Have Not received payment for class action lawsuit regarding Mercedes bluetec settlement. On January 20, i received a email from Mercedes heritage in ******** Alberta informing me my vehicle was included in the settlement case, and they would inform me when the parts were available to perform the Field Measure. ******* claim was approved and a check was sent to this class member on September 5, 2023. It was not returned as undeliverable and it expired on December 4, 2023. We mailed it to the same address as noted in his BBB complaint below. The Settlement Administration has ended and we cannot reissue his check.
We have not received any communication from this class member to our main JND email inbox or telephone number.Customer Answer

I am rejecting this response because:As stated by many the check was never sent out this is a canned response. Many checks were never received, There is no deadline date for the checks to be cashed or mailed out as stated in the lawsuit this was a self imposed matter created by JND holdings.
I have been at this property since 2015 i keep diligent records of mail and have many dated pieces of mail sent to the stated address from September/October 2023 None from JND, as many have stated JND seemed to never shown the mail was sent out to owners of affected vehicles, there was no legal deadline date to receive or cash checks. There was no option to be granted direct deposit option for Canadians which left a easy out for JND to state checks were sent when clearly from the number of complaints they were not.
If JND refuses to send the check or reissue, I will file claim against them in there local state in ******* ********** through a local firm and we can handle it accordingly. I don't wish to escalate this issue however JND has not acted in peoples best interests on this matter clearly.
Sincerely,

I am rejecting this response because:As shown I have kept detailed mail records to the address there was never any mail from JND, I have shown email records that went unanswered long befor the proposed deadline when jnd stated otherwise. Clearly jnd does not want to correct their error and I will file claim in their office state.
I appreciate bbb assistance in the mater and will elevate the issue as needed.
Unless JND can provide the funds to the address stated or evidence to this check being delivered which has yet to materialize for any of the complaints

This company was representing a class action lawsuit on 2 vehicles we own. They approved payments on Claim DG4X2RPSVH and Claim DY8NW57ZQ6 for almost $3000 each and issued cheques. We never got them and we were not aware of when they were actually issuing them. Fast forward a year and we inquire to see where our money is and they said the cheques were cancelled and cannot be reissued because it has been too long. They never once tried to contact us. It sounds like this is how they have operated with multiple people.Business Response

I am rejecting this response because: text messages were never received nor was any communication stating that cheques were mailed. There was no follow up at all other than the claim had been approved, but did not state when we were to expect payment. If these supposed cheques were mailed, please provide the signature stating they were received as they should have been sent via courier with signature required to ensure proper delivery. We all know how often regular post goes missing. It would be hard to believe standard post would have been used for something like this with no follow up afterwards to let us know they are enroute, as well you would have seen if they were cashed or not and could have reached out before the 180 days to make sure they arrived. That is not our problem.

I am rejecting this response because:If I had not sent them all the information that they requested, why did they send me the email telling me that I had successfully filed a claim?
To me this smells like they send documents stating that they had all of the information to successfully file a claim and then later claim that I had not sent the necessary information. They should have told me that I still needed to file whatever information was missing rather than "success".
Seems like a great strategy to keep money that they should have distributed to the claimants.

I became part of the recent MB BluTec settlement for Diesel vehicles. I continuously owned a diesel ML-350 (2013) during the timeframe in question. The amount for my particular claim was $3290 in compensation. I had the work performed on my engine and submitted the documents and claim forms within the specified time limits. I updated my address when I relocated homes and received email confirmation that the updated information had been received. In March 2023 I was told that claims would be paid on a rolling basis. I waited. Since then I have emailed twice more - November 2023 and January **** - but have not had a reply at all. I have kept the email thread intact. The communication about the progress of the claim has been poor. It truly is not acceptable to leave people hanging like this over months when claims made are legitimate. No updates or indication of what is going on was received. The last time I checked online I saw that all checks are supposed to have been sent and the case is closed. I am utterly perplexed. I did everything in my power to apply correctly from the beginning - and did indeed do so.Business Response

I am rejecting this response because: I do not accept that our claim was invalid. The Individual Release form was signed and returned by my wife, *************************, on May 22nd, 2022. ******** is the legal co-owner of the car in question and is on the title, registration, and insurance cards sent as documents. The car has been driven by her since we purchased it together in 2013. The *** installation was booked and signed for by my wife. We are one household; only one car is in question. We sent her information on the individual release in May 2022 as the owner/driver of the car, and we did not hear back that this would invalidate our claim. If we had been told this was the case, we would have corrected it to ******************* signature before the deadline. It was ******** who followed up with address updates via email after we relocated homes twice as we believed this to be perfectly suitable. Then, suddenly an email response on March 13, 2023, said that ******** was considered a third party person and that ***************** should contact the company to discuss the record. This was a surprise to us, and at this point, we were now passed the deadline. Since November 2023, we have not been able to get a reply to emails. We are honest people and feel that purely on one technicality a release form to cover 'all future actions by any family members/heirs' - you have dismissed our entire claim, without giving us a chance to amend that technicality. Ours is not a fraudulent claim, as all the documents submitted prove with both of our names on each of the legal documents that we are eligible to receive the compensation for the car, according to the details of the case. We did everything we were aware of to satisfy proof that the car has belonged to us during the timeframe of the legal case.
Sincerely,

I am rejecting this response because:Your claim that i only provided unsigned release form is not accurate and not true. I double checked that all documents are uploaded to your system. On April 22, 2022 I provided all 3 documents as specified in your notice of deficient claim:

7/25/2021 I receive an email from "mbbluetecsettlement.com" about a class action against Mercedes-Benz diesel vehicles. I near immediately supply all required information and set an appointment for the required rework to be done at the dealership. 11/7/21 I email to verify they have all they need. 1/14/22 they send another email that looks very much like a form letter sent to many many people. I respond that I had already submitted all required and was told via email that I just have to wait for payments to begin on a "first come, first served" basis. I get the same confirmation again on 1/18/22. Mid September (I have the letter in a file cabinet at home) I get a snail mail letter stating they need more information. Stuff that had already been submitted I learn from their website but resubmit anyways. I trying to net be a pest give them more time and contact them again 1/13/23. I get both an auto response and another email stating that, essentially, the process is ongoing. I wait, and wait some more. I email again 12/1/23 and am told "all Class Member deadlines have expired and all settlement payments have been made. This administration is complete, no further claim revisions or updates can be made, and reissue requests are no longer being accepted. This matter is officially closed." I tried to email them on their website to no avail. I called them on 12/1 at 9:50am and gave all my information. I was told I would get a response. It has now been 3 weeks with nothing to show. This is a serious problem and pattern with this company per the ****** reviews..Business Response

BBB,
Thank you for your help in this matter. Last night, 01/17/24, at about4:50pm, I got a call from ***** at The Law Offices. He stated that my case was looked into more thoroughly and they found I DID have all required documentation turned in on time as I stated. He said a check will be issued and on it's way. Needless to say, I am cautious because we've all been told "the check is in the mail" a few too many times.
I doubt the 7 day window to call this case closed will suffice but if I get the check (or other correspondence), I will let you know

I qualified for two vehicles under the Mercedes-Benz Blutec II Settlement. The first vehicle was not a problem. I received my payment. For the second vehicle, they stated that I was missing information (even though I submitted the exact same information as the first vehicle). All of my communications with this company had been via email except for the one letter that stated that I was missing information. This came by regular mail. The deadline to submit the outstanding information was July 16th, I returned to ****** from a family ****** European vacation July 23rd and submitted the "missing" document July 25th. The have denied my payment.Had they corresponded this information vis email, like ALL of the other correspondences, I would have replied on time. They clearly pick and choose which methods to have the highest unlikelihood of someone responding.Business Response

I am rejecting this response because:All communication prior to their letter informing me that my file was incomplete was sent via email rather than postal. I was not in the country to receive the postal letter. Had they communicated via email, like all of their other communications, I would have been able to act in a timely manner. It was IMPOSSIBLE for me to act on this as I was in Europe. As soon as I returned, I acted immediately (July 25). Why not communicate this via email seeing as all of our previous communications were via email?
Sincerely,
