    I received many calls from this company. They asked if I wanted to try their fuel cards. Nothing was said about factoring. They filed a UCC so now they company I do want for factoring can not file the ***.

    Sorry to hear this has caused a problem. I I am confused. The factoring company can file a Ucc, ours does not stop it, also we can subordinate to them as well if they want, or if you do not want the fuel line of credit we can remove it all together.  Because our rates are so low and the service is so quick, most of our competitors make it hard on our customers. Not your fault, but what they are saying is not true. Please call our customer service to get a subordinate letter if they are not willing to accept placing a UCC with our so you can keep your 0% fuel line of credit in place.  

    as a side note, if you wanna do our factoring instead (which is already to go because of your fuel line) Ill so the first couple for free, and beat any rate youve gotten. Your call, just another option. Sorry again you have been caught up in this mess.

    I am writing to express my frustration with the late-night calls I've been receiving from your company, extending as late as 9 pm. This is highly inconvenient and disruptive. Also, they filed a lien on my company when i dont have any business with them

    This company filed a UCC filing on my company HIGH2SKY LLC. I never filled out or signed any paperwork. They are causing me to lose money for each load I can not factor with the company I've already told them on recording that I am Factoring with.

    I'd like for them to remove this UCC filing as it is false and pay for days that I am not able to factor my loads with my Factoring company!

    This company is a complete scam!! Absolutely do not conduct business with them. I am going to gather other companies in the same situation and sue them into oblivion. They aggressively contacted me about a fuel card and sent many cards before I ever made a decision or even got completely set up.
    Then they continued to call me 5 times a day asking why I don’t use the card they sent. I don’t even think they’re actually based in the US, and their phone representatives give false names. My current company Im working with for factoring and fuel told me that this happens all the time and that they’re true scammers. They cleverly stole their name from another company Fleetsmart(which is a real company) but they call themselves Fleetsmarts. They just look up companies with new authorities and aggressively contact you. I asked for more information and now I’m suddenly locked into some sort of contract where they’re able to place a lien on my company. It’s hard to get a response from anyone in their “office”.

    I am rejecting this response because:

    UCC Section 9-611 States it is clearly illegal to file a UCC-1 on any debtor without their consent and knowledge prior to filing. They only did this to try and strongarm me into conducting business with them when you find out the truth. 

    I told them months ago (March 2023) that I clearly had no intention in doing business and providing my banking information. They called me several times for months aggressively asking why I haven’t activated or used the card they sent me. I thought of it as very fishy they would just send me a fuel card without discussion of my business plans or needs and requiring me to link my banking information in order to utilize their “discounts”. 
    Only reason I even initially engaged with the company is because they made their name similar to another company I truly had interest with (fleetsmart), they just added an S to the end to their name(fleetsmarts). I even contacted the original company and learned that this company is swindling new owners/operators into “agreements” with them and they among many other companies are seeking legal action against this company. I’ve been blocked from gaining true business with trustworthy companies due to this and am just now finding out exactly what happened (November 2023). Completely predatory and unprofessional company. It’s simple don’t just file a UCC because it easy to do so without proof of collateral. There’s statutes that protect against this, but I guess that’s not a concern to them.

    This company has fradulently filed a Ucc claim on my business and I have called and emailed this company to send me letter of release at no avail. I was called by them offering me a factoring service and fuel cards for my trucking company and I said send me some info via email and I will look into it. Now I have a fradulent ucc filing and I can not get any assistants from any one at the company and I have a another factoring company I want to go with who also have reached out to them. I have contacted my lawyer and calling the secretary of state in hopes to get this resolved quickly but a simple letter and compliance was all I wanted. I need the letter or I will *** for it.

    About a month ago I received a phone call from someone at **********, soliciting me to do business with them. I declined to weigh my options, they asked if they could send me info to my email in which I accepted. They sent fuel card to my address in which I never asked for and never used. But now I have a ucc-1 lien on my company and never did any kind of business with them. I've requested it be removed and they say it's being done but nothings happened as of yet. I just want these frauds (bullies) away from me.

    First off. The phone number we have on file and the person that called in had all of your companies information. They were aware of and had the right answers to everything about your business and was representing themselves as the owner. If you are the rightful owner of this business someone has tried to steal your identity. I am going to have a girl call you to try and work this out. However, if you are rude to my people, then youre going to have to deal with the identity fraud yourself and prove you and not them are the actually owner. That being said we want to help and get it right.  but I will not tolerate my people being treated poorly. If you arent in agreement with that, then lets try and get this figured out together.

    We have given this to the authorities, if they provide proof that the chargers are not the customers, ( which we believe they are the customers) we will remove our collection actions.  But the courts or investigators will need to provide that.  Our investigation unit found no evidence of identity theft.

    the first week of May I received a phone call from fleetsmarts. They tried to sell me on fuel cards which I declined along with factoring services. They sent fuel cards to my office. On 05/16/2023 an unauthorized UCC filing was filed against my company. I spoke to their customer service which was not helpful at all. When I requested a letter of release be sent to me and the factoring company of my choice they said yes they will do it to get me off the phone. And then they emailed me a questionnaire. No letter of release, no supervisor I can speak with. They are causing my company damage because I can not work with any other factoring company as long as they have this UCC filing. This needs to be fixed and people need to know how this company attempts to bully you into their service. Fleetsmarts needs to be exposed for their wrong doings!

    The release letter was sent to the email that the account was set up under 2 times. So either you do not have access to the email that this account is under. Or you are intentionally harassing my company. Also, you can remove it simply by requesting it removed by the Ucc.  Ucc removal does not require us to be involved. When we file them, it is a statement that we are intending to try and do business with you. Removing them is showing your intent not to do business with us.

    On 09/15/23 I received a phone call from Anthony stating that a load from back in March was going to be recoursed for load #***** for the amount of $1525. I asked why was this the first we were hearing about a load from back and March and why did it not show up on the portal? Their answer was "I dont know". I said we needed this broken down over several weeks because we can't afford the full amount recoursed immediately and the person I spoke with agreed and we worked out the amount and number of weeks. That was at 3:22pm on Friday the 15th. At 5:20pm on Friday I got a text from Anthony saying they were going to automatically deduct it in full since it had been so long.
    On Monday the 18th I contacted that broker regarding payment and they stated they had grossly overpaid Blue Water Capital (the load was $5,000 from a different carrier and they paid $10,000) and Blue Water should have applied that amount to our load, they also stated that Blue Water has stopped responding to them about the balance, and that if we get a letter of release for that load they would pay us directly. I reached out to Blue Water via email and phone numerous times yesterday requesting to either be repaid for that load they recoursed OR send us a letter of release for that load only and got NO RESPONSE from the billing department. I called 5 times and emailed 3 times. Finally, got an email last night at 6pm that they "could not send a letter of release because we have funded Load *****". They have recoursed a load that they refuse to send a letter of release so we can get paid AND have already been over paid by the broker. If this isn't rectified immediately we will need to pursue legal options.
