I am writing to lodge a complaint against ILYM Group, a financial firm that has been unresponsive regarding a significant issue with my payments. I work for In-*************** Services (IHSS) and receive my checks from the ************************* Some time ago, a portion of my check was deducted and sent to ILYM Group, but I have not received these funds back, and I urgently need them.Despite numerous attempts to reach ILYM Group through phone calls and emails, I have received no response. My calls go unanswered, and my emails are met with silence. This lack of communication is highly unprofessional and unacceptable. Additionally, my research online shows that many others have reported similar issues with ILYM Groups unresponsiveness and failure to return funds.The withheld funds are crucial to me, and the delay in returning them has caused significant financial strain. I have tried every possible method to resolve this issue directly with ILYM Group, but their consistent lack of response has left me no choice but to seek external assistance.I request that the Better Business Bureau intervene to facilitate the return of my funds. ILYM Groups behavior raises serious concerns about their business practices and customer service. We did send your check out to you when this lawsuit originally settled, but we were provided an old address from Commerce Distribution, but we had no way of knowing if the address was correct or not. I can re-issue your check out to you today, but just need your complete address. The *** code you provided does not match what we have in our system. Please email me your address to ******************************** and we will get this taken care of today.
We don't want to keep anybody's checks. We reported the un-cashed funds to the ************************* in a last attempt to reach all of the class members who have not yet gotten their money, in order to get an updated address so that you can get the funds owed.
As soon as you send me your current address I will print out your check and get it on it's way.

Hello ****,
This case had a value per work week of $22.8834, and amount per PAGA pay period of $2.80. Since you had 100 work weeks, that would be 100 x $22.88.34 = $2,288.34 plus the additional $2.80 for the 1 PAGA pay period gives the total settlement amount of $2,291.14. From there, we were required to split that settlement up as 80% penalties and 20% wages, which were $1,833.47 and $457.67, respectively. Then, taxes were taken out from the 20% wage portion based on ***************** employment tax rates, and that resulted in the net check amount you received of $2,120.20.
I did check our phone system to see why we weren't able to receive your calls, but couldn't find any record of you calling in with the number provided in this complaint so unfortunately I don't know why you weren't able to reach us! Where it says "the case had a VALUE PER WORK WEEK of $22.88", how did you decide on that number? is it specific to a position at the company, hourly, etc.
Just wanted clarification on how that number was settled on, i can expand but i think you will answer my questions in the following email.

The total settlement was $925,000, then there were $381,335.13 in attorney fees and costs, service award to the plaintiff who brought on the case, fees to the state and the $10,000 PAGA portion of the settlement.The work week amount was determined from the net settlement amount to be distributed to all class members, which was $543,664.87 after the deductions, and dividing that by the total number of work weeks for all class members combined, which was ******.When you divide that out, that's where the $22.8834 per work week is derived.

I have repeatedly tried to reach the ILYM group through calls, emails and change of address through their website and have received no contact on their behalf. I have been trying to reach out to this company for over a week now, left a voicemail, called numerous times, and emailed them through their website twice. A Class Action Lawsuit for **************** vs ****** settled months ago and the last public record from the judge stated that **** will take over any new information regarding the case to post but nothing has been updated from them! I had to spend hours googling until I found ILYM. I have called for the last two days with no answer or call back after a voicemail. I even updated my address just incase and there was no confirmation or follow up. Please update your systems to at least give the people an option to track their progress in a case, and, or an automated confirmation system when you receive requests from us. You know youre doing something wrong when you respond to complaints instead of phone calls or make callbacks.Business Response

Although the case had gone through the final process in the courts, there are additional processes between class counsel and defense counsel that happen, as well as waiting to receive funding from the company, before we can disburse the checks to all class members. We finally got the order to disburse the checks and sent out checks to all class members on 7/22/2024. We have your address correct in our system, so the check should be arriving soon!
I checked our phone system to see why we weren't able to get to your calls, but was not able to find any record of any calls coming from the number you provided on the complaint in the last 90 days, so I can't say what had happened there! I know at times we do get inundated with calls, but we make sure to get back to everyone and want to make sure everyone gets the money they are entitled to from the lawsuit! I am NOT satisfied with above response until a tracking number and delivery has been provided of approved funding settlement check. This case was completed/settled almost 1 year ago in October of 2023 by San Bernardino County Superior Court and I WILL NOT ACCEPT any response until delivery of settlement check. Also I am dissatisfied as an email can always go ignored. If company is unwilling to receive calls or provide call backs to people affected by settlements I do not trust they will respond via email. I would appreciate more detailed reasoning as why settlement has not been paid out as it has been almost a year.Business Response

The reason the settlement checks have not been released for this case is because the full funding amount has not been completed by the defendant. The parties had agreed to monthly installments and the full payment is due the end of July. Once the final payment is made, we can release the checks. Disbursement of funds to the class members will likely occur late August.

About two weeks or so ago I had gotten a letter in the mail stating that they had a check for me regarding legal action taken against a company, WIS ************** The letter stated that I had to contact them by a certain date. I had sent a call the day after I received the letter as I had gotten my mail late. I had not received a call back. After receiving no call I had tried contacting them again to no avail. I let another day pass and sent out an email contacting this company. Unfortunately that email has been unread as I have not gotten any sort of contact back.
