My wife and I had tickets to a play on Thursday, December 21, parked in a lot on 44th, scanned the ** code and paid for parking. Then came back to a ticket for $65 from Diamond Parking. Not interested in paying for parking twice because of poor signage and lack of clear information. Paid for parking in all good conscience and would like Diamond Parking to waive their ticket fee.Business Response

Thank you for reaching out to us regarding the notice ********** you received.
After further review of all QR codes signs on lot A140 **********************, it appears all signs and programming are working correctly. I also ran a revenue report which shows I had transaction on December 21st, 2023, throughout the day. After further review of the receipt,you sent in and in our Backoffice reports it look like you paid for parking from 10am and expired at 2pm same day. The notice was issued at 6:28pm. Our checkers handheld system (using a 3rd party application) does not give them in depth information as to which vehicle paid and expired. The system while checked in to the lot only shows vehicles that are paid or unpaid at the time of checking. We do apologize for any inconvenience this may have caused you. As a valued Diamond customer this notice is voided.

I drove my 73 yr old mother to the No Frills store on *************** (*********, **) so she could get some essentials and they ticketed me an $80+ parking fine!! Apparently it has to be the driver of the vehicle who does the shopping. Both Diamond Parking and No Frills are responsible for predatory parking patrols. An $80 fine for a <$30 grocery shop? I have the store receipt and I'm on camera in the store assisting my e mother out with her groceries. People on fixed incomes who shop at discount grocery stores don't have extra money laying around to pay these fines.Business Response

On December 11th I parked my car on ************* parking. I went to ******* *********** my wife didn't leave parking, she was on the phone waiting 10am, time when mall opens. I quikly checked in in medical office, came to my car and found the ticket says "walked off" (I'll attach it here). 1. No payment required for this parking. 2. Mall was closed. 3. By ******** Charter of Rights and Freedoms nobody can obstruct me to move where ever I want to. 4. They don't even have evidence I left parking area.5. My wife stayed on parking area. I presented all this argument to them in online appeal. They answered by email, shortly saying: "The officer witnessed the vehicle occupant(s) leave the property without their vehicle". Appeal denied. They don't even see any reasons to prove "violation". I need to pay them $120 after 10 days, with *****% annual interest.On my opinion, their employee, who issued the ticket, is not peace or police officer, so I don't see any reasons to trust him. That's why I made short video, sitting in my car. It shows, how their "officer" is witnessing leaving people - mall was closed, so he assumed, all people who parked there are leaving property, and issuing tickets to every car. But their sign does not say I should not park there, when mall is closed. I went to police - the said, they don't deal with such parking tickets from private organizations, by the way, they don't know it which way I can be forsed to pay them, in case I will ignore this ticket. That is what I am planning to do - ignore this ticket. As I know: "Nobody can be guilty, unless one's guilty proven". But still, maybe I am wrong, that is why I'm looking for an advice. We have reviewed your notice and appeal. Our goal with any customer, is to provide the reason the notice was issued and find fair resolution to prevent it from happening again in the future. This lot is private property and Diamond Parking has been hired to enforce these parking rules as posted on the property due to the unauthorized use on the facility. One of the rules posted (on the sign you submitted for evidence) is NO WALK OFFS CUSTOMER ********************** WHILE CONDUCTING BUSINESS ON PROPERTY.Unauthorized vehicles will be ticketed and/or towed. You can park for free while conducting business on the property. Once you leave the lot you are in violation. Specifically in your case, you stated you left and the mall was also closed. You were witnessed by our patroller leaving the lot which put you in violation, as stated on signage, and the patroller is contracted to immediately issue a notice. Your desired settlement requests a refund. As there is no payment made this is not an option. We will however, reduce the notice as a one tome courtesy to $40. This amount will only hold on your account until the end of day Dec 31st. To proceed with this courtesy, you may contact the Customer ********************** department at ************ and quote your reference number during business hours or visit ************************************************* .

I am rejecting this response because:As I mentioned in complaint, I trust what my spouse stated, not your "parking employee". He is not an officer from City or government. I made short video, how your "employee" does his duties - negligently, he issued tickets to every car, no need to check where owners went, mall is closed, right? But you sign does not say, "parking prohibited while mall is closed".
My wife showed the way to ******* lab, not leaving parking. I left, she stayed.
I have video evidence to not trust your employee. So please, provide me an evidence showing me and my wife leaving parking spot.
Otherwise, I'm expecting your apology for wasting my time, to prove you I'm not guilty, if it's actually your role before accusing someone, to prove someone's guilty.

Diamond parking issued me a ticket that they will not retract. The agent wrote that I went to the hospital but I did not. Their signage shows a Sunridge logo that is on all their signs, which insinuates that anyone can park in those spots who are using Sunridge services which includes Sunridge plaza. The business insists they are correct and the manager or whichever very unprofessional person I spoke to hung up on me and would not let me speak. They also now have seemingly blocked my number.Business Response

Hi there Reference ******** Dec 11 2023 **** to **** Monday Dec 11 2023 I scanned the bar code belong to Diamond parking. that was the first time I was using their app. I suppose to scan the code and register to avoid getting ticket. we have 90 min free parking and we have to just register any time we go that parking. As I had snap shot I didn't push the Done bottom and I thought it's finish and when I came back saw a ticket for $89.Ticket for the time that I was not even suppose to pay I sent the dispute they denied.I need someone to help me with this scam. On November 17, 2023, I parked in a Diamond Parking Lot (Lot Code: A675). At 5:51 PM PST, I made a payment of $15.87, covering parking from 5:51 PM PST on 11/17/2023 to 6:00 AM PST on 11/18/2023. Upon returning to my vehicle, I discovered a ticket indicating a $65.00 charge. Ticket Reference# ********** was issued at 7:24 PM PST on 11/17/2023, citing "No Advanced Payment" as the reason. This is inaccurate, as I had already paid for parking until 6:00 AM PST the next day, as evidenced by the receipt.Although my car did not remain in the lot overnight, the receipt clearly states that parking began at 5:51 PM PST on 11/17/2023 and concluded at 6:00 AM PST on 11/18/2023. The ticket's rationale contradicts this information. I disputed the ticket on their website, but on November 22, 2023, I received an email denying my appeal, insisting on the full payment of the ticket. This is unjust, given that I provided evidence of payment at the time of parking.I fail to comprehend why I should be penalized with a larger fee when I already paid to park. I am not seeking a reduction in the ticket amount but rather a complete dismissal. I was issued this parking Ticket by diamond parking while I was in the parking lot for PCC in Fremont, **. I was shopping and came out to have this ticket on my car. There is a sign stating that the lot is for PCC shopping. There was no other signage to say that parking was to be paid by some other manner. I tried contacting the company and they put me on hold and refused to admit that there is 1 hour parking for PCC shoppers at the lots location. They charged me $65 when I was only in the store 15 minutes. They are running a scam since I say a person walking around the lot giving out tickets but they do not have a way to determine who is sopping in the store.Business Response

Notice Reference # ********** Diamond Parking Service, *******, ** On November 29, 2023, I parked in what was marked as a "public lot" on **************** in *******. Upon parking, I noted signs in the lot indicating I had to pay for the parking by visiting the "PaybyPhone" app. I downloaded the app and paid for two hours using the location code on the signage in the lot. I also extended an hour using the same app, as was required due to the event I attended still going. When I came back to my car, I had a ticket from Diamond Parking for unpaid parking with a fine of $65.50. This made no sense because I followed directions as given on signage in the small lot that I used. I contacted Diamond Parking the next day and showed my receipts. I was told that I "may have paid a competitor's lot" and that my issue was be elevated to management. I received an email the following day saying that I broke the "terms and conditions" for parking at that location, but the fee was lowered to $25.21 "as a one-time courtesy". They also stated that I should contact the company I paid and ask for a refund (totaling $18.60).I responded to the message that any fine is unacceptable, as I followed all directions, and if Diamond has an issue with competitors (and their own company) being unable to properly post signage and collect fees, then it is their problem and not mine. I also questioned as to the possibility of the checker making a mistake in the ticket issuance. After three days, I have received no further answer or contact from Diamond and I have not paid the fine. I believe that any fine should be waived and am contesting this decision. The company is at fault for improper signage and overall despicable business practices in the "parking industry".Business Response
