I was a member of a class action lawsuit. This was administered by JND legal Administration. The case is noted below.************** Mercedes-Benz Canada, Inc.MB Canadian BlueTEC II Settlement www.BlueTECSettlement.ca Toll-free ************** AKC I sent in all the appropriate paperwork and also had the Mercedes Field measures installed our 2015 Mercedes Benz GLK250, at no cost. There was to be a settlement payment issued on closing of the class action lawsuit. When no payment was received after the closing date, I sent various emails requesting our settlement. JND then indicated they hadnt received our paperwork. Our paperwork was submitted to them, and I feel that due to their clerical errors, they have either lost or misplaced this file.I have all the dated email correspondence, with this company and can provide additional information when requested.Their website is included above for reference to class action settlement offering.

JND Legal Administration is the Settlement Administrator appointed by the Court in connection the Mercedes Benz Canadian BlueTEC II Settlement.  As the Settlement Administrator, JND may only pay claims that meet the requirements set forth in the relevant Settlement Agreements and Court Orders.  The deadline to submit a claim was May 1, 2023 and we do not have a claim submitted by ****************** prior to that date.  In conversations with ******************, he provided the *** number of his vehicle as well as his wife and father-in-law's names. We have performed an extensive search and can confirm that we did not receive a claim submission for that *** under ******************, his wife, or his father-in-law's name.

I am rejecting this response because:

As per the various emails that have been sent, we have made this very clear that the appropriate documentation was mailed to this organization.

It is our belief that the company has lost or misplaced or mis filed our application as a member of this class action lawsuit.

We had the necessary field measures retrofitted to our vehicle and submitted the paperwork required to this company in order to be a part of this lawsuit against the manufacturer, that being Mercedes Benz.

This ongoing denial has been very frustrating and we are being viewed as this is our fault, which is a pathetic response to my ongoing concerns to resolve what should have been a straight forward process.

We simply ask for the compensation that is rightfully ours, as per the documentation set out within the class action lawsuit.

      Sincerely,

      ***********************

I am a victim of 2017 Equifax Data Breach. Filed the claim for credit monitoring service at Equifax Data Breach Settlement website. Contacted the settlement administrator and I was told that 2 emails were sent to me in 2022. However, I have never received these emails.Further more, the attached print out from Equifax Data Breach Settlement website shows that my claim is still "under review" as of 2024-05-06, which implies that the emails has not been sent out to me as of today.

      I am rejecting this response

Here are the reasons for my rejection:

      1. Emails Not Received: Contrary to your assertion, I have never received any emails from your business in 2022 regarding my claim. I have thoroughly checked my inbox and spam folders, but there is no record of such communication.

      2. Claim Status: As of May 6, 2024, my claim remains under review according to the status displayed on your website. It is perplexing that credit monitoring emails were allegedly sent out while my claim is still pending after two years.

I have attached a printout of the claim status for your reference. I kindly request a more thorough investigation into this matter and a reconsideration of your response.

      Addressing ******************** statements -

In August 2022, we advised ******************** that we could confirm receipt of her claim and that claims were being processed as expeditiously as possible.
In December 2022, we mailed ******************** a deficiency letter advising her that she needed to submit proof of field measure completion and proof of purchase (which must include the date of purchase).
In January 2023, we confirmed that we received her deficiency response.  We did not speak to the validity of the response itself.
The documentation ******************** submitted cured her deficiency for proof of field measure completion.  However, while she submitted a Motor Vehicle Purchase Agreement for the vehicle at issue, it was a partial image and did not include the date of purchase and her claim was therefore denied in accordance with the relevant Settlement Agreement.

They do have the obligation to check the documents before the confirmation. Also under no circumstances I would  send a document with missing information.

These people are criminals. We received a notice of the ****** v State Farm settlement. We then received a check in the mail for our 'portion'. We had since sold the home that the check was for but the mortgage holder was still on the check. Once I finally convinced the mortgage holder to please sign the check I deposited it only to have it returned by the 'maker'. We had asked the settlement administrators to remit a new check without the mortgage holder but they refused to do this. I have sent countless emails and left many messages all since August 2024 to no avail. These people are crooks and cannot be trusted.

      Business Response

      Date: 04/08/2024

Under the terms of the Settlement Agreement in the ****** v State Farm matter, payments are required to be issued in the names of each insured for the eligible claim as well as mortgage holders.  Insured names and mortgage holders were identified by the defendant and mortgage holders may only be removed from settlement payment checks at the direction of counsel/parties.  As the Settlement Administrator, JND has worked diligently with class members and the counsel/parties to facilitate the removal of mortgage holders from settlement payment checks when requested.

************************ request for settlement payment reissue without the mortgage holder listed as payee was recently approved by counsel/parties.  Considering that approval, JND cancelled the check referenced by ********************** to allow processing of his request to reissue.  That reissued settlement payment check without the mortgage holder will be mailed to ********************** the week of April 8,2024.  JND was unaware that ********************** was able to obtain the mortgage holders signature on the previously issued check and, as such, did not interrupt the process of voiding that payment.

I contacted them regarding the equifax Data Breach Settlement over 10 times since October 2023. I even called to ask who's processing the claims and their employee said they don't know. The money they received is the consumers money but they are barely providing any information except "your claim is in review"... No one seems to have any information. The only new information I was provided was that NO claims for the extended Claims Period has paid out. WHY? Let me guess.. They are all in review. I contacted the lawyers, and now I'll be contacting the judge because they are just sitting on this money and have "no information" to provide!

I still haven't heard back from my last email sent March 5th and March 19th.  They won't even tell me who the judge is so i can file a complaint to let the judge know they are not paying out the consumers money.  As you can see from the attached photo, no voicemails from them.  At first I thought JND is just taking their time holding on to consumers money, but now I also consider them to be liars. They have NEVER contacted me via phone or left me voicemails. They aren't even responding in emails!!!  I already submitted a complaint to the consumer financial and I won't stop until I get my settlement payment that I am owed for the out of pocket costs of this equifax breach!

JND Legal Administration is the Equifax Data Breach settlement company charged with execution the settlement agreement between consumers and Equifax. I filed my original claim several years ago and JND legal services denied the claim saying I needed to provide more information on my claim without telling me what the problem was. After many calls to JND Legal Administration I was able to finally able to talk to someone that had actually looked at my claim and that person said there were no problems with the claim and that the email saying the claim was deficient was sent in error. I filed a subsequent claim about four years ago after several loans were fraudulently applied for under my name. Last week JND Legal Administration sent me a generic email saying again that my claim was deficient and I needed to submit more information. I again called asking why my claim was deficient and agents just read the email that was sent to me. I asked to speak to a supervisor and was told one would call me back but after five days no one had returned my call. The problem is that JND Legal Administration put a timeline on when I had to respond by or "your claim for money spent will be denied in whole or in part without further communication from the Settlement Administrator". So JND Legal Administration put a timeline on my response while refusing to call me back to clarify what I needed to send them (this is exactly what they did on the original claim as well). After threatening this complaint, **** called me back to say I needed to submit mileage justification to the post office and standard postage receipts (some had been submitted but photos were taken of all letters sent in lieu of receipts because I had had stamps on hand and didn't need to purchase them). **** implied this was inadequate to justify the postage expense. Bottom line is that JND Legal Administration promises call backs and doesn't make them and does everything possible to deny legitimate claims for victims of identity theft.

As a member of In re: Equifax ****************** Security ********************** Litigation Settlement Class, ******************** claims are subject to the **** District Courts Settlement Final Order and Judgment.  The Settlement Agreement along with the Consent Orders Equifax reached with the **** CFPB, and State Attorneys General in 2019 govern the settlement payments. As the Settlement Administrator appointed by the Court in this matter, JND may only pay claims that meet the requirements dictated by the Settlement Agreement and Court Orders.

****************** Initial Claims Period Claim was paid on 12/19/2022. He also filed an Extended Claims Period claim.  However, after review, that claim was issued an Incomplete Claim Notice for Insufficient Documentation on 3/14/2024. JND spoke with **************** about the specific deficiencies on 3/19/2024. He subsequently submitted a document in response to the Notice of Insufficiency which will be reviewed in accordance with the Settlement Agreement and Court Orders.

I am rejecting this response because:

While everything in the response from JND Holdings, LLC is true it doesn't address the complaint.  JND Holdings, LLC is sending out generic claim denials that aren't specific enough to address the problem with any claim deficiencies.  JND Holdings, LLC customer service representative are trained to do nothing but read these deficient emails to claimants (as if they couldn't read them themselves) and do everything possible to I keep claimants from talking to someone who has actually looked at their claims and can answer questions on the deficiencies.  That is the problem that needs to be addressed and isn't even discussed in the JND Holdings, LLC response.  I talked to four JND Holdings, LLC customer service representatives that did exactly as stated above and only received a call back from someone that had access to my claim after threatening to file this complaint.

      Sincerely,

Filed Mercedes Benz Bluetec class action and I had 2 cars that qualified for the class action. I provided all necessary information request exactly as required. There are many people who filed properly and did not get paid as there are online groups discussing this matter to this date. I was in contact with the company and sent proof of submission for each requested item. I was first told I was sent a "deficiency letter dated april 22, 2022 ...stating that your claim was missing AEM installation." This was FALSE and I proved it as there was an invoice directly created by merecedes benz for this lawsuit. Mercedes Benz issued a receipt for the required fixing of the car and that it was completed; that was what Mercedes Benz provided to those who had done the work and that was sent to JND. I know all was completed properly as I did get a notice from JND and it only stated that I needed to provide proof of name change. I did that as well as I provided my marriage certificate and NO other items were outstanding. *** gave me an reason that was not relevant to my filing and therefore, they had not looked at my claim. There is no letter April 22, 2022 regarding invoice; again it was regarding proof of name only. It is not right to tell me false reasons for your neglect to pay me my rightful settlement check. I should have received 2 checks and got nothing. My most recent contact with JND have not been acknowledged following my contact to JND in which I had provided the proof again and that what I sent was correct. This is pretty straight forward and expect to receive my checks in this settlement.

We are in receipt of the notification of the complaint filed by ***************************** in connection with the Mercedes Benz Blue Tec settlements. As the settlement administrator appointed by the Court in that matter, JND may only pay claims that meet the requirements set forth in the relevant Settlement Agreements and Court orders. Here, unfortunately, Ms. ********* claim did not meet the necessary criteria for payment.

******************** submitted one claim but she did not submit proof of AEM installation. ******************** was sent a deficiency letter on 4/22/22 and one of the deficiencies included on that letter was proof of AEM installation.  Her attempted proof of AEM installation was a screenshot from the Mercedes-Benz website but it did not include her name or dealership information and was insufficient to cure the deficiency.  In accordance with the Court approved Settlement Agreements, Ms. ********* claim was denied.

I am rejecting this response because:

Please see attached file that contains the following:

      -JND NOTICE OF DEFICIENT CLAIM

-PROOF AEM INSTALLED -as per provided by Mercedes Bens specifically for this class action

-INDIVIDUAL RELASE OF CLAIMS -was completely filed out

-REGISTRATION PROOF IN MY NAME per attached registration; AND, -attached marriage certificate, also had been provided to show my name change from ******* to ********

The attached were the items requested by JND in their DEFICIENT CLAIM and that were then provided to them to them completely and timely.  There were no outstanding items for this claim.

I had directly addressed this in the numerous contacts I made to JND and was not offered any direction to get my settlement.  JNP was elusive, vague and stopped responding to my inquires as to how to take care of this matter appropriately.

I met all your requirements and expect my settlement check to be sent to me.

      Sincerely,
