Back in 2019, I submitted a claim for a cash payment of $125. I recently found out that they where starting to mail out the checks back in February. It it June, I still have not received my payment. I emailed them, they responded back with incorrect information about my claim. I responded back and told let them know about the incorrect information. That was 4+ weeks ago. No response. I sent then a message through the website and by email. No response. They GHOSTED me!Business Response

I am rejecting this response because:PART 1:There are several issues.- Back in 7/25/2019, I submitted "Option 2, Cash Payment: I want a cash payment of $125."
- I never did choose the "Credit Monitoring" option.
- I never received said email. ********* could back me up on that.
- Cash payment was never "Up to $125", it was flat rate of $125 indicated by my claim.
Thankfully, I did printed out and kept my "Claim" for 3+ years.See attached file "Equifax Data Breach Settelment 2019".PART 2:I litterly copy and pasted "PART 1" from my response to you dated 06/16/2023.Guess what?YOU GHOSTED ME!File attachment, that is the same copy I emailed you on 6/16/2023.ANDIt is the exact same copy I provided to you and BBB when I filed this complaint!Guess what!I did some research on the this company. You have a long history of not paying out legit claims.

I was part of the Equifax settlement years ago. Thank you to the attorneys who fought SO HARD for victims like myself. At first the administrator claimed that they have sent me my check but, I have never received it as because my credit was destroyed had to move out of the address on file. But, I was never notified by ANY other means. Please bear in mind that all this hardship is directly due to the negligence of Equifax. For years and years my identity was used in multiple ways. All of my personal information, Social Security number, email address, passport information all is compromised and used on the dark web. They even violated my tax returns. (Credit card, auto loans, loans ) As difficult as it was I provided as much information as I could as this event cost me thousands and thousands of dollars. As a result I became homeless, With my compromised credit status I was unable to obtain a job or an apartment or automobile insurance, credit card NOT EVEN A BANK ACCOUNT or loans nothing. Now I am being violated AGAIN! Its because this company (The settlement Administrator) refuses to send me my check or tell me a time WHEN I receive my monetary compensation for this liability disaster. It has been years now the are stalling..and for what? Dont they realize that EVERY day that goes by is another financial disaster that I must endure? Your ticket ******* Dear ****,Your Settlement payment will be reissued as soon as possible. An exact mailing date has not yet been set.Regards,Equifax Data Breach Settlement AdministratorThis is been happening for months now. Still no replacement check. No check from the beginning. I am rejecting this response because:I ATTACHED ALL DOCUMENTATION THAT WAR REQUIRED UPON REQUEST FROM THIS COMPANY.
this included but was not limited to1. over 48 hours of tedious work trying to prove my identity to the various companies that this breach caused.
2. Due to the breach, my credit was reduced to a score below 400 which caused me higher interest rates, the inability to obtain gainful employment, the inability to obtain automobile insurance and the ability to obtain any type of housing which requires a higher credit score.
3. How does one send proof of this? I do not even have those email addresses that were compromised. All of the files that I had obtained were located in the ****** system which is now an accessible to me.
4. how do I send you documentation on how my life has been turned upside down and then I cannot get any credit cards, I cannot gainfully be employed, I cannot obtain a loan or insurance or even housing with this credit score.
what kind of proof would you like? I am a victim of this breach, according to your records, how am I to receive my just compensation? Just answer that question for me.

I am rejecting this response because:I am dissatisfied with the provided response due to its recurrent nature. Each time I reach out, I am greeted with the same reply via phone rep. ******* that my documents have been received and are currently under review. However, I must express my concern regarding the disparity between the actual payout of approximately $38 and the expected amount of $100 that I had initially specified during the dispute. I kindly request a thorough explanation as to why the settlement fell short of my chosen sum.
To provide context, my initial claim dates back to 2017, followed by subsequent claims in 2021 and now 2023. The Equifax Data Breach Settlement was on appeal until August 2021. The Initial Claims Period Claim Settlement payment distribution occurred thereafter in December 2022.
Regarding **************** Initial Claims Period Settlement payment amount of $40.44 (for her claim filed in October 2019), the Settlement and Consent Orders reached with the **** CFPB, and State Attorneys General in 2019 prioritized reimbursing Settlement Class Members for the costs they incurred related to the breach and providing credit monitoring to any Settlement Class Member who wanted it. In order to ensure funds would be available for these priorities, the Settlement and Consent Orders initially limited claims for time spent and alternative compensation to a total of $62 million. The entire $62 million allocated for these claims was distributed proportionally as required by the Settlement Agreement and Consent Orders.
Per the terms of the Settlement, because claims for alternative compensation and time claimed during the Initial Claims Period exceeded $62 million, Settlement payments were distributed pro rata to those making valid claims.
Once the Extended Claims Period ends in ****, if any funds remain in the Settlement Fund the initial limitation on claims for time spent and alternative compensation will be removed and remaining money will be distributed on a proportional basis to those claimants who submitted valid time spent and alternative compensation claims.
Per the terms of the Settlement, Extended Claims Period claims are reviewed in the order received. **************** claims will be determined as expeditiously as possible.Customer Answer

I have diligently furnished all requisite documentation and have not been presented with any supplementary inquiries, whether through telephonic, electronic mail, or alternative communicative channels. Anyways i cannot waste anymore time with people who continue to manipulate the facts. send me the check for 3 units at the average retail price
BBB - please keep this complaint from the business open till i receive my check in the mail

Equifax Data Breach Settlement c/o JND Holdings LLC. Case number PJA89YKNU6.This is a complaint against JND for stalling and evading Benefits Payment on the Claim listed above. On 09/24/2019, I filed my Initial Claim under Equifax Data Breach Settlement for cash reimbursement for losses and expenses and time spent. My claim amount was $ *****. 15 (seven thousand five hundred seven dollars and 15 cents) including allowance for 20 hours of spent time. On 06/14/2022 per JND request, I provided additional proof in the form of bills, invoices and receipts. All files were directly uploaded to JND website and confirmations were obtained. On 09/23/2022, I filed an Appeal contesting the case findings and as result, on 10/09/2022, JND sent me an email stating, Quote: "We have processed your claim and determined that you are eligible for a Settlement payment." End of quote. Since then, they stopped responding to my calls, emails and inquiries. Finally, on 05/19/2023, I called and spoke with ****************** who stated there was no benefits amount assigned to my case and that someone would get back to me. On 05/22/2023, I contacted by email JND Senior VP, *************************, who replied that, Quote: "Your claim appeal is under review by counsel". End of quote. The Case was already processed and approved in October 2022 and now they say it is under review?. This explanation is disingenuous and totally without merit. *** is trying to evade and manipulate my claim compensation. Consider this is a very serious matter that requires immediate corrective action. Presently, JND owes me a check payment in the amount listed above without any further delay.Business Response

****************** filed an Equifax Data Breach Settlement Initial Claims Period claim for alternative compensation/cash payment, time spent, and money spent. The alternative compensation/cash payment and time spent portions of his claim were approved per the terms of the Settlement. He was issued an Insufficient Documentation Incomplete Claim Notice for the money spent portion of his claim on June 10, 2022. ****************** responded to that notice but the documentation remained insufficient to support his money spent claim. A Denial Notice for his money spent claim was issued on September 21, 2022. ****************** appealed this denial which is under review by counsel. Appeals are reviewed by the parties to the appeal, not JND. As soon as a decision is reached by the parties, we will provide that determination to ******************* Per the terms of the Settlement, any Settlement payment will issue after that determination is reached.Customer Answer

I am rejecting this response because:The response provided by JND is convoluted, too ambiguous and short on specific data. They state, Quote: "Appeal is under review by the counsel" End of quote. They don't provide any details on who the counsel is, besides the disclaimer that it is not a part of JND. Next, they claim, Quote: "Appeals are reviewed by the parties to the appeal not JND" End of quote. I'd like to ask JND to specifically name those parties to the appeal. Please provide name, phone number and business address. I am not aware of any other parties to the case besides myself and JND. Additionally, in the past 7 months, I received no communications regarding the status of my appeal. My previous attempts to contact JND by phone, email or message board proved unsuccessful. They don't communicate, play for time and delegate decision making responsibility to unidentified parties. This leads to the delay of resolution of my claim and denies my justified compensation. I find that there is simply no merit to their arguments therefore, I categorically reject their reply.
Sincerely,

I am rejecting this response because: This reply lacks specific details as were requested in my previous statement. Practically speaking, I am cut off from the appeal process, have no access to the files and cannot address my legitimate concerns. There is no timetable to the appeal besides some vague outline as to the finality of case review process. Based on these findings, I have decided to to protect my rights and financial interest in this matter. All parties will be notified accordingly.
