforementioned letter they send me 2 factoring agreements, I couldn't believe after so much time they didn't take my complaint seriously.At the end I'm getting legal advise since this is causing my new trucking company to lose money on loads I can not book while at the same time I have to pay for insurance and other services and I will recommend anybody else to follow the same path since this representative "***" was mocking to my advisor about the many complaints they have like if another one wouldn't hurt them, Lastly to Fleetsmarts I want to express that for us, trucking entrepreneurs this is serious, is our live and every load we delivered helps to make your life and does living in this great country easier and continues to build America as we now it.Business Response

First thing, I am sorry for any difficulty or inconvenience you have had. Our goal is to help small business not hinder them.
second. A UCC filing has been set up by the government for companies to register customers they have interest in doing business with. On 12-12-23 at 07:03 A representative, who passed all qualifications showing that they were a representative of your company, acknowledged and accepted interest in using our products, and for having a fuel line of credit. 12/23/23 07:51 A follow up call was made, and on a second time a representative from your company acknowledged that a credit line was wanted and desired by the company. The phone records from all phone calls are available for me to send to you. The filing was then submitted to the federal government after the approval of the credit line, no signatures are required for these filings. The government only requires that we have agreed to do business with you and that the customer has shown interest in using and having a credit line. This is in no way a stumbling point for the customers business to move forward. If our competitors are trying to make it sound like we have done something wrong to slow up your business, that is them making life harder for you not us in an attempt to make us look bad. Any company can buy your receivables legally with a second place UCC filing. Also, All filings can be subordinated if the ***************** you wish to use, simply asks.third. 02/20/24 09:06 Customer called in and indicated they were no longer interested in our products and the credit line. They also requested that the filing be removed. The removal of that filing was submitted to the federal government that same day. The federal government can take up to two weeks to reflect that request. we have no control over how quickly they take care of this matter. All documents are available to be sent upon the customers request.
Lastly on 02/20/24 11:00 factoring company rep called pretending to be ******. patched in with AM. ended the call and the customer and all connection with this account has been reported for fraudulent activities as it was confirmed that the person calling in was pretending to be the customer and was not. This documented phone call is available to be shared upon request as well.

Fleetsmart contacted me offering a fuel card. We accepted the offer. However, that also enrolled us into factoring service, service that we don’t use in our business. Due to the factoring they placed ann UCC on our business. After several calls and emails they have not removed an UCC filed for this company yet. We contacted the Secretary of State and according to them only Fleetsmart can remove it. It’s been over a year and they still haven’t removed it. When we call Fleetsmart they only say we will call back, when we email them they don’t replay. Please RUN from Fleetsmart. They are crooks.Business Response

First off. I am sorry you have had a bad experience with us. I’m happy to look over your situation, but I don’t see you anywhere in our system. So please provide me the company name, and I will look into it. Second thing is the UCC filing Is for all loans. It is not specifically for Factoring. That being said, most factoring companies require a 1st place UCC filing. We file a UCC filing for wall fuel lines that are given (as the federal government requires us to do) So, if your company was provided a fuel line of credit, we would have filed that with the government. If you have someone telling you that this was an improper move, most likely, it is one of our competitors, trying to give us a poor reputation as our rates are below all of our competitors. That’s being said, We remove those filings at a customers request as long as they don’t owe any money. We also will subordinate to any Factoring company. The Factoring company just needs to reach out to us and ask. so please provide me with your companies information and I will get you the information on what’s going on with your account.
