I purchased a fake ***** ********************* shirt from a seller on Poshmark on 8/1/22 as soon as I opened the package I realized it looked nothing like the authentic ones I had previously purchased from Macys and even on Poshmark. The customer support told me to send pictures and I did. They told me they would respond I. 24 hours I noticed this morning after checking the app that denied the return and said it was authentic. I have pictures. First, the logo tag stitching is in white and the **** font is not all caps it saysPolo next I notice the authentic logo tag stitching is yellowish golden not white. Third there is a zipper instead of buttons. All the other ***** ********************* shirts I have for my so have buttons. The seller said they didnt realize it wasnt authentic and wouldnt have sold a fake meaning she was taking responsibility but my problem is Poshmark didnt take the time to even compare the item or listen. I was just asking for a return. I dont think thats unreasonable why would I pay $23.95 for a fake when I have authentic ones I purchased for under $30. When I tried to reach out again to them they said it was pass the 72 hours mind you they took 2 days to investigate and still denied the return this is ridiculous. I just want my money back for an item that is clearly not authentic even my son can see that and he is a kid. I will gladly ship the item back with the tags still on. Also the fourth thing I noticed is that is the sizing was off, Medium for boys in ***** ********************* shirts are ***** NOT ***** which is what this shirt is. All the other ***** ****** my son has including the ones from Macys are Medium *****. You cant speak with anyone only message. After 72 hours you get a reply saying its too late to return which is fine but I originally reported the problem in less than 24 hours. This is unacceptable!

I am rejecting this response because: I paid for a ***** ********************* shirt that is not authentic I requested a refund which is not asking a lot, but was denied the refund because your team member said it was authentic and it is not. My son has quite a few authentic ***** ********************* shirts and they look nothing like this one. Very disappointed I just want my money back and I will return the shirt I do not want it, its fake.

I have never seen a ***** ********************* shirt look like this and the sizing is also off. Medium boys is *****. If you can show me some type of proof that its authentic I would accept that. I dont think it was really investigated. I guess I have to just take your word for it because I doubt proof of authenticity will be provided. Disappointed but Im done.

On 23 July, 2022 I paid $57.67 for what it was described as a MAN's shirt on Poshmark. The seller had the listing under "men" "shirts" size small. Seller provided the following measurements, all approximate, 18" Pit to Pit, 22" Top to bottom, *****" Pit to wrist. Every garment buyer would trust that when the "Tag says "Small"" one would have to try it and take it from there. It is also expected that a size small would follow textile sizing standards. The shirt has a body length of approx. 21" The 1/2 chest width is approx. 19" The sleeve length (to the cuff) is also approx. 19" Comparing these to the chart: the shirt depicted would correspond to a man's XXS body and sleeve lengths but would fit a size. The shirt sent to me was NOT as DESCRIBED, that is, a MAN's SMALL size. To further prove it is not as described, I tried it on and the result is also attached. I wear a small size but the shirt the seller sent me is NOT a MAN's SMALL size. The platform Poshmark kept sending me the same canned message requiring more evidence to support my case. I had sent graphic evidence and clear insights of the garment being a WOMAN's and NOT a MAN's. The seller's response was evasive. The measurements given were from women's sizing which no one denied. I've been patient enough with the Poshmark Community team that insolently kept giving me the runaround and providing 0 support and robo-responses. No one from their support team bothered to check any of the content of my messages, let alone the trail of messages I have hitherto sent to them requesting a refund.Said marketplace Refund Policy reads:"When you make a purchase on Poshmark, we don't release payment to the seller until you tell us you've received your order as described. You have 3 days after delivery to inform us if the item has been misrepresented by reporting the problem in the Poshmark app or website with supporting photos."Poshmark failed to adhere to its own policy and offered an honest standard of ethics.

      Date: 08/11/2022

      Complaint: 17669004

I am rejecting this response because: Poshmark *** failed to uphold the Uniform Commercial Code, fully adopted by most states, stipulates that most new consumer products come not only with an express warranty, but also with a so-called implied warranty of merchantability. 2016 New York Laws UCC - Uniform Commercial Code Article 2 - SALES Part 3 - (***** - *****) GENERAL OBLIGATION AND CONSTRUCTION OF CONTRACT ***** - Implied Warranty: Fitness for Particular Purpose. "Where... the buyer is relying on the seller's skill or judgment to select or furnish suitable goods, there is unless excluded or modified under the next section an implied warranty that the goods shall be fit for such purpose." That is an automatic, unwritten promise that my purchase will perform as commonly expected, including that it will last a reasonable amount of time given the nature of the item. In most states, implied warranties are in effect for four years, although that doesn't necessarily mean a product must last that long. Implied warranties apply to retailers and manufacturers and may be broader than an express warranty.

Having a problem with said product that I think is the result of an inherent defect, I had let the retailer on Aug 2 (see attachment) know that I'll take its failure to resolve my complaint as a breach of the implied warranty and wanted to get the satisfaction of a refund, even to assert my rights through a credit-card chargeback. The fine print in most manufacturer warranties and online retailers' terms and conditions disclaim implied warranties. Although retailers rarely disclaim them directly, they sometimes do so by marking sales "as is," "with all faults," or similar language. A handful of states prohibit such disclaimers, even for as-is sales. And the federal ************************* Warranty Act prohibits companies from disclaiming implied warranties during the period in which any express warranty or service contract is in effect. After telling the **** seller " ricki_richi" that his product couldn't handle my shopping load (way inside the 220 lbs. advertised), the seller won't answer or wouldn't take it back. However, the law says, by providing a product that doesn't meet my stated needs, the seller breached another implied warranty: that of fitness for a particular purpose.

      Sincerely,

      *********************

This site/platform has continued to unjustly restrict my account. I have had my account wrongfully terminated /restricted for a bag that is clearly not a replica/dupe/counterfeit as they continue to accuse me of so therefore Im not in violation of any policies. I believe this company is racist and Ive had my picture taken down because I felt like I was a target. I see many women of Caucasian descent that post dupes/reps/counterfeits all the time. Ive reached out to this company multiple times to remove the restriction off of my account and all they offer is a sorry for the inconvenience rather than examining why this keeps happening. Ive attached a picture of the listing as this time no one from poshmark will answer my emails. It is a daisy rose bag. I want some sort of compensation, or Im taking this further. This is my final attempt to resolve things this way. Ive missed out on numerous sales and my reputation is stained from potential buyers. I dont want an apology I want it fixed and made right. Ive also attached images of all the counterfeits that have plagued this site from white women who dont get restricted or banned but get golden stars by their name.

I purchased $200 worth of clothing and $19 shipping costs for clothing through Poshmark from a seller called @shopstealsdeals. THEY ARE FALSLY ADVERTISING CLOTHING AND I GOT SCAMMED. I was told the purchase was insured by Poshmark Protect. I shared pictures of the DAMAGED wrinkled balled up clothing this seller mailed to me. I cant wear the damaged clothing. When I reached out to Poshmark, someone named ****** refused to help and offered advice for me to try and resell the damaged, unwearable items. This is absolutely UNACCEPTABLE AND UNPROFESSIONAL. I am asking that the BBB shut them down for refusing to refund when Poshmark advertised that purchases are insured. They lie to their customers. The seller should be shut down for sending damaged items balled up like garbage. Poshmark should be shut down too!!! I want my $219 refunded

On June 30, 2022 I created a listing to sell PMS brand skincare tools. I was thorough in my description as well as pictures included. I sold the listing on July 4, 2022 for $67 (free shipping & before Poshmark fees and taxes). The retail value of all the items sold was approximately $397. I shipped the order promptly on July 5, 2022. The buyer received the items on July 7, ********************************* stating the items are more scratched up than I expected them to be and couldnt get the *** kiss to work and a disc is missing. To which I kindly replied The *** kiss has to be charged to work (I included the charger and adapter in the shipping box because it is needed for the item to work). The logo on the back came off when I sanitized with alcohol. The white disc is the ultra sensitive disc so its not gritty like the green or blue one is. The scratches on the *** microderm tool are from where the cord was wrapped around it when stored. Poshmark ultimately sided with the buyer and allowed the buyer to return the items to me claiming that they dont support the buying and selling of skincare tools. The buyer shipped the items back to me and immediately upon arrival I opened the box to find the charger and adapter for one of the items missing. I immediately filed a report with Poshmark attaching pictures and explaining it was missing. 2 business days go by and I have yet to get a response. I email Poshmark and the representative that contacts me states that When a case is submitted by a seller, we take both reports and photos from each side into account. Unfortunately, we are unable to determine if this order was damaged before or after delivery to the buyer.. Nothing was damaged, as I explained, I just didnt receive items. I email back explaining that but they still were no help. Poshmark DOES NOT protect sellers. They allow buyers to STEAL from sellers. Do not sell merchandise on Poshmark.

I sold a pair of pants to a new with tags customer and she files a complaint this woman pulls out all the dysfunctional language gaslighting the martyrdom bringing up the tragedy in her life that has nothing to do with this transaction as you can see from her complaint she first claims that the pants are not as described when I tell her I took the description from the YF&B website and did not use stock images all of a sudden she finds ink stains -and her mother just died which has happened in 100% of the false claims I have gotten and is so gross I have included photos of the pants pre-packaging in the area she claims has stains, I use stickers instead of written thank you notes for just this reason so the ink does not transfer to the item she sent the pants raw dog in a box and did not resend the expensive tissue paper I used no bag no lining., she did **** with a pen- I have the close up of the before If you even bother to look at the conversation you would she claims to see that there is you can see a **** in the full-length photo which clearly isn't there 1st photo close up before it was sent, the You clearly didn't read this women's hysterical ranting which is unhinged -where she claims to see the tiny spot in the full link photos which she absolutely can't have, Photo # 1 entitled close up it is the area where she stained the pants before they were sent she wants to send them back because they are soft enough and when she finds out she can't do that all of a sudden there is a pen stain lucky for me she didn't stain them a lot I was able to remove it with a shout laundry stain remover photos 3 4 and 4 naked "pen" " taken out with shout wipe" "after cleaning". more hysteria which you didn't bother to read where she claims she could not in good conscience even resell the pants because they were "ruined" by this time **** I was able to remove them in under a minute luckily for me she is lazy as well as stupid

I purchased a paid of Jeans that was advertised as "line New" and size 32 (men). The paid arrived and I noticed that the jeans shrunk down to a size 30. I verified the size my taking measurements. I own several paid of the same jeans and extremely familiar with the fit. I contacted the seller who asked me if I wanted to return them. When I said yes, he asked to open a case with the platform (Poshmark).Poshmark got back to me and denied the return or refund saying the following:"Unfortunately, Poshmark does not support returns based on the time not fitting properly. When buying used items, please be aware that they may have been washed, shrunken, or in the other conditions that are altered from the original state. We advise buyers to ask detailed questions prior to purchasing the item..."My reply to that is that the item was advertised size 32 "like new" which is very misleading. Any clothes that have shrunken in a washer machine would be considered damage by definition and would certainly not be "like new"...I asked for them to reconsider the their decision and they never replied back. At this point, I I need another party to bring sense out of this ridiculous situation as the decision was simply unfair.

I purchased a Coach purse from a seller who failed to disclose a highly important detail which qualifies under Poshmark return policy to qualify a return. When I received the purse & opened the package, it immediately reeked of cigarette smoke. The exterior leather smelled of smoke. The inside satin fabric along with the pockets had a strong stench of cigarette smoke. There was one little gas receipt left in one of the ************ also reeked of cigarette smoke. I messaged the seller about the *********** completely denied my issue saying shes a non smoker and it did not smell when she packed it with ***** I requested a return with Poshmark support using there own return policy that the purse was not as described because the seller did not disclose the smell of cigarette stench. She also misrepresented the item by saying its in excellent used condition. The seller states she is a non smoker but many sellers use Poshmark to sell other peoples items so that doesnt mean she was the original owner of the purse. There is no way the owner of the purse was a non smoker. This is clearly deceptive of the seller. Poshmark sided with the seller & said my request reason did not qualify for a return because item is as described & seller did not misrepresent. As a courtesy they gave me a $5 credit towards my next purchase! I will never purchase through Poshmark again because they do not treat **************** equally. The seller who sold me the purse claimed in response to my complaint that she is a 5 star seller selling thousands of items. I am only a buyer so Poshmark obviously makes more money off of this seller than I make for them and I believe that is why they sided with her. That is the only reason I can come up with since my return reason DOES qualify me for a return according to Posmarks return policy. This is discriminatory to me. I want my full refund of the purse which is $85. I have no problem returning the item back to the seller. Seller can disclose & resell.

Poshmark agreed to cancel my sales transaction and issue a refund. I returned item to seller and received the confirmation email from Poshmark that transaction was canceled and refund was issued. Upon receipt of this email, I closed my credit card dispute since I, in good faith, was expecting Poshmark to issue the refund as promised. However, I have not received the refund to either my PayPal account or Citi credit card and have reached out to Poshmark no less than 7 times to ask for the refund status with no response. In 2 is their earlier replies, they instruct to reach out if I do not receive refund by 7/22/22 and 7/28/22. It is now July 30, 2022 and I have yet to hear from them or receive my refund.
