      I was a member of the class action against Mercedes--The Mercedes BluTec Case.I properly submitted all necessary forms and received notification from JND that my claim was successfully received. I never received my check for over 3500...emailed a dozen times with no response; finally sent a claim letter certified mail to their offices in *******. I get back an email that my claim was deficient as I did not show proof of the repair. This is untrue. I again submitted the documentation showing that the repair was made....they are either incompetent or crooks--given the other posts here and elsewhere online--I suspect they are plain old crooks.

      We are in receipt of the notification of the complaint filed by ***************************** in connection with the Mercedes Benz Blue Tec settlements.As the settlement administrator appointed by the Court in this matter, JND may only pay claims that meet the requirements set forth in the relevant Settlement Agreements and Court orders. Here, unfortunately, ************************ claim did not meet the necessary criteria for payment, as discussed below.

      ********************** did not submit proof that an Approved Emissions Modification (AEM) was installed in the subject vehicle, nor did she submit a signed Individual Release. The Settlement Agreements requires both of these as part of a valid claim. Accordingly, JND mailed ********************** a notice of deficient claim on April 22, 2022 to the same address ********************** provided in her this BBB complaint.  In response, ********************** submitted a signed Individual Release but failed to submit proof of AEM installation and her claim remained deficient.

      The deadline to cure deficiencies on an incomplete claim expired on December 31, 2022 and ************************ claim remains incomplete for the reason stated above. In accordance with the Court approved Settlement Agreements, ************************ claim was denied.

      I am rejecting this response because:

      JND's response is untrue.  Their own settlement website shows the repair was completed and this is the first I have heard they did not have my Release,

      which is attached.  I am a member of a class that was *********** compensation..I complied using their website, wrongly assuming that it would be acceptable way to provide them documentation requested--as they said it would be.  I waited patiently heard nothing for many months and when I finally called...crickets. Part of JND fiduciary duty to each of the claimants was distribute the money to the people who were harmed.  I complied with all requirements of the settlement-they just decided not to pay me and obviously from the many many other complaints I am not alone.  I will take my claim to Small Claims Court and report them to the Attorney General.

      I sent an email to ************************** on December 8th asking "specifically" IF my claim was being reviewed. Not a hard question to answer. Perhaps I was asking because I filed a claim and never received any emails. It has been awhile since I initially filed my claim. I received an email back on December 11th by stating, "if I filed a claim than nothing further is needed from me. And we're still processing claims on a rolling basis". I responded to the email on the same day by saying, "Well, I didn't receive any emails". After my last email, never received any additional emails. Okay so is my claim being reviewed or not? Was my online claim even received?

      I am rejecting this response because:

      As previously stated, the proper documents were resubmitted on May 25, 2022 via the online portal based on the NOTICE OF DEFICIENT CLAIM sent by JND dated April 22, 2022. The following documents were used:

      1. Registration at time *** was installed. This fulfilled two duplicate deficiencies JND reported, and I quote:
            1.1. "Proof that the Subject Vehicle was registered in your name at the time the *** was installed. How to fix: Please provide proof that the Subject Vehicle was registered in your name at the time the *** was installed"

           1.2. "Proof that the Subject Vehicle was registered in your name at the time the *** was installed. How to fix: Please provide proof that the Subject Vehicle was registered in your name at the time the *** was installed"

      2. Registration from time of purchase. This fulfilled the deficiency JND reported, and I quote:

           2.1. "Proof that you owned or leased and registered the Subject Vehicle, including the dates of ownership or lease for your Subject Vehicle. Permitted documentation to prove ownership or lease includes your bill of sale, lease agreement, title, registration from time of purchase or lease, ********** of ***** Vehicles ("DMV") registration history, financing agreement, insurance documentation listing date of purchase or lease, or proof of lease payment; insurance documentation may suffice for proof of registration. Your documentation must show the date you acquired or leased the Subject Vehicle, as well as the date you registered it"

      Due to the ambiguous wording in section 2.1 above and the fact that ****************** registration does not list acquired dates, the Subject Vehicles bill of sale was also submitted. If any information was not received by JND via their online portal subsequent notice should have been sent stating and remaining deficiencies.  The cure date for deficiencies to be submitted was October 1, 2022. There was no subsequent communication from JNC of any manner beyond the NOTICE OF DEFICIENT CLAIM sent by JND dated April 22, 2022

After further review, and contrary to what **************** claims, **************** did not submit a bill of sale or any documentation sufficient for proof of ownership for the subject vehicle.The Settlement Agreements require claimants to meet the full list of requirements provided on the Claim Form, and as JND has detailed, **************** did not provide proof of ownership for the subject vehicle despite our instructions on the Claim Form and in the notice of deficient claim. Therefore,in accordance with the Court approved Settlement Agreements, ****************** claim was denied.

      As stated in my previous response, if approriate information was not received via the online portal when information was resubmitted, there was adequate time (several months) before the submission deadline. I was never contacted by JND, which indicated that I fulfilled all of the requirements. 

       

      This response is not acceptable from JND.  As the consumer, I attempted to comply with all requirements of the settlement. I am requesting the refund I am owned.  I'm happy to resubmit proof of ownership again if that is required.

      I am a victim of the Equifax Data Breach, I had to receive payments Claim, extended claim for time spent, and out of pocket expenses. The data breach , so far costed me millions of dollars based on actual numbers. Although, for some reason, some of those expenses are not allowed, however, even by their own matrix, I am owed significantly more than the recent $40 check they recently send me, which appears to be prima facie evidence of misappropriation of the monies owed to me but misappropriated by most likely JND Legal Administration. I submitted my information for extended claim time spent, out of pocket expenses multiple times and followed up with the claims administrator multiple times, each and every time, I was given a run around, I attempted to escalate it to their management, no one bothered to even call me back to attempt to resolve the situation. My claim was filed more than four years ago, in August of 2019. I am one of those victims who is impacted by Equifax from the start. I am still waiting for my payment for time spent, and my expenses, it has been reviewed and approved but I am still waiting to receive mine. I want my claim and extended claim issued immediately. it is way overdue, almost 4 1/2 years to administer and pay out a court approved settlement is completely unacceptable. I also want a regulator to look into the books of this company and audit them since it appears, it is business as always for this company as there are numerous other complaints made against this company and its misconduct in their what appears to be breach of their fiduciary responsibilities among others. My payment is due to me and I expect full payment immediately.

      I am rejecting this response because: it is a non responsive response, 4 1/2 years to pay my already court approved monies due to me, is simply unacceptable.  BBB needs to audit this company and its financials.  It appears that they are misappropriating court approved costs due to people, that is why there are numerous complaints against their misconduct.  BBB may want to write a letter to the judge assigned to the case informing him of this company's conduct in court's helping BBB with this company's audited financial statement that would be open for public's scrutiny.

      My story on my 3 MB Bluetech vehicles eligible for previous owner money from MBUSA class action lawsuit.In previous follow up email they responded if something is missing they ll reach out, but in a very recent email, i was told JND no obligation to reach out if there were missing documents.I have kept the email chain going for almost 2 years, so all JND responses are all in the email.How can so many have made the mistake of not including the release ?? Maybe it s easy to "loose" documents at JHD, perhaps an disgruntled employee that has gone rogue, or orders from a disgruntled supervisor to shred every 3rd release making the claims deficient. The possibilities are endless, who is supervising and validating the process ?? Who keeps the deficient claim payout money ?? being the $700 million dollars + - was based on delivered vehicles, MB knows who bought them. They also know who currently owns them thru State Title / Registration and the *** reports from the dealers still servicing these defective diesels.I have reached out to MBUSA, The Lawfirm of **************** and my Local State ***************** bringing My Claim issue to their attention and forwarding my email chain to each. I'm doubtful I'll hear from anyone, but my promise to MBUSA,If MBUSA doesn't step up and at least follow up with JND , since *** was hired by MBUSA to administer the monies, a new *** is in my future instead of a new MB and they'll have 1 more 2023 S class rotting on the lot.

Additionally, per the Settlement Agreements, a claimant must submit a signed Individual Release in order to have a valid claim. ******************* did not submit proof of ownership, proof of sale, or proof of registration for two of his five **********************. Accordingly, all five of Mr.********* ********************** are deficient.

      The deadline for former owners, such as ********************, to submit a complete claim expired on July 12, 2021 and all five of Mr. ********* ********************** remain incomplete for the reasons stated above.       I filed claims for a 2012 s350 2013 sprinter and 2015 sprinter in my math, that's 3.

      I have an email from your office stating you would contact me if any claims were deficient after I asked about status of claims.  I have a lengthy email history with your office.

       provided proof of ownership of all 3 vehicles with insurance verification from NJM insurance.

      JND Legal Administration (JND) is serving as the Administrator in ************ Lodge No. 177, *************** v. ************************* (Case No. 2020-L-001297, Circuit Court for the ********************** of Madison County, ********) class action settlement.  On October 6, 2022,the Circuit Court for the ********************** of Madison County, ******** entered the Order and Final Judgment approving the Settlement on a final basis.  The settlement Class includes:  All policyholders under any Commercial or Personal Lines property insurance policy issued by the Insurance Companies, who made a Structural Loss claim for property located in the State of ******** during the applicable Class Periods, that resulted in an ACV ("actual cash value") Payment from which Nonmaterial Depreciation was withheld, or that would have resulted in an ACV Payment but for the withholding of Nonmaterial Depreciation causing the loss to drop below the applicable deductible.

      The deadline to submit a completed claim form was November 22, 2022.  ******************************* submitted a timely claim form, which was received on August 4, 2022.  On November 7, 2022, JND informed ******************* that his claim submission was received.

      In accordance with paragraph 7.1 of the Settlement Agreement, the Defendant shall calculate the amount of the Claims Settlement Payment to which each Class Member who timely submits a Claim Form is entitled,based on information that includes but is not limited to the total outstanding Depreciation for a Covered Loss. In making such determinations, the Defendant may consider all information reasonably available within their records to assist in making such determinations in good faith.  This review is currently in process by Defendant.  Payments or letters (if you do not qualify for a payment) cannot be sent until the claims administration process is complete and the timing for this cannot yet be determined.  However, the website, www.ilpropertydepreciationsettlement.com,will be updated as new information becomes available.

      JND Holdings LLC is a criminal organization that should be investigated.All necessary paperwork and documentation was submitted in the proper form for the Mercedes Benz Blue Tec settlement. Each valid participant is owed $3200.They did not pay me and many other valid participants.Based on the settlement amounts they stole hundreds of millions of dollars from the settlement victims.They owe me $3200.Sincerely ***********************

Now I know the deadline is January **** but that is for submitting the form My payment should have gone out for time spent it was confirmed I would be receiving 2 payments 1 for the initial claim which I was ripped off out that and the second payment was for my extended claim submitted that was confirmed in October 2022 and I have had my 2 claim numbers assigned way back in 2021, now according to the administrator it's on a first come first serve basis, that's not in settlement order that is finalized.I want my extended claim payment issued immediately it's now been a year since they started paying the victims yet my seems to be kicked or shuffled In lost paperwork. $38.00 roughly around there Administrator is still missing my extended payment.
