I parked in a lot on Saturday March 2nd, 2024 off 4th Avenue in ******* **. This lot had no arm or gate to bar entry which makes the lot free for public access. There was a sign that stated "leased parking Monday through Friday" which, because it was a Saturday, I assumed meant there was no fee for the day. I was parked there for approximately an hour. They then sent me a "ticket" which charged $46. They sent me a bill even though I did not agree to pay any charges for any services. There was no attendant available to notify me that parking in the lot was needing to be paid for. Upon review after receiving this ticket, signage was not properly posted as there was only one sign in the lot which was in the back corner, and a QR code to pay via smartphone was partially obscured by graffiti. Additionally, the so-called "fine" was five times more than the charge for services rendered after I discovered the "ticket". There is no legal authority for them to administer an invoice to me when the lot is open to the public and signage is obscured and confusing. This is frankly an extremely predatory business tactic and it is illegal in most other states. I am seeking that Diamond parking drops this charge and stops giving illegal tickets to unsuspecting motorists.Business Response

I am seeking to get this erroneous debt removed as they are attempting to collect from me when I did not agree to services rendered, as the parking lot was open to the public (no gated entry) and the signage was obscured and confusing.

I dont feel I was in the wrong, I only walked away from my vehicle to meet a person with Developmental Disabilities, as she was a hand over to me, from another worker. We then immediately went to *************. Apparently an employee at Diamond parking watched me walk away after I parked; and it was then when he ticketed my car.
It would have been nice, if he would have said something to me at that point, I then could have explained the situation and that I only needed 5 mins. or less to pick up the other person and head over to *************.
Please see the attached documents- this is everything I have received from them to date and my explanation as well.
I did file a dispute with them directly and they declined.
Please get back to me and inform me as to what is going to happen and feel free to contact me, should you have any questions.
I did call **********************************- I spoke to ****** and he said that the best they could do was to offer me a reduction in the fine to $90.00. I did not accept or decline the offer.

Hello,
Please be advised, ************* is private property and strictly reserved for customer only while conducting business on the property. This means you are not permit the lot for any amount of time or reason. As per the signage if you cannot adhere to the terms and conditions set in place you are not permitted to park there. They pay parking section across from you were parked allows you to pay and then do business in the neighboring areas. You chose not to utilize that option.You appealed online on Nov7/23 and were responded to Nov10/23 stating the rules and that you were lacking evidence. We provided an opportunity, as a courtesy, to submit receipts supporting your claim of conducting business, but there was nothing submitted, no correspondence. We sent a past due notice Dec11/23, a Final Notice Dec29/23 both advising the balance outstanding would be send to a third party collection agency if further unpaid, again, with no correspondence. Now being contacted by collections you wish to appeal once again. Unfortunately this will not be accepted. This notice is valid and remains payable in our system.

I do not accept this from Diamond Parking.
I just needed 2 minutes for the handicap person with developmental disabilities to be handed over to me and we did go to the mall immediately after I don't feel I should be penalized for not heading directly into the mall that minute.
I left my vehicle for no more than a couple of minutes... it was for a very good reason and I feel Diamond parking is not understanding or sympathetic to the cause- it's not like I parked my vehicle there and went to a different location. I parked there to go to the mall in which I did, but needed a moment to help out my hand over with disabilities.
II hope they see my point... Otherwise I will seek out my options with the Government

Diamond Parking incorrectly charged me for parking in their parking lot. They stated that parking under 3 hours was free and yet gave me a ticket even though I left the parking lot prior to the 3 hr ***** They stated that my license plate was not accounted for but I registered my new license plate number which I acquired digitally 2 days ago with them online prior to leaving the parking lot (image attached)I registered with their website (which they required) prior to parking and they have yet to rescind their ticket despite me providing evidence that I should NOT have been charged. Went to park in a lot at ***************************************. Signs posted said Sunday is free, and the pay kiosk wouldn't accept payment, stating Sunday is free. Came back to a citation on my car demanding payment of $65.50. Most of the cars in the lot had citations on them. Contacted the company and offered to pay the parking rate for the 3 hours I was there, which would at most be $12. They stood by the fee and said they could do a one time reduction to $25.21, which includes taxes and fees. If I want to pay online there will be additional charges. I parked my car in diamond parking lot at ******************************* (*******) Went to ******'s pharmacy, then to ******* for groceries. Our goal with any customer, is to provide the reason the notice was issued to prevent it from happening again in the future. First, I want to state that this location is private property and Diamond Parking has been hired to enforce these parking rules as posted on the property due to the unauthorized use on the facility. One of the rules posted is that you are not permitted to leave the property without your vehicle, or you can be ticketed and/or towed. You can park for free only while conducting business on the property. Once you leave the lot, for any amount of time or reason, you are in violation. Specifically in your case, you were witnessed by our patroller leaving the lot and the patroller is contracted to immediately issue a notice. The photos on file do in fact show a ticket issued under your wiper blade. We have voided it as a one-time courtesy. A ticket issued like this in the future will be considered valid. Thank you.

On 14 February **** I parked in a Diamond Parking lot in downtown ******* ** (lot B266) (near the Fox Theatre). I paid in advance ($17.45) per their signage at approximately 5:40 PM for a nearby event whose doors opened at 5:30 PM. My credit card was billed for this charge; my friend witnessed me paying this charge. This transaction was witnessed by my companion, **************; her contact information can be made available.At 6:13 PM Diamond ticketed me $46.50 for "failure to pay in advance." However, my credit card *was* billed for the charge at 8:09 PM; I was still attending the event at this time.I attempted to challenge the ticket with Diamond in a series of emails, including a screen capture of my credit card charge (attached); Diamond refused to accept my challenge.I have paid the $46.50 in order to avoid further charges, but informed Diamond that I will pursue further challenge of their charge. I have begun investigating Small Claims Court; assuming that I prevail, a realistic remedy will be in the vicinity of $600 (TBD) (court cost, process server, several hours of my time).This may seem like a lot of trouble to go to, but it is the *second* time in six weeks that Diamond has incorrectly fined me for "failure to pay in advance" and it is simply wrong. It is effectively extortion as business model, relying upon the difference in time between payment and actual billing.As an example of their sloppiness, they didn't even record my license plate correctly.Business Response

I am writing to file a formal complaint against Diamond Parking Services regarding an unjust parking charge I received on February 11, 2024, at the ****************. parking lot in ****************, ******. The ticket (Reference#********) indicated that I had to pay $86.50 within 10 days or else I have to pay $126.50 if after 10 days for the reason of "Failure to Pay". Despite my attempts to dispute this charge directly with the company, my appeal was denied under conditions I believe to be unfair and misleading to consumers. This parking lot has been designated as "retail parking," free for customers of the adjacent stores. This understanding was based on consistent past experiences and a lack of clear communication regarding any recent policy changes. On the date in question, I parked under the belief that this policy was still in place. It was only after I had commenced receiving services within a retail establishmentspecifically, while during a nail service that I was made aware of the new requirement, which was solely available via a QR code payment system. At the time, I was without my phone, unable to comply with this sudden payment. I filed a dispute upon receiving the parking notice, outlining several points: 1. The lack of sufficient notice regarding the change in parking policy; 2. The inadequate information provided; 3. The absence of feasible alternative payment methods. However, my appeal was denied with a response that I found to be dismissive and lacking in addressing the core issues raised in my dispute, particularly the lack of clear communication about the parking policy changes and the unreasonable expectation for customers to have immediate access to mobile payment methods. Please note that this location is private property and Diamond Parking has been hired to enforce these parking rules as posted on the property due to the unauthorized use on the facility. The lot in which you were ticketed is a pay parking lot. The property manager sent out a notice to the retail tenants to let them know about the change well in advance so that they can let their customers know. Also one of the pictures from the patroller show you parked in the stall beside the pillar with the sign right at your drivers side door advising this is a pay lot and how to pay for parking (See attached). The are also other signs on the lot. Unfortunately the notice is valid. We will however, reduce that amount to $60 as a one time courtesy. This amount will hold on the account until the end of day Feb 29th, 2024.

The sign you mentioned was placed beside a pillar, which can easily be missed, especially if one is not expecting new information. In the attachments, you will find photos of this and one of the only two signs regarding payment for parking, which notably does not provide any alternative way of payment other than via mobile. This highlights the inadequacy in the visibility and accessibility of the new parking policy information.

Expecting all customers to have a smartphone, along with the knowledge and ability to use QR codes, does not cater to all demographics. Please be advised your vehicle was parked at one of the stalls with the large sign posted on the pillar beside your car. It is the driver responsibility to be aware of their surroundings and signage when entering private parking facilities at all times. The accountability is with the driver. There is in fact adequate signage on the property, and being unable to comply with the them due to not having a cellular device does not negate the rules and requirements to park here. If you cannot comply, you cannot park. The notice is valid. I will, for the last time, extend the offer to pay $60. This will expire end of day March 7th, 2024. Thank you.

I was issued a parking ticket in the amount of $66.50 today by this company, at a building where I've been parking for the last 4 years. I have been a regular customer of the business at this location. As far as I am aware, up until very recently, this building allowed for customers to park in their parking garage for free. I got out of my car and went upstairs per usual to do business, and when I got back to the parking garage, I only then noticed small signs, placed in nondescript locations, indicating that now parking was free for 2 hours, BUT ONLY if you registered with the park mobile app. I registered ASAP hoping to abide by the rules, but when I got back to my car, discovered that I had already been issued a ticket for "No advanced payment". This is not fair, decent or just business practice. Because signage is not consistently placed in parking stalls, and is not prominently visible ON ENTRANCE to the garage, this feels like a sleazy way to hide signage and play "gotcha" with fees on longstanding regular customers. Notice should be placed that the garage is under new management and requires registration to avoid fees in places that are OBVIOUS to the eye when driving a vehicle.Business Response

My 10 year old son and I shopped the ******* grocery store the morning of Feb 7, ****. After shopping, my boy began feeling ill so we looked for the customer washroom. Upon finding the washroom, the manager of the store informed us the customer washroom was out of ************************* this quickly escalated to an emergency bathroom incident, we rushed to the nearest washroom I could think of, which was directly across the street at a medical building.They were gracious in allowing us to use their washroom. When we returned to the ******* parking lot, Diamond Parking Service penalised me with a parking violation, citing the parking is "for customers only. Walked off towards medical centre". I have been ******* customer for over 20 years, and was a customer on this particular day as well. We only left the ******* parking lot briefly for a washroom emergency for my child.I disputed the violation the next day; only to have the dispute declined Feb 13th.As a long-term paying customer of ******* Canada, this ********************** ticket should be retracted for the reasons stated above.It's quite unfortunate to have a parking attendant literally stalking customers in this manner. We only walked off the property for a bathroom emergency for a child. Diamond Parking has clearly lost site of the facts, and have zero compassion for children in need. Please note that this location is private property and all parking rules have been created by the property owner(s). Diamond Parking has been hired to enforce these parking rules as posted on the signs throughout the lot. If the occupant/driver leaves the property without their vehicle (for any amount of time/for any reason) they will be subject to ticketing and/or towing. There was no documentation/receipt proved with a date and timestamp showing you were a customer at the time as stated, and your vehicle was parked at the back corner spot. With this evidence the decision was made and the ticket is upheld. We will as a one time courtesy reduce the amount to $60 to be paid by Feb 20,2024.

I was never asked to provide proof of payment in this case. Fact is, I threw the receipt in the trash bin as I left the store in a rush. Im sure that can be validated on CCTV.
Under better circumstances, I could provide bank statements to prove payment, but am not willing to provide to Diamond Parking.
As Diamond Parking continues to conduct its business so unprofessionally and without intelligent compassion, there seems no option for me but to pay their reduced fine amount set forth.
Its very unfortunate businesses like this continue to operate by harassing legitimate paying customers that face adversity with children.

I have been sent a past due notice for a parking ticket that was supposedly left on my dash by Diamond Parking Ltd. I find that worrisome because a) I always check my parking receipts and b) I dont ever remember parking at their lots. On further inspection I see the spot they are referring to in ************************, on 01/02/2024 at 11:05. 1) I have never been to that street or space. 2) I dont know if they mean dd/mm/ yyyy or mm/dd/yyyy. Both are not possible since on 2nd Jan I was at work all day and at home all night. And on 1st February I was on a flight between ***** and ****** at both 11:05AM and 11:05PM. 3) the time doesnt specify day or night but I assume they mean morning. Again cant be me. Finally, stressed, I log in to their system worried Ive been duped only to find the photos of the violation have an Audi Q5 in the lot. I dont own that ********* is a Tesla *********** deeper inspection I see the plates say VE091B. Mine is VE091D. Theyve obviously sent the wrong person the notice which has my name, address and plate. Im now confused, disappointed and frankly wondering why I was threatened by the notice that they will ****************. Can you please help me get to the bottom of this? I appreciate the help.
